Kerala CM Pinarayi Vijayan should face trial in graft case: CBI tells SC

Thiruvananthapuram, Jul 29: The CBI has told the Supreme Court that Kerala Chief Minister Pinarayi Vijayan, who was discharged from all criminal and corruption charges in the SNC Lavalin case, "should face trial".

In an affidavit filed in the court, the Central Bureau of Investigation questioned the discharge of Vijayan and two others, saying the Kerala High Court orders in this regard was "not correct".

The CBI has challenged the High Court's August 23, 2017, order to discharge Vijayan, K. Mohanachandran, former Principal Secretary in Department of Power, and A. Francis, then department Joint Secretary. The High Court had given the go-ahead for the trial of remaining three accused, who are Kerala State Electricity Board officials.

Objecting to the High Court's decision to discharge certain accused and making remaining charge-sheeted persons to face trial, the CBI said: "Vijayan should also face trial for the same set of offences".

"The specific acts and omissions of each accused can only be decided in a properly conducted trial and the discharge of some accused may adversely impact the outcome vis-a-vis those tried in court," said the CBI affidavit.

Reacting to the fresh development, Leader of Opposition in Kerala Assembly Ramesh Chennithala told the media that it had now been proved right what they had been saying all along. "Vijayan should now react to this... we have been saying all through that he has a role in it."

Vijayan, however, has not responded so far.

The case pertains to an agreement with Canadian firm SNC Lavalin in 1997 for the renovation and modernisation of Pallivasai, Sengulam and Panniar hydroelectric projects in Idukki district of Kerala, which allegedly caused a loss of Rs 266 crore to the exchequer.

Vijayan was then the Power Minister in Kerala.

The three accused directed to face trial too had approached the apex court, asking why they were not treated on par with Vijayan and two co-accused discharged in the case.

The CBI maintained that the High Court order was "bad in law" and its findings that Vijayan and two others need not to face the trial amounts to "clear differentiation" between two sets of accused.

"Without the knowledge of Vijayan and two others, the consultancy agreements would not have been converted into supply contracts on fixed rates on February 10, 1997, when Vijayan was (Power) Minister and had gone to Canada along with Mohanachandran (also discharged in the case) as a guest of Lavalin and during the visit the decision to sign the supply contract was taken by Vijayan," the affidavit added.

"The wilful omissions and commissions on the part of the public servants provided the opportunity to SNC Lavalin for deriving wrongful gains, casing corresponding loss to the KSEB," it added.

A bench of Justice N.V. Ramana and Justice Abdul Nazeer had earlier stayed the trial of the case and sought the CBI's response.

On November 5, 2013, a CBI court in the state capital exonerated all the accused, without taking up the case for trial.

However, a year later, the CBI approached the High Court against the CBI court's exoneration, which ordered the trial against three persons and discharged three others, including Vijayan.

A criminal case was registered on February 12, 2007, and the CBI filed its charge sheet on June 12, 2009.

New Delhi, Jan 29: Badminton champion Saina Nehwal joined the ruling BJP today and is likely to campaign for the party ahead of the February 8 Delhi election.

"I have won medals for the country. I am a very hardworking and I love hardworking persons. I can see Prime Minister Narendra Modi does so much for the country, I want to do something for the country with him," the shuttler said, wearing the BJP scarf.

"I draw a lot of inspiration from Narendra sir".

Haryana-born Saina Nehwal, 29, is a major acquisition for the party in the middle of the Delhi poll campaign; she is one of the most popular sportspersons in India with a huge fan following and brand value. She is preparing for the 2020 Tokyo Olympics.

A former world number 1, she has been honoured with the country's top sporting awards like the Rajiv Gandhi Khel Ratna and Arjuna Award. She was also awarded the Padma Bhushan in 2016.

The Badminton player has won over 24 international titles. In the London Olympics, she won a bronze. She was world number two in 2009 and number one in 2015.

With her tweets praising Prime Minister Narendra Modi, Saina Nehwal was widely seen to lean towards the BJP.

One of her tweets became controversial when it was found to be identical to several others in praise of a PM Modi speech last year. Saina was trolled on Twitter with screenshots of the identical tweets. She was also among the sportswomen who put up identical tweets on Diwali thanking PM Modi for his initiative to empower women, with the hashtag #bharatkilaxmi.

The BJP roped in many famous personalities last year, including cricketer Gautam Gambhir, who was elected MP from Delhi in the national election, and wrestler Babita Phogat. Just before the Haryana assembly polls, the party roped in wrestler Sushil Kumar, Babita Phogat and former Hockey team captain Sandeep Singh. Sandeep Singh won the election and was appointed minister.

New Delhi, Feb 23: Dreaded underworld don Ravi Pujari, operating from overseas, has been reportedly arrested in South Africa and efforts are on for his deportation to India.

Pujari, who parted ways with underworld don Chhota Rajan, had jumped bail from Senegal, last year and had escaped to South Africa, where he was involved in big-time drug trafficking and extortion racket.

Sources in Indian Intelligence said that Ravi Pujari, who was hiding with a false identity of Anthony Fernandes, a Burkina Faso passport holder, was located in a remote village in South Africa.

On a tip-off from Indian external intelligence agency, the Senegal police air dashed South Africa last week. Pujari, 52, wanted in over 200 cases of heinous crimes, including murder and extortion, was detained with the help of South African agencies.

Sources in Mumbai Police said that Pujari's arrest has not yet been confirmed officially but Ministry of External Affairs is in touch with its mission in South Africa. An official in MEA refused to speak on the issue. Embassy of Senegal in Vasant Vihar, New Delhi, also did not respond to IANS' queries in connection with Pujari's arrest.

The mafioso first came into news in early 2000 when he started extorting huge amounts from famous Bollywood personalties and builders. He was involved in an attempt to murder case, aimed at killing a prominent lawyer of Mumbai.tip-off

Pujari's wife Padma and three children also fled India and some of them hold Burkina Faso passport. His son who was recently married in Australia reportedly holds an Australian passport.

Earlier last year Ravi Pujari, living under the identity of Anthony had jumped bailed from a Senegal court through fraudulent means. IANS had accessed the don's new passport. Pujari now goes under the name of Anthony Fernandes and is a citizen of Burkina Faso, a West African country, his date of birth is shown as 25.1.1961.

Pujari, a movie junkie influenced by Amitabh Bachchan's portrayal as Anthony Gonsalves in 'Amar Akbar Anthony' was using the name, Anthony Fernandes. This passport was issued on 10.7.2013 and is valid till 8.7.2023. The passport showed his profession as Agent Commercial which means that he is designated as a businessman running a chain of restaurants Namaste India in Senegal, Burkina Faso and neighbouring countries.

Pujari's lawyers in Senegal had argued in the court citing that he is Anthony Fernandes, a businessman from Burkina Faso as mentioned in his passport and not a fugitive as claimed by the Indian Government.

Clearly indicating a collision between top government functionaries of Burkina Faso and Pujari in which an influential Indian businessman, who is his partner in a restaurant chain, may have played the role of a conduit.

New Delhi, Jan 7: Services at various bank branches and ATMs are likely to be affected as hundreds of employees will go on a bank strike across the country on Wednesday.

The bank strike is part of the Bharat Bandh call given by trade unions to protest against the labour reforms and economic policies of the Central government, according to reports.

The protestors' main demand during the Bharat Bandh is that the Centre should drop the proposed labour reforms.

A Bill in this regard was passed and proposes to merge 44 labour laws into four codes -- wages, industrial relations, social security, and safe working conditions.
