Govt wants to monitor WhatsApp messages, says SC

New Delhi, Jul 13: The Supreme Court on Friday took a strong note of the Information and Broadcasting Ministry's decision to set up a social media hub for monitoring online data, observing that it will be "like creating a surveillance state".

The top court said the government wants to tap citizens' WhatsApp messages and sought its response within two weeks.

A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud issued a notice to the Centre on a plea by Trinamool Congress (TMC) legislator Mahua Moitra and sought Attorney General K K Venugopal's assistance in the matter.

"The government wants to tap citizens' WhatsApp messages. It will be like creating a surveillance state," the bench said.

Senior advocate A M Singhvi, appearing for Moitra, said the government has issued a request for proposal and the tender will be opened on August 20.

"They want to monitor social media content with the help of this social media hub," Singhvi said.

The bench then said it is listing the matter on August 3, before the opening of tender on August 20 and AG or any law officer for the government will assist the court in the matter.

Earlier, on June 18, the apex court had refused to accord urgent hearing on the plea seeking to stay a central government move to set up a 'Social Media Communication Hub' that would collect and analyse digital and social media content.

The counsel for Moitra had said that the government is trying to monitor the social media contents of individuals by tracking their social media accounts such as those on Twitter, Facebook and Instagram, and their e-mails.

Recently, the Broadcast Engineering Consultants India Limited (BECIL), a Public Sector Undertaking (PSU) under the ministry, had floated a tender to supply a software for the project.

Social media platform WhatsApp assured the Supreme Court on Wednesday that it will not roll out its payment services without complying with all payment regulations and norms in the country.

A bench headed by Chief Justice S.A. Bobde and comprising Justices Indu Malhotra and Hrishikesh Roy took up the matter through video conferencing. Senior advocate Kapil Sibal, representing the social media platform, said "WhatsApp Inc makes a statement on behalf of his client that they will not go ahead with the payments' scheme without complying with all the regulations in force."

The statement was made during the hearing of a petition seeking a ban on payment through WhatsApp, as it does not conform to the data localization norms. The top court took the assurance made by WhatsApp on record.

In 2018, WhatsApp was granted a beta licence to launch its payment service, but a dedicated and separate app is yet to be launched. A petition was moved in the apex court that WhatsApp's existing model for its payments service should be declared inconsistent with the Unified Payment Interface (UPI) Scheme, as a separate dedicated app has not been offered by the company.

The petitioner NGO, Good Governance Chambers, argued that the National Payments Corporation of India (NPCI) and the Reserve Bank of India (RBI) must change its model on the lines of the UPI payment scheme, and its operations may be suspended until these conditions are met.

The apex court today asked the Centre, Facebook and WhatsApp to file their replies within three weeks and it will take up the matter thereafter. The court noted that the government may process the applications filed by WhatsApp in accordance with the law and there is no stay on the same. Facebook was represented by senior advocate Arvind Datar.

The petitioner argued that lapses have been found in relation to WhatsApp's claims of having a secure and safe technological interface for securing sensitive user data.

New Delhi, Jan 19: Messaging service WhatsApp which on Sunday faced issues in transmitting multimedia content including pictures and images, prompting social media users to share hilarious memes and messages, resumed regular services after over two hours.

#WhatsAppDown was the trending hashtag on Twitter for most part of Sunday afternoon in India along with several other countries such as Brazil, Europe and also parts of Middle-East including UAE, reported downdetector.in, a realtime problem and outage monitoring website.

Users of the popular messaging app were unable to send media files, stickers and GIFs.

Most users immediately went to Twitter to find out about the problem and check if others were facing the same issue.

Numerous tweets and memes took over the internet as soon as the news broke about the WhatsApp tech issue. After around two hours of technical glitch, the app resumed full service.

Even after full recovery of media transfer, people globally still continued checking the status of the messaging app.

WhatsApp has been one of the prime messaging apps since May 2009 and has recently collaborated with Facebook.

Unnao, Feb 26: Ever heard of someone wishing a 'bright future' for the dead? In a bizarre incident in Uttar Pradesh's Unnao district, a village head issued a death certificate with the wish for an elderly man who had died last month.

The incident took place in the Sirwariya village in Asoha block where an elderly person Laxmi Shankar died after a prolonged illness on January 22.

His son went to the village head Babulal and requested him to issue a death certificate that he needed for some financial transactions.

Babulal not only issued the death certificate, but also 'wished' 'a bright future for the deceased' on the document.

The village head wrote in the death certificate -- "Main inke ujjwal bhavishya ki kaamna karta hoon (I wish him a bright future)."

The letter went viral on the social media on Monday after which the village head apologised for the error and issued a new death certificate.
