HC stays BMC notice to raze illegal structure in Kapil Sharma’s flat

Mumbai, Oct 17: In a reprieve to standup comedian Kapil Sharma, the Bombay High Court on Monday granted interim stay on a notice issued by BMC in April this year directing razing of an illegal structure allegedly constructed by him at his flat in an 18-storey building in Goregaon.

kapilOn April 28 this year, the civic body issued notice to Sharma under section 351 of the Mumbai Municipal Corporation Act, claiming that certain constructions in the 18-storey residential building ‘DLH Enclave’ in Goregaon, in which the actor has a flat, were illegal and hence will have to be razed down.

Sharma had approached the Bombay High Court challenging a notice issued by the BMC directing razing of an illegal structure allegedly constructed by him at his flat in suburban Goregaon.

Sharma, in his petition, claimed that the Brihanmumbai Municipal Corporation (BMC) notice was “bad in law” and issued with “malafide intentions”.

Sharma’s advocate Pradeep Thorat informed a division bench of Justices Ranjit More and Anuja Prabhudessai that earlier the builder, Dev Land Housing Ltd, had also approached the high court against the notice and that the petition has been posted for hearing on November 23.

“Let this petition (Sharma’s) also be tagged along with that petition for hearing on November 23. Till then the notice is stayed,” Justice More directed.

The actor had kicked up a controversy last month by alleging that he had been asked to pay a bribe of Rs. 5 lakh by an official of BMC which, in turn, claimed that the actor had flouted norms not only in his Versova office building but also at his apartment in suburban Goregaon.

“In March and April 2010, the civic body issued commencement certificate to the developer granting permission to construct the 18 floors. On November 6, 2013, the corporation issued Full Occupation Certificate to the building,” Sharma said in his petition.

However, on November 14, 2014, BMC’s assistant engineer from Building and Factory department issued notice to Sharma claiming that he had made some illegal constructions in his flat in the building, and sought his reply.

Sharma, in his reply to the BMC, said no unauthorised construction was carried out at his flat in the building.

The civic body on December 1, 2014, however, replied refusing to accept the actor’s clarification.

Sharma then filed an application in Dindoshi sessions court against the notice. On December 28, 2014, the sessions court granted interim relief and directed the civic body not to initiate any action pending hearing of the application.

“Despite the sessions court order, the corporation issued another notice on April 28 this year directing razing of the building,” Sharma said in his petition.

Apart from Sharma, the BMC had issued notices to several other flat owners, including actor Irrfan Khan, for allegedly carrying out illegal construction in their flats.

Sharma, in his petition, sought the notice to be set aside and direction to be issued to the corporation not to act upon the notice pending hearing of this petition.

The petition is likely to come up for hearing in due course of time before a division bench of Justices Ranjit More and Anuja Prabhudessai.

Washington, Jul 16: Actor Chris Evans, better known as 'Captain America', made a six-year-old boy's day by sending him a personalised video message lauding his heroic act of saving his younger sister from a dog attack.

According to The Hollywood Reporter, the aunt of the young boy (Bridger Walker from Cheyenne) posted on Instagram the story of how the boy saved his sister on July 9 and was horribly injured in the process.

She shared the story on the photo-sharing platform on Sunday and also posted few photos featuring the brother-sister duo as well as pictures of the injuries on Walker's face.

"After receiving 90 stitches (give or take) from a skilled plastic surgeon, he's finally resting at home," wrote the aunt (Nikki Walker).
"We love our brave boy and want all the other superheroes to know about this latest hero who joined their ranks," she added.

Moved by the young boy's story, Evans made a direct video message appreciating the boy for what he did, and how he is no less than a superhero.

He also promised to send the young kid an authentic 'Captain America' shield as a reward for his selfless, heroic act.

Evans' video message to the young boy was shared by the aunt on her Instagram profile.
In the video, Evans is saying, "Pal, you're a hero, what you did was so brave, so selfless -- your sister is so lucky to have you as a big brother.

Your parents must be so proud of you," Evans said in a video message that the family shared Wednesday. "Keep being the man you are, we need people like you. Hang in there, I know recovery might be tough, but based on what I've seen, I don't think there's much that can slow you down."

Towards the end, the 39-year-old actor told the boy he was sending the 'Captain America' shield to him, as the world needs more bravehearts like the little boy.

Mumbai, Feb 27: Bollywood superstar Shah Rukh Khan on Wednesday said it's with constant education that a country, a family can move forward as there is never an end to learning.

In December last year, when the actor visited the Indian Film Festival of Melbourne, the La Trobe University announced the 'Shah Rukh Khan La Trobe University PhD Scholarship'. At the event to announce therecipient of the scholarship here on Wednesday, Shah Rukh said it was his honour to lend his name or be attached to the scholarship.

"I am a big believer in education. I truly believe that the way forward for any country, any family, city, state is by educating itself more and more.

"There is never an end to education. I've come to realise the more I know, I figure out, the less I understand. It's very important to keep educating ourselves for the rest of our lives.

"I've always believed education in India and elsewhere in the world, is the most important step forward for any nation," he said.

The scholarship aims to provides an opportunity for an aspiring female researcher from India to undertake research.

The 54-year-old superstar said what also will help taking the world move ahead is educating women.

"Related to the fact, is of course, education of women, empowering women, to look after themselves to look after their families...

"If you are able to empower them with education, the world goes even further forward," the actor added.

New Delhi Apr 10:  Actor Salman Khan on Friday thanked people for staying indoors and shared two pictures, first showing Bada Qabaristan's (graveyard) gate which has been closed due to lockdown and the second was of an empty street in Mumbai.

The actor thanked the people for listening to the guidelines and understanding the gravity of this situation amid the 21-day government-imposed lockdown in view of coronavirus outbreak. The tweet by 'Dabangg' actor came soon after the conclusion of Shab-e-Barat.

Shab-e-Barat is observed as a day of forgiveness or atonement in Islam and leads to congregations at graveyards and religious places.

The 54-year-old actor took to Twitter and wrote, "Wah! Thank u for listening n understanding the gravity of this situation the country is in. God bless n protect each n every 1.

Over the past few days, appeals were made to the Muslim community from several quarters to not venture out of their houses to pray on Shab-e-Barat in view of the COVID-19 lockdown.

Earlier, the 'Tiger Zinda Hai' star shared his lockdown experience in a video message with nephew Nirvaan and urged people to take the government's advisory of self-isolation seriously amid the rising cases of coronavirus in the country.
