HC defers Salman Khan case to July 1 as case papers not ready

Mumbai, Jun 15: Ordering expeditious completion of case papers, the Bombay High Court today adjourned till July 1 a criminal appeal filed by Bollywood superstar Salman Khan against his conviction in the hit-and-run case in which he has been awarded a five-year jail sentence.

salman khanWhen the case came up for hearing, Justice A R Joshi was informed by Salman's lawyer Amit Desai that the 'paper book' (compilation of evidence and documents which is served to both the sides by the court) was not complete.

The judge then ordered that this task should be expeditiously completed and deferred the matter till July 1.

On behalf of the Maharashtra government, Chief Public Prosecutor S S Shinde appeared and consented to the date fixed for the next hearing.

Salman did not come to the court. His sister Alvira was, however, present.

The HC had on May 8 stayed the execution of the 5-year sentence awarded to 49-year-old Salman in the 13-year-old case and granted him bail while admitting his appeal.

Salman was convicted by a sessions court on May 6 and sentenced to five years' imprisonment on various counts, including 'culpable homicide not amounting to murder'.

A man was killed and four others were wounded when the actor's Toyota Land Cruiser ran over them while they were asleep on a pavement outside a bakery in suburban Bandra on September 28, 2002.

Salman has challenged the findings of the trial court that he was drunk and was driving under the influence of liquor. The actor pleaded that the trial court had wrongly convicted him under the culpable homicide charge, because he had no knowledge that he would meet with an accident.

In the appeal, Salman has argued that the trial court had failed to appreciate the fact that four prosecution witnesses, including the investigating officer, had maintained that there were four persons present in the Toyota Land Cruiser when the accident took place and that it was the family driver Ashok Singh who was at the wheel.

Apart from being convicted of culpable homicide, Khan was also found guilty of offences under section 279 IPC (rash and negligent driving) and sections 337 and 338 IPC (causing hurt by acts endangering life or personal property of others), which prescribe six months' jail.

Besides, he was sentenced to undergo jail for six months under sections 181 (driving without licence) and 185 (drink driving) of Motor Vehicles Act.

Salman was also found guilty under the Bombay Prohibition Act's section 66 (a) and (b) for which he received two months imprisonment and fine of Rs 500. All sentences will run concurrently.

Salman's lawyer Amit Desai had earlier argued in HC during admission of the actor's appeal that the prosecution's sole eyewitness Ravindra Patil (Khan's then police bodyguard who passed away in 2007) was an "unwilling witness" and he was "forced" to give his evidence about Khan driving the car.

The lawyer had also contended that Patil had in an interview a day after the accident said there were four persons in the car. However, during the trial, he contradicted himself by saying there were only three persons.

Desai argued that the trial court judgement holding that Khan was driving the car and that he was under the influence of liquor was not satisfactory. He also said that the trial court had failed to consider the defence plea of a 'tyre burst' having caused the accident.

Khan's lawyer had also questioned the prosecution's failure to examine singer Kamaal Khan, who was present in the car at the relevant time along with the actor and was a key eyewitness.

However, government pleader Sandeep Shinde, though not opposing the admission of appeal, had objected to suspension of the sentence and argued that Khan had knowledge of consequences of rash and negligent and drunken driving.

Therefore, he said, the trial court had rightly convicted Khan under the charge of culpable homicide not amounting to murder.

Shinde said the blood test of Khan revealed there was alcohol content above the permissible limit. He also said that while Kamaal Khan's statement was recorded by police during investigation, he was not available to them for examination before the trial court as he was a UK national.

Refuting the defence claim of four persons travelling in the vehicle, Shinde said the theory of Ashok Singh being at the wheel was introduced at the fag end of the trial when Khan made a statement under section 313 of CrPC, and termed it as an "afterthought".

Mumbai, Jul 18: Filmmaker and Yash Raj Films (YRF) chairman Aditya Chopra on Saturday recorded his statement with the Mumbai Police in connection with actor Sushant Singh Rajput death case, an official said.

Police have sought information about a contract signed between Rajput and YRF from Chopra who visited Versova police station this morning and left after four hours, the official said.

The "Chhichore" actor, 34, was found hanging at his apartment in Mumbai on June 14. No suicide note was found from the spot by the police.

The police are investigating allegations that professional rivalry, besides clinical depression, drove the actor to suicide.

Police are also trying to understand the reason behind Rajput ending his contract with YRF, the official said.

Earlier, the police had recorded statement of YRF's casting director Shanoo Sharma.

The police had recorded statements of 34 persons, including Rajput's family members and close friends like actors Rhea Chakraborty and Sanjana Sanghi, in connection with the case.

