INX media case: Delhi High Court dismisses Chidambaram's bail plea

New Delhi, Sept 30: The Delhi High Court on Monday dismissed the bail petition filed by former Finance Minister and senior Congress leader P. Chidambaram in the INX Media case.

Justice Suresh Kumar Kait dismissed the bail on the grounds that after being a member of the Bar and of Parliament, "there is a chance that he may influence the witnesses".

However, the court observed that Chidambaram is not at flight risk and is not likely to tamper with the evidence.

Kait dismissed the order after hearing the arguments from both the sides.

During the course of hearing, Solicitor General Tushar Mehta stated, "We are at a stage where we have exposed our evidence to him as we have confronted the accused and hence, the risk of tampering and influencing is much higher."

He submitted, "Some people are in so powerful position that their mere presence can influence the witnesses."

"To say that I am a responsible and respected citizen is not an argument altogether. Those who have fleeced the country are the ones who are respected and responsible and having business empire and what not," the Solicitor General observed.

Sibal opposed the claims of the prosecution and said that Chidambaram is not at flight risk, there is no evidence of him tampering with evidence. 

"After spending 40 days in prison, he will flee? They have to justify each day of incarceration. What is it that you cannot do outside jail but can do inside it," said Singhvi on behalf of Chidambaram. 

Chidambaram and his son Karti Chidambaram were named in the case by Peter and Indrani Mukerjea, who are currently in jail in Mumbai in connection with the murder of Indrani's daughter Sheena Bora.

The ED too had filed a money laundering case against Chidambaram in this regard in 2017.

Chidambaram has been lodged in Jail No 7 of the Tihar jail, which is meant for economic offenders.

He was sent to judicial custody by a Delhi court after his arrest on August 21 by the Central Bureau of Investigation for alleged irregularities in granting FIPB clearance of Rs 305 crore to INX Media, now known as 9x news, during his tenure as Finance Minister. Chidambaram is also being probed by the Enforcement Directorate in a money laundering case relating to INX Media.

Several senior leaders of the Congress including former Prime Minister Manmohan Singh, Congress interim President Sonia Gandhi, leader of the Opposition in the Rajya Sabha Ghulam Nabi Azad and senior Congress leader Ahmed Patel visited Chidamabaram in jail.

Earlier, senior Congress leader Jairam Ramesh on Friday also accused the government of planning a conspiracy to "defame and character assassinate" Chidambaram in the case. 

The Congress has termed the charges against Chidambaram a "paramount example of political vendetta".

Lukung, Jul 17: Union Defence Minister Rajnath Singh on Friday assured that not an inch of our land can be taken by any power in the world while he interacted with the Indian Army and ITBP personnel at Lukung.

Referring to the India-China border standoff, he said, "Talks are underway to resolve the border dispute but to what extent it can be resolved I cannot guarantee. I can assure you, not one inch of our land can be taken by any power in the world."

Emphasising on finding a diplomatic solution to the standoff, he further said, "If a solution can be found by talks, there is nothing better."
"Recently what happened between troops of India and China at PP14, how some of our personnel sacrificed their lives protecting our border. I am happy to meet you all but also saddened because of their loss. I pay my tributes to them," he added.

Singh interacted with the Army and Paramilitary troops here along with Chief of Defence Staff General Bipin Rawat and Army Chief General MM Naravane.

Earlier today, the Defence Minister witnessed para dropping and scoping weapons here. He also inspected a Pika machine gun.

Indian Army T-90 tanks and BMP infantry combat vehicles carried out the exercise at Stakna, Leh in presence of Singh, Chief of Defence Staff and Army Chief.

Defence Minister is on a two-day visit to Ladakh and Jammu and Kashmir. He will take stock of the situation at both the Line of Actual Control (LAC) and the Line of Control (LOC).

While Pakistan constantly violates ceasefire from across the LoC, China has continued to intrude into Indian territory in Ladakh region in recent past, escalating tensions between India and its eastern neighbour.

On June 15, twenty Indian soldiers laid out their lives during combat with Chinese forces in Galwan valley, leading to tensions between both nations. Chinese soldiers subsequently started moving back following dialogues between two countries through the military level and diplomatic level.

Singh was accompanied by the Chief of Defence Staff General Bipin Rawat and Army Chief General MM Naravane.

New Delhi, Jan 5: A masked mob on Sunday entered the Sabarmati Hostel on the Jawaharlal Nehru University (JNU) campus and assaulted several students and professors with sticks and rods.

"I have been brutally attacked by goons wearing masks. I am bleeding. I was brutally beaten up," JNU Students' Union (JNUSU) president Aishe Ghosh told reporters.

She has been admitted to the AIIMS here for treatment.

Several other students were also injured in the incident.

In a video of the incident, a group of goons with their faces covered can be seen assaulting students with wooden sticks and rods.

A tweet from the official handle of the JNUSU said, "Sabarmati Hostel: right now. They are beating the students who are inside. Knocking on doors with rods. People are jumping from balconies. #SOSJNU #EmergencyinJNU."

"Professors who were trying to protect us have been beaten up. These are unknown ABVP goons, not all are students, they have covered their faces, and they are moving towards the hotels near the West Gate. Stay alert. Make human chains. Protect each other. #SOSJNU #EmergencyinJNU," another tweet added.

Meanwhile, the ABVP's JNU unit claimed in a tweet: "Emergency in JNU. Leftist goons of JNU accompained with their cadre from other universities have crossed every limit. They have proceeded with unimaginable violence on ABVP activists of JNU."

Thiruvananthapuram, Apr 20:  Kerala Chief Minister Pinarayi Vijayan on Monday said that the government would revoke the order, which allowed the opening of barbershops and restaurants in the State.

The development comes after the Ministry of Home Affairs (MHA) objected to the move.
When asked about the letter issued by the MHA terming certain decisions as to the dilution of guidelines, Chief Minister Vijayan said: "There is no confrontation between the State government and the Centre."

"Kerala is following all directions issued by the Centre. Barbershops will not be opened and restaurants will only provide online delivery," he told the reporters, adding that public transport would not be allowed.

"There was a decision to open barbershops but many experts have pointed out against the decision. So the Kerala government is withdrawing the decision," he said.

Earlier, Chief Secretary Tom Jose said that if needed, then the State government will make necessary modifications to the lockdown guidelines in the wake of a communication received from the Central government.

The MHA had objected to the decision of Kerala government to allow services like barbershops, local workshops, restaurants, etc., and had urged the State government to revise its lockdown guidelines.

The Government of India had said that violation to lockdown measures reported posed a serious health hazard to the public and risk the spread of COVID-19.

Union Home Secretary Ajay Bhalla wrote to all Chief Secretaries and a separate letter had been sent to the Kerala Chief Secretary asking them not to dilute lockdown guidelines in any manner.

In his letter to the Kerala Chief Secretary, Bhalla had stated that the consolidated revised guidelines on the measures to be taken by the Ministries/Departments of the Government of India has been circulated on April 15 for containment of COVID-19.

Kerala Minister Kadakampally Surendran had said that relaxations have been given abiding by the direction issued by the Central government. He had added that the Centre may have asked for an explanation due to some misunderstanding.

India is under a nation-wide lockdown that came into force on March 25 to contain the spread of coronavirus, which has claimed 559 lives in the country. Last week, Prime Minister Narendra Modi announced the extension of lockdown till May 3.
