Juvenile accused: SC notice to Centre on father's plea

Juvenile_accusedNew Delhi, Dec 2: The Supreme Court on Monday issued notice to the Centre on a plea of the father of the December 16 gangrape victim that the juvenility of an accused needs to be ascertained by a criminal court and not by the Juvenile Justice Board.

A bench headed by Justice B.S. Chauhan also asked the Ministry of Women and Child development to file its response within four weeks on the issue of ascertaining the ‘minority of an offender’ in heinous cases.

It also sought the records including the statement of the victim that implicated the juvenile offender in the sensational case.

The victim’s father has moved the apex court seeking directions to put one of the accused who was then a minor on trial by a criminal court by quashing a law that bans such prosecution of juveniles.

The juvenile, who was six months short of 18 years at the time of incident, was convicted for gangrape and murder of the 23-year-old girl but he got away with a maximum of three years imprisonment mandated under the juvenile law by the Juvenile Justice Board in New Delhi.

The father of the victim, who had said the August 31 verdict of the Board was not acceptable to the family, has filed the petition in the apex court, saying since they are challenging the constitutional validity of the Juvenile Justice (Care and Protection of Children) Act 2000, there is no other authority concerned to which they can approach for such relief.

The victim’s father has sought a direction to declare “as unconstitutional and void the Juvenile Justice (Care and Protection of Children) Act to the extent it puts a blanket ban on the power of the criminal courts to try a juvenile offender for offences committed under the IPC”.

The petition filed through advocate Aman Hingorani said the juvenile “is liable to be tried and punished by the criminal courts for the aforesaid offences, complete with the judicial discretion on established principles of law regarding the award of sentence keeping in view, amongst other factors, the nature and gravity of the offence”.

The petition referred to the trial court verdict by which four adult accused were convicted and sentenced to death and sought similar trial for the then juvenile offender, who has now turned major.

“One of the accused (Respondent No 2 -- juvenile), however, has not been tried at all for the offences committed under the Indian Penal Code by the criminal court on the premise that he is a juvenile in conflict with law aged 17 years,” the petition, in which the Centre and the accused have been named as respondents, said.

It also stated that “the blanket protection to juvenile offenders from being tried by the criminal courts for offences under the IPC, is an instance of legislative adjudication, and hence unconstitutional”.

On the night of December 16, 2012, the girl was gangraped and brutally assaulted by six persons in a moving bus here.

One among them was the juvenile, so he was tried by the Board.

The victim succumbed to her injuries in a Singapore hospital on December 29, last year.

The four adult accused -- Akshay Thakur, Vinay Sharma, Pawan Gupta and Mukesh -- were tried by a fast-track court which awarded them death penalty. Now the sentence is before the Delhi High Court for confirmation.

Another accused Ram Singh was found dead on March 11 in his cell in Tihar Jail and the trial against him had been abated.

Jammu & Kashmir, Feb 7: Former Jammu and Kashmir chief ministers Mehbooba Mufti and Omar Abdullah, besides two political stalwarts from NC and its arch-rival PDP were booked under the stringent Public Safety Act (PSA) by the administration on Thursday, officials said.

A magistrate accompanied by police served the order to Mufti at the bungalow where she has been detained, the officials said.

Abdullah was also booked under the PSA, they said.

National Conference general secretary and former minister Ali Mohammed Sagar, who wields a support base in downtown city, was served with a PSA notice public order by the authorities.

Similarly, senior PDP leader Sartaj Madani was booked under the PSA. Madani is the maternal uncle of former chief minister Mehbooba Mufti.

Both Sagar and Madani were detained in the aftermath of August 5 crackdown by the Centre on politicians following abrogation of special status of the erstwhile state, besides its bifurcation into two union territories.

Their six-month preventive custody was ending on Thursday.

Earlier, the officials had said that former NC legislator Bashir Ahmed Veeri was also booked under the PSA but later it turned out that he had been released.

New Delhi, Apr 13: India's tally of positive COVID-19 cases rose to 9,152 following an increase of 796 cases in the last 24 hours, the Union Ministry of Health and Family Welfare said on Monday.

Out of the total number of cases, 7,987 patients are active cases while 857 cases have been cured/discharged and migrated.

With 35 deaths in the last 24 hours, the death toll mounted to 308.

According to the ministry, Maharashtra remained at the top with the total cases at 1,985, including 217 patients who have recovered/discharged and 149 patients died.

Delhi's tally of positive COVID-19 cases rose to 1,154 cases, including 27 recovered and 24 patients succumbing to the virus.

Tamil Nadu too reported 1,075 cases, including 50 recovered and 11 patients dead.

Meanwhile, four states have crossed the 500 mark with regards to the total number of cases as Rajasthan recorded 804 cases, Madhya Pradesh with 532 cases, Gujarat with 516 cases and Telangana with 504 cases, as per the ministry.

Kanpur, Jul 10: Kanpur encounter main accused Vikas Dubey, who was injured in an encounter with the police, died on Friday, the police said.

"Gangster Vikas Dubey arrested for killing eight policemen is dead," confirmed the police.

According to SP Kanpur West Anil Kumar, gangster Vikas Dubey attempted to flee after the car overturned. Dubey attempted to flee by snatching pistol of the injured policemen. However, he was shot in the retaliatory firing.

"Vikas Dubey attempted to flee by snatching pistol of the injured policemen after the car overturned. Police tried to make him surrender, during which he fired at the policemen. He was injured in retaliatory firing by police. He was later rushed to the hospital," SP Kanpur West told reporters here.

Dubey, the main accused in the Kanpur encounter was arrested by the police in Ujjain on Thursday morning. He was on the run for the last six days and had come to Ujjain to offer prayers at Temple, where he was identified by a security guard at the shrine.

The gangster is the main accused in the encounter that took place in Bikru village in Chaubeypur area of Kanpur last week, in which a group of assailants allegedly opened fire on a police team, which had gone to arrest Dubey. Eight police personnel were killed in the encounter.

Dubey managed to escape after the killing.  The Uttar Pradesh police launched a hunt for him and raised the bounty on him to Rs 5 lakh.

Bahua Dubey and Prabhat Mishra, close aides of the main accused, were killed in separate encounters in Etawah and Kanpur respectively, on Thursday.

The main accused's other aide Shyamu Bajpai was arrested by the Chaubeypur police following an encounter. He carried a reward of Rs 25,000, the police informed on Wednesday. Earlier the same day, Uttar Pradesh's Special Task Force (STF) gunned down Vikas Dubey's close aide Amar Dubey in Hamirpur district.

No one fool other than ghobar society will believe on this news. Totally a goonda raj by yogiraaj.  He tried to offer 1crore to all killed policemen. But locals obligation now this is the  new drama. One way this is a lesson to his and his chaddi society's followers that party can take their own soldiers life for the self benefit.
