Hit-&-run case: SC admits appeal against Salman's acquittal

New Delhi, Jul 5: Supreme Court today admitted for final hearing the appeal of Maharashtra government challenging the acquittal of Bollywood superstar Salman Khan in the 2002 hit-and-run case, but refused to fast-track the proceedings.

The apex court, however, did not allow the submission of Attorney General Mukul Rohatgi, appearing for Maharashtra, that the appeal be fixed for final hearing after six weeks as the matter is nearly 15 years old.

"We cannot put on fast track the hearing just because X, Y, Z is involved. We have to deal with so many important matters," the court said, adding that it may hear the appeal if the Chief Justice of India issues a direction.

During the hearing, senior advocate Kapil Sibal, who is representing the super star, said he has instructions that the matter be "decided on merits".

Meanwhile, the bench also agreed to hear a separate plea filed by senior advocate Pandit Parmanand Katara challenging Bombay High Court's order on the ground that a revision petition, instead of an appeal, should have been filed there.

Katara further said that the plea before the apex court was not maintainable due to alleged non-observance of the legal procedure.

The court, however, refused urgent hearing on the plea and said it would consider the matter later. The bench got irked when the lawyer insisted for an urgent hearing of his plea ahead of the petition filed by Maharashtra government saying, "are you arguing for the Press or for yourself. If you want to argue for the Press, then we are not interested."

Earlier, the apex court on February 19, had issued notice to the actor on appeal of the state government in the case saying that exoneration from the top court would "vindicate him once and for all".

Subsequently, another petition was filed by one Firoz Shaikh on behalf of the family members of a person who was killed in the 2002 hit-and-run case.

The plea had sought setting aside of the high court judgement and a direction to the 50-year-old actor to pay compensation to the wife and son of deceased Shaikh Noorulla Shaifik.

Maharashtra had said that the Bombay High Court had erred on two points while acquitting the filmstar. "Firstly, the High Court had erred in its finding by holding that there was 'erroneous application' of Section 33 of Evidence Act (relevancy of certain evidence for proving, in subsequent proceeding, the truth of facts therein stated) by the trial court," the Attorney General had said.

On second count, he had said the High Court had erred by holding that the prosecution witness Ravindra Patil, a constable who was guarding the actor and had first called the police, was not a "wholly reliable witness" and his version needed corroboration with accounts of other witnesses.

The Maharashtra government's appeal contained 47 grounds to assail the high court's verdict and sought restoration of the trial court's decision by which the 50-year-old actor was convicted and sentenced to five-year-jail term.

Among other grounds, the petition said, "High Court has erred in brushing aside the alcohol examination certificate and the evidence of the assistant chemical analyzer just because there was some alleged delay in taking the blood samples and for sending it to the chemical analyzer."

The high court, in its verdict passed on December 10 last year, had held that prosecution had failed to prove beyond reasonable doubt that the actor was driving the vehicle at the time of the accident and was drunk.

The high court judgement had come on an appeal by the superstar, seven months after he was pronounced guilty by trial court of running over five people sleeping on a pavement outside a laundry in suburban Bandra with his Toyota Land Cruiser, killing one and causing injury to four others.

On May 6 last year, a sessions court had convicted Salman in the case.

New Delhi, Apr 2: After donating to UNICEF to combat COVID-19, actor Kareena Kapoor Khan on Thursday announced that she will also contribute to PM-CARES Fund and Maharashtra's CM Relief Fund along with her husband Saif Ali Khan and son Taimur Ali Khan.

Kareena made the announcement through an Instagram post and also urged others to do their bit by doing whatever is possible.

"We extend our support to the PM CARES Fund and the Chief Minister's Relief Fund (Maharashtra)," read an official statement post by Kareena on Instagram.

"In times like these, every helping hand and every rupee raised matters. Do Help wherever possible," the statement further read.

However, the amount of donation hasn't been revealed in the post.

The star couple has joined a list of celebrities including Akshay Kumar, Varun Dhawan, Alia Bhatt, Vicky Kaushal and others who too have extended support to PM CARES Fund to fight against coronavirus.

Earlier on March 31, the 'Jab We Met' actor had announced their contribution to UNICEF, GIVE INDIA and the International Association of Human Values (IAHV).

There are 1764 active coronavirus cases in the country, while 150 people have been cured and 50 have died, as per the Union Health Ministry.

Mumbai, Apr 29: Irrfan Khan, one of India's finest and most versatile actors, lost his battle with a rare form of cancer and died in a Mumbai hospital on Wednesday, a statement from his family said. He was 54

Irrfan, who was diagnosed with neuroendocrine tumour in 2018, is survived by his wife Sutapa and his sons Babil and Ayaan.

It is the second tragedy for the family in less than a week. The ?Maqbool? actor lost his mother, 95-year-old Saeeda Begum, in Jaipur just four days ago and could not attend the funeral because of the nationwide lockdown.

Irrfan, that rare actor who straddled multiple worlds, making his mark in both international and Indian cinema in roles intense and light-hearted, was admitted to the intensive care unit of the Kokilaben Dhirubhai Ambani Hospital with a colon infection

?It's saddening that this day, we have to bring forward the news of him passing away. Irrfan was a strong soul, someone who fought till the very end and always inspired everyone who came close to him. After having been struck by lightning in 2018 with the news of a rare cancer, he took life soon after as it came and he fought the many battles that came with it,? the statement from his family said

?Surrounded by his love, his family for whom he most cared about, he left for heavenly abode, leaving behind truly a legacy of his own. We all pray and hope that he is at peace. And to resonate and part with his words he had said, 'As if I was tasting life for the first time, the magical side of it',? it added.

