All accused in 1996 Bihar Dalit carnage acquitted

Patna, April 17: The Patna High Court has acquitted all the 23 persons accused of perpetrating the massacre of 21 Dalits at Bathani Tola in Bhojpur in 1996.

The accused were convicted by the sessions court in Ara district and sentenced in May 2010. While three persons were awarded capital punishment, the remaining twenty were handed life imprisonment.

A Division Bench of judges Navneeti Prasad Singh and Ashwani Kumar Singh cited “defective evidence” to acquit all of them.

The carnage took place on the afternoon of July 11, 1996. Upper caste (Rajput and Bhumihar) landowners of the Ranvir Sena — a private militia of the landlords — stormed Bathani Tola in Bhojpur district's Sahar block in Central Bihar and ruthlessly hacked the Dalits, among them women, teenage girls and babies less than 10 months old.

Ajay Singh was charged with brutally killing 10-year-old Phool Kumari, Manoj Singh was charged with the murder of the three-month-old daughter of Naimuddin (one of the prime eyewitnesses) and Nagender alias Narendra Singh was charged with slaughtering two women, Sanjharu and Ramratiya Devi. They were awarded the death sentence by the sessions court

Bathani Tola, along with Laxmanpur-Bathe (where more than 60 Dalit men, women and children were slaughtered by the Ranvir Sena), have since become bywords for caste massacres that engulfed central Bihar from the mid-1990s onwards.

An FIR was lodged against 33 people the day after the massacre. In all, the Bhojpur police framed charges against 63 persons in October 1996.

“I am shocked by the High Court verdict,” said Anand Vatsyayan, counsel for the witnesses in the Bathani Tola case. “The evidence at hand was more than sufficient to uphold the judgement passed by the Ara sessions court.

“The Supreme Court guidelines in the event of a massacre are quite clear. The eyewitnesses need not remember all the names. And, of the six prime witnesses questioned in this case, all had conclusively pointed fingers at the persons convicted by the lower court.”

In July last year, the supremo of the Ranvir Sena, Brahmeshwar Singh “Mukhiya,” known as the ‘Butcher of Bathani Tola,' walked out of Ara Jail.

Mr. Vatsyayan, however, said a case (no. 37/10) was on against the Mukhiya in the Ara sessions court and the evidence of official witnesses was being awaited.

New Delhi, Feb 2: The Congress on Sunday released its manifesto for Delhi polls, promising to implement unemployment allowance of Rs 5,000-7,500 per month and cashback schemes for water and power consumers, if voted to power.

Presenting the manifesto, Delhi Congress chief Subhash Chopra said the party will provide free power up to 300 unit per month.

The manifesto also committed to spend 25 per cent budget each year on fighting pollution and improving transport facilities.

An unemployment allowance of Rs 5,000 for graduates and Rs 7,500 for post graduates per month will be provided under the Yuva Swabhiman Yojna, he said.

The Congress will launch flagship cashback schemes for power and water supply to benefit consumers saving these resources. The party, if voted to power, will open 100 Indira Canteens to provide subsidised meals at Rs 15, Chopra said.

The Congress will challenge the Citizenship Amendment Act (CAA) in the Supreme Court and demand the Centre to withdraw the law. The party will also not implement the National Register of Citizens (NRC) and the existing form of the National Population Register (NPR), if voted to power in Delhi.

New Delhi, Jan 15: The Delhi government Wednesday told the high court that execution of the death row convicts in the Nirbhaya gangrape and murder case will not take place on January 22 as a mercy plea has been filed by one of them.

The four convicts -- Vinay Sharma (26), Mukesh Kumar (32), Akshay Kumar Singh (31) and Pawan Gupta (25) -- are to be hanged on January 22 at 7 am in Tihar jail. A Delhi court had issued their death warrants on January 7.

Justices Manmohan and Sangita Dhingra Sehgal were told by the Delhi government and the Centre that the petition filed by convict Mukesh, challenging his death warrant, was premature.

The Delhi government and the prison authorities informed the court that under the rules, it will have to wait for the mercy plea to be decided before executing the death warrant.

They also said that none of the four convicts can be executed on January 22 unless the present mercy plea is decided.

The Supreme Court had on Tuesday dismissed the curative pleas of Mukesh and Vinay.

The mercy plea hearing began Wednesday morning and will continue in the afternoon.

Mumbai, Jun 3: With an expected increase in wind conditions up to 120 kilometres, cyclone Nisarga is likely to make landfall on the north coast of Maharashtra later today, as per the Indian Meteorological Department (IMD) on Wednesday.

"Wind conditions will further increase up to 100-110 gusting to 120 kmph as conditions are favourable for intensification. The higher sea surface temperature and low vertical wind shear favoured the intensification of severe cyclonic circulation," said IMD in a series of tweets.

Explaining the nature of wind speed, IMD further tweeted, "Eye diameter is about 65 km as observed through Radar. thus the diameter has decreased during past 01 hours indicating intensification of the system. hence wind speed has increased from 85-95 kmph to 90-100 kmph gusting to 110 kmph."

Several National Disaster Response Force (NDRF) teams have been deployed across Maharashtra to ensure preparedness for the impending cyclone. A total of eight teams have been deployed in Mumbai, five teams in Raigad, two teams in Palghar, Thane, and Ratnagiri and one team in Sindhudurg, said NDRF.

Besides, five NDRF teams were airlifted by IL-76 from Vijaywada for Mumbai on June 2, as per the Indian Air Force (IAF)

"Around 60 per cent of people, from the coastal areas around this area, have gone to their relatives' places. The remaining ones have been sent to the evacuation centre. We have also taken into account the COVID-19 guidelines and ensured social distancing," NDRF officer Shiv Parada Rao, deployed with his team in the Dahanu area, spoke to ANI.

"From the information we have received cyclone Nisarga is likely to hit here by tonight. The exact time is not confirmed yet. We are taking all preparedness measures to tackle the situation," he added.

NDRF teams also conducted evacuation in Alibaug during the early hours on Wednesday morning, as per NDRF Director General SN Pradhan.

As per the 5 am bulletin released by IMD, cyclone Nisarga was heading towards north Maharashtra coast at a speed of 11 kmph. It was about 200 km South -SouthWest of Alibag and about 250 km south-southwest of Mumbai at 2.30 AM today, stated the bulletin.
