Minor rape victim approaches High Court to terminate 22-week 'unwanted' pregnancy

New Delhi, Dec 4: A 16-year-old rape victim has knocked the doors of the Delhi High Court seeking permission to terminate her 22-week "unwanted" pregnancy.

The court has said the minor needed to be medically evaluated, both physically and psychologically.

According to the minor's plea, she was lured into a sexual relationship by a married man for a year, after which she became pregnant.

Justice Vibhu Bakhru after interacting with the minor girl, who insisted that the pregnancy be terminated, said she appeared to be in considerable distress.

It directed the medical superintendent of a government hospital here to constitute a medical board, comprising a gynaecologist and a psychiatrist, to evaluate and give an opinion on medical termination of pregnancy.

The court, in its order passed on November 28, asked the girl to appear before the board on November 30 and directed the board to submit its report thereafter.

The victim's counsel relied upon the Supreme Court's orders in which the court, after examining the medical reports, had permitted the termination of pregnancy even after a period of 24 weeks of pregnancy.

The girl, in her plea filed through her father, said she was a victim of rape as the 20-year-old man lured her into sexual relations by telling her that he was a divorcee and "they were akin to husband and wife".

This resulted in her conceiving an unwanted pregnancy, the plea said.

The Indian Penal Code says s relationship with a girl below 16 years of age is punishable for of rape irrespective of her consent.

An FIR was lodged on November 3 for the alleged offence of rape under the IPC and the Protection of Children from Sexual Offences Act.

"The minor is a victim of rape who has undergone and is continuing to suffer from deep trauma and anguish both as a result of the rape and the consequent pregnancy and is in no fit mental or physical state to bear a pregnancy to term. The lifelong effect on her as a consequence of such forced pregnancy will be grave and irreversible," the plea said.

Bengaluru, Feb 5: City Crime Branch (CCB) of Bengaluru City have arrested two drug peddlers from Kerala and have seized banned products from their possession.

According to officials the arrested persons have been identified as Shinto Thomas (35) of Wayanad and Tajudden Talat (29) of Thiruvananthapuram.

"We have seized 4 kg 350 grams of Hashish oil, 21.5 kgs of Ganja, Rs. 9300 cash, two mobile phones, two ganja crushing tools, and 625 empty boxes and other articles from them", police said in a statement.

Bhubaneswar, Jul 5: Odisha Police have arrested five persons including groom for gross negligence and violation of COVID-19 guidelines during his marriage procession in Berhampur.

"A case has been registered for violation of COVID-19 guidelines for organising a marriage procession with more than 50 guests in the premises of a hotel. They disregarded the compulsory use of mask and flouted social distancing norms," DIG Central Zone Satyabrata Bhoi said.

The incident happened on July 2.
"The case has been registered at Gopalpur PS under section 188/269/270 IPC, R/W Sec- 3 Epidemic Disease Act, and 34 IPC. Two vehicles used in the procession have also been seized. the arrested persons will be produced in the court," he added.

The District Collector has sealed the hotel for violating the COVID-19 norms.

Following the incident, the Chief Minister's office tweeted: "Odisha is in a crucial phase in the fight against COVID-19, hence, it is very essential that we all obey guidelines and regulations issued by State Government to contain the spread of COVID-19. Violation of the same would lead to strong action."

The West Bengal government has suspended two women teachers in East Burdwan district on the charge of teaching pre-primary students from an English alphabet book consisting of a portion derogatory to the people with a dark complexion.

While presenting the alphabets with corresponding words and images, the book says U is for "Ugly". The illustration printed beside the letter is that of a boy with a dark complexion.

"The book is not part of the textbooks referred by the education department. It was introduced by the school itself. We have zero-tolerance for acts which instil prejudices into the minds of students," Education Minister Partha Chatterjee told reporters here on Thursday.

He said the two teachers of a local municipality-run school have been placed under suspension with immediate effect based on a preliminary investigation and stricter action would be taken against them later.

Though the school is now closed because of the lockdown, the matter came to light when the father of a student of the school was teaching him with the help of that book. He informed other parents and the education department was apprised of the issue, sources said.