The news of his death was first confirmed by his "Piku" director Shoojit Sircar who sent his condolences to the family and doffed his hat to the actor's fighting spirit

"My dear friend Irfaan. You fought and fought and fought. I will always be proud of you.. we shall meet again.. condolences to Sutapa and Babil.. you too fought, Sutapa you gave everything possible in this fight. Peace and Om shanti. Irfaan Khan salute," the director said on Twitter.

Irrfan's death came the morning after news that he had been admitted to the ICU with a colon infection.

The self-effacing National Award winner, who acted in films as diverse as ?Life of Pi?, ?The Namesake? and ?Haasil?, had stayed away from the public eye after his diagnosis in 2018 when he went to the UK for treatment.

He returned home in 2019 and shot for "Angrezi Medium", the sequel to his 2017 hit "Hindi Medium". However, his health condition prevented him from promoting the movie, which hit the theatres in March just before the lockdown that began on March 25.

Mumbai, Jun 15: Actor Sushant Singh Rajput's death has reignited the discussions around the struggle of survival in Bollywood, with many insiders highlighting "cruel and unforgiving" nature of the industry, particularly tough on outsiders.

Rajput was found hanging in his Bandra apartment on Sunday.

According to a police official, Mumbai Police found out during the probe that the 34-year-old actor was under medication for depression.

An engineering student, Rajput left his course at the Delhi Technological University in the early 2000s and rose from a background dancer to a TV star with soap opera Pavitra Rishta, which gave the "outsider" his breakout show in 2009.

In 2013, he made his Bollywood debut with Kai Po Che! and went on to star in films such as Shuddh Desi Romance, Raabta, Kedarnath, Sonchiriya and Chhichhore.

But his most prominent role came as cricketer Mahendra Singh Dhoni's in the 2007 biopic, MS Dhoni: The Untold Story.

In a telling tweet, veteran actor Dharmendra wrote despite not knowing Rajput personally, his death served as a reminder that the industry could be "cruel".

"Pyaare Sushant, naa film dekhi na kabhi mila tum se... par tere achaanak chale jaane se bada sadma laga. This beautiful beloved 'show business" is very cruel. I can imagine your unbearable pain. I share the pain of your loving family and friends," Dharmendra wrote.

Actor Meera Chopra penned a powerful, poignant note about the loneliness one feels working in an industry, which is "cold and ruthless".

"We all knew well that Sushant was going through depression since long, but what did we do? Where was his close circle, the directors and producers he's worked with, his close friends? Why nobody came out and helped, gave him the kind of love, the work that he wanted - because nobody cares," she wrote on Twitter.

The Section 375 actor, who has been vocal about feeling suffocated by the constant judgement from the industry colleagues, said nobody in Bollywood cares about what one's going through and artistes are just a flop away from being alienated.

Chopra said the industry has "failed" Rajput and Bollywood will now never be the same.

"True, Bollywood is a small family, but a kind of family which is never there when you need them. He had to take his life for that family to realise the kind of pain and need he was in. An outsider will always feel like an outsider here.

"I just want to say to my industry that help people when they need it, and you know when they need it. There is no point tweeting when they are no more. Don't pretend to be sad when you guys didn't do anything when he was sad. Stop being such a hypocritical society," she added.

Gulshan Devaiah said, as an actor, one could understand why Rajput would've taken the step to end his life.

"As actors, somewhere deep down inside, we think we know why he did it and that’s why it so disturbing even if you didn’t know him at all. It’s a hard game to play and he played it very well but the game won in the end," Devaiah wrote.

Quoting Chopra's tweet, the Mard Ko Dard Nahi Hota star dismissed the idea of Bollywood being a family.

"If one thinks it’s a family, there is the problem. Bollywood is an imaginary name for a place of work, that’s it. I am really not trying to put anybody down here and sorry if it seems," he wrote.

On Sunday, actor-producer Nikhil Dwivedi posted a strongly-worded tweet calling out the "hypocrisy" of the industry after people from the film fraternity wrote they regretted not staying in touch with the "Chhichhore" star.

"High and mighty announcing they should have kept in touch with Sushant. Come on, you didn't! And that's because his career dipped. So STFU! Are you in touch with Imran Khan, Abhay Deol and others? No! But you were, when they were doing well," Dwivedi said.

Similar sentiment was echoed by filmmaker Anubhav Sinha, who, without taking names, said the "Bollywood Privilege Club" must sit down and think hard.

"Now don't ask me to elaborate any further," he tweeted.

Addressing outsiders, filmmaker Hansal Mehta wrote a long thread about the two ends of an artiste's time in the industry - the glorious successes and the crushing lows.

"There are many young 'outsiders' in this industry. Remember this - there is an establishment that will make you feel like the next big thing until they need you. They will drop you and mock you as soon as you falter. Do not fall for the trap. The ones that celebrate you will celebrate your downfall some time later," he tweeted.

Mehta said it's important for those who don't come from a film family to not force themselves to fit in.

"Just be authentic, follow your heart and stop seeking acceptance from anybody. Your connection should be with your art, your craft and with your audience. Nothing else matters. Over the years you will succeed, you will stumble.

"But remember that nothing is more important than you. Look after yourself. And know that you matter. The world is much bigger and wiser than what you perceive. So are opportunities. If you stay they will be yours. Lots of love. Never lose heart," the filmmaker wrote.

Celebrity hairstylist-turned-director Sapna Bhavnani claimed that Rajput's battle with mental health was out in the open and yet the industry chose to look the other way.

"It’s no secret Sushant was going through very tough times for the last few years. No one in the industry stood up for him nor did they lend a helping hand. To tweet today is the biggest display of how shallow the industry really is. No one here is your friend," she wrote on Twitter.