Maharashtra Home Minister Anil Deshmukh on Friday dismissed the need for a CBI probe into the death case of Rajput, saying the Mumbai police are capable of handling the matter.

On Thursday, Rhea Chakraborty demanded a CBI inquiry to understand what "pressures" prompted Rajput to take the extreme step of suicide.

Rajput starred in films such as Shuddh Desi Romance', Raabta, Kedarnath and Sonchiriya. But his most prominent role came as cricketer Mahendra Singh Dhoni in the biopic, MS Dhoni: The Untold Story.

Los Angeles, Feb 21: Nepalese-Australian actor Dichen Lachman has joined the cast of the third film in the Jurassic World franchise.

Lachman, best known for Netflix series Altered Carbon and TNT show Animal Kingdom, is the latest addition to the Colin Trevorrow-directed picture, reported Deadline.

Universal Pictures and Amblin Entertainment project will see Chris Pratt and Bryce Dallas Howard reprise their roles. Mamoudou Athie and DeWanda Wise are also part of the cast.

The movie marks the return of original Jurassic Park stars Sam Neill, Laura Dern and Jeff Goldblum.

Trevorrow has co-written the script of the new film with Emily Carmichael. He will also executive produce the film with Steven Spielberg.

Jurassic World 3 hits theatres on June 11, 2021.

Mumbai, Aug 6: Taking over the case of the controversial death of actor Sushant Singh Rajput, the CBI on Thursday registered a case naming six persons, including his actress-girlfriend Rhea Chakraborty and her family members.

Besides Rhea, others named in the FIR are her family members Indrajit Chakraborty, Sandya Chakraborty and Showik Chakraborty as well as his house manager Samuel Miranda and the actress' manager and publicist Shruti Modi.

The registration of the case came a day after the Centre informed the Supreme Court that it has asked the CBI to take over the case following a reference from the Bihar government.

The entry of the CBI will not be to the liking of Maharashtra government, as it has already raised objection to the move, saying Bihar does not have any jurisdiction for a probe, as the incident happened in Mumbai.

The CBI has invoked charges related to criminal conspiracy, abetment of suicide, wrongful restrain, wrongful confinement, theft, criminal breach of trust, cheating and criminal intimidation against those named in the FIR.

The case will be probed by the Special Investigation Team (SIT) under the Superintendent of Police Nupur Prasad. DIG Gagandeep Gambhir and Joint Director Manoj Shashidhar will supervise the investigations.

The CBI FIR is based on a case registered by Patna Police on a complaint filed by the actor's father Krishna Kishore Singh, who accused Rhea and others of abetting Sushant's suicide and misappropriating his assets. The Patna Police had invoked sections related to criminal conspiracy, cheating, and abetment to suicide among others.

The 34-year-old actor hailing from Bihar, known for his stellar performance in Kai Poche and MS Dhoni: The Untold Story among others, died by suicide on June 14 in his apartment in Bandra in Mumbai on June 14. Mumbai Police has registered a case and had been investigating various angles when Sushant's father also registered a case in Patna against Rhea and others.

The case ran into controversy as Mumbai Police and the state government questioned the locus standi of their Patna counterparts with one of the senior Bihar Police officers who landed in Mumbai was sent to quarantine by state authorities.

Sushant's death had raised shackles with several actors and others questioning the nepotism in Bollywood after it emerged that he was under depression as he was not getting his due in the film industry.

It also assumed political colours with a section alleging that top Shiv Sena leader and Maharashtra Chief Minister Uddhav Thackeray's son Aditya Thackeray, also a Minister, has links to the incident. Aditya has denied any links.

BJP leaders, including former Chief Minister Devendra Fadnavis, had demanded CBI inquiry in the case.

The Bihar government acted fast in referring the case to the CBI, as the state was going to Assembly elections later this year and there was anguish among people over the state.

So far, Mumbai Police have recorded statements of 56 people, including Rajput's sisters, Rhea, and others from the film industry, after registering an Accidental Death Report (ADR).

The Enforcement Directorate has earlier registered a money laundering case against Rhea and others on the basis of the FIR filed by Patna Police. The agency on Thursday quizzed Miranda while it summoned Rhea for questioning on Friday.

Earlier, Rhea had approached the Supreme Court seeking transfer of the case registered by Patna Police to Maharashtra. In her plea, she had said that she was in a live-in relationship with Sushant from a year up till June 8 when the petitioner had temporarily shifted to her own residence in Mumbai. She has been in deep trauma due the death of the actor and moreover getting rape and death threats.
