HC declines to review Mangalore air crash ruling

Kochi, September 30: A petition requesting the Kerala High Court to review its earlier order giving Air India (AI) a free hand in settling the compensation for Mangalore air crash was dismissed on Thursday.

On August 25, a division bench headed by Justice CN Ramachandran and Justice PS Gopinathan had quashed the earlier single bench order asking AI to pay Rs 75 lakh as compensation for each of the deceased, while dismissing another appeal by relatives who maintained that the Rs 75 lakh compensation ordered to each of them was not enough.

Only seven passengers survived after an AI Express flight from Dubai with 166 passengers crashed after overshooting the runway at Mangalore's Bajpe airport in May last year.

The review petition was filed by Arikkad Abdul Salam from Kumble, whose son died in the accident, after the division bench not only

declined their contention that Rs 75 lakh is the minimum compensation but also declared invalid the single bench order that ordered for Rs 75 lakh to be paid as compensation.

After the division bench order in favour of AI was announced, some of the relatives of victims have moved towards settling for the first available offer from the company.

Patricia, a relative of a victim, had approached the HC with a petition for a direction to allow her to accept the admitted amount of Rs 35 lakh as compensation.

The division bench had found that compensation is unlimited in air crashes, as claimed by the relatives, but ruled that carriers are liable to pay only for actual damages proved by the claimants as per Montreal Convention of 1999.

The single bench order was quashed after the court noticed that the air carrier has paid an average compensation of Rs 80 lakh for death, with minimum compensation of Rs 25 lakh and maximum compensation being Rs 7.75 crore.

Bellary,  Jul 26: A 100-year-old woman resident of Huvina Hadagali town in Bellary district, Karnataka, recovered from COVID-19 after testing positive for the virus earlier this month.

"Doctors treated me well. Along with regular food, I was eating an apple a day. The doctors are giving me tablets and injection, and I am healthy now. COVID-19 is like a common cold," said Hallamma while speaking to news agency.

The woman's son, daughter-in-law, and grandson had also tested positive for the virus, and the family was treated at their home.

According to health department officials, her son works at a bank and had tested positive on July 3, after which Hallamma tested positive on July 16; the 100-year-old reported negative for the virus on July 22.

Meanwhile, the covid-19 death toll in the country rose to 32,063 with 705 fatalities being recorded in a day on Sunday. The number of tests for detection of covid-19 has crossed the 16-million mark in the country.

Bengaluru, Aug 6: With rains in several parts of Karnataka amid Covid-19 pandemic, state Medical Education Minister K Sudhakar on Thursday asked the people to maintain caution and contact the Health department helpline in case of any symptoms.

"There is heavy rain in several districts of the state's coastal, Malnad and north interior regions. People have to observe utmost caution during these rains amid corona infections. In case of any symptoms like fever, cough and cold immediately call the health department helpline 104," Sudhakar tweeted.

As of August 5 evening, cumulatively 1,51,449 Covid-19 positive cases have been confirmed in the state, which includes 2,804 deaths and 74,679 discharges.

Among the districts where the new cases were reported, Bengaluru urban tops the list accounting for 64,881 cases.

Regarding Bengaluru, Sudhakar said, there are 4,276 beds across 11 Covid care centres in Bengaluru.

"As of today morning, 936 of them i.e., 27.79 percent are vacant. Out of the 3,346 patients, 306 patients are due for discharge today," he said in another tweet.

Aimed at availing beds at Covid-19 hospitals for symptomatic patients and those in need, the government had decided to shift all asymptomatic patients to Covid care centres.

Mangaluru, Feb 17: Kambala superstar Shrinivas Gowda, who is drawing comparisons to ace sprinter Usain Bolt, has reportedly refused to take part in athletics trials with the Sports Authority of India.

28-year-old Gowda, who hails from Moodbidri in Dakshina Kannada, was celebrated as a potential Olympian after a clip of his race went viral, amid claims that he had done 100m in 9.55 seconds, against Bolt's record of 9.58. He has so far won 32 medals in 11 kambala events this season.

Union sports minister Kiren Rijiju and SAI said Gowda would appear for trials at SAI's Bengaluru centre on Monday. The government "will do everything to identify sporting talents", Rijiju had tweeted.

"I will meet the Chief Minister. I am keen on continuing in kambala," Gowda said. Asked about the clamour for a crossover into athletics, he said, "For the time being I have no plans to appear for SAI trials. I am busy with the Kambala season and will consider meeting them following that and after consulting my well-wishers."
