Relief for Nityananda: HC dismisses petitions

Madurai, May 10: Amid the controversy over appointment of self-styled godman Nityananda as head of the Madurai Adheenam, the Madras High Court today dismised a PIL seeking a direction to the government to take over the ancient Saivite Mutt.

The Madurai Bench of the Court also dismissed a habeas corpus petition filed by a disciple of the Dharmapura Adheenam seeking to produce the pontiff of Madurai Adheenam, Arunagirinatha Gnanasambanda Desika Paramacharya Swami, in person.

Dismissing the pleas,the Bench comprising Justices M Sathya Narayanan and D Hariparanthanam said the petitioners should approach the Hindu Religious and Charitable Endowment department under provisions of the HR and CE act and the High Court was not competent to handle the issue at this stage.

The Court said as the matter involved appointment of Nityananda as the successor, it was a matter to be decided by the HR and CE (Joint Commissioner) court or civil court.

Meanwhile, counsel for M Solaikannan, Hindu People's Party leader who filed the PIL, sought a special leave petition for appealing against the Court order to the Supreme Court. The counsel also said he would file a civil suit.

In his petition, Solaikannan alleged that the recent appointment of Nityananda, who is facing criminal charges, including rape, as the 293rd pontiff of Madurai Aadheenam (Mutt), was made without following rules and rituals established by tradition.

The appointment had not been ratified by other Saivite mutts. The present mutt head had been administered some drug and he had agreed to make Nityananda as the Mutt head only under the influence of drugs, the petitioner alleged.

The Habeas Corpus Petition filed by one T Gurusamy Desikar, sought a direction to police to produce the mutt head Arunagirinatha Gnanasambanda Desika Paramacharya Swami, in person and set him free from 'illegal custody' of Nityananda.

However, the Mutt head has said he was not under the control of any person, including Nityananda.

Nityananda's appointment as the head of the 1500 year-old Saivite Mutt here, has triggered a controversy. Many religious leaders and political outfits have protested the appointment.

The self-styled godman had landed in controversy after a video footage purportedly showing him in a compromising position with an actress was telecast by local TV channels in March 2010. He was arrested on April 21 from Solan in Himachal Pradesh and granted bail on June 11 the same year by the Karnataka High Court

Meanwhile, Arunagirinatha Gnanasambanda Desika Paramacharya Swami said there was no going back on his decision to have Nityananda as his successor.

"Once enthroned as junior pontiff, he cannot be dethroned", he told reporters here.

Nityananda was an erudite scholar with proficiency in English and Tamil and the Saiva Siddhantha,he said.

He claimed that he had sought the help of Dharumapura Adheenam and Kanchi Sankaracharya to appoint a successor,but both did not have time to find one.

Referring to the Kanchi Seer Jayendra Saraswathi's statement that Nityananda's appointment was in violation of spiritual and religious traditions, he said he could not blame the Sankaracharya as someone would have misled him.

Nityananda,who was also present at the press meet, said there were mutt heads who supported him.

New Delhi, April 6: Prime Minister Narendra Modi on Monday said that people from every section of the society and age group demonstrated unity on Sunday by responding to the Prime Minister '9 pm-9minute' appeal and strengthened the resolve to the fight against COVID-19.

"We experienced yesterday at 9 pm, the strength of togetherness of 130 crores people of our country," said PM Modi.

He further praised the citizens of the country for their support to the lockdown imposed across India in the wake of coronavirus threat.

"The maturity shown by the people during the lockdown, in a large country like India, is unprecedented. No one could have imagined that the people will abide by this with such obedience and sense of service," said Prime Minister Modi.

"I state it with full responsibility that this is a long war against coronavirus pandemic. But we do not have to get tired or take a rest in this war. We have to emerge victoriously. Today, the country has only one goal and one resolve - to win this war," he added.

The Prime Minister continued saying, that the government has developed an Aarogya Setu app through which one can get information regarding the infected cases around them.

"I request all of you to tell people about it, everyone should make sure that at least 40 others install it. They will get info through it about possibly infected cases around them. In these tough times, we have to ensure this," he added.

The Prime Minister also advised everyone to take necessary preventive measures and stay protected by adopting the mantra of social distancing.

"Always remember, whenever you go out your face should be covered, I say you should keep your face covered even at your homes. The mantra today for the whole world is social distancing and discipline," he added.

Prime Minister Modi addressed the BJP workers and the nation on the occasion of the Bharatiya Janata Party's (BJP) 40th Foundation Day.

New Delhi, Jun 17: AAP MLA and national spokesperson Atishi has tested positive for COVID-19, her party colleagues said on Wednesday.

Delhi Chief Minister Arvind Kejriwal took to Twitter to wish her speedy recovery.

"Atishi ji has played an important role in the fight against corona. I hope that she will get healthy soon and again get involved in serving the people," Kejriwal tweeted in Hindi.

According to sources, Atishi was tested on Tuesday for COVID-19 and her report came positive today.

She is presently under home quarantine, the sources said.

"Get well soon Atishi, recover soon from Corona," AAP MLA Saurabh Bhardwaj tweeted.

Atishi represents Kalkaji assembly constituency.

New Delhi, Aug 8: The Union Health Secretary Rajesh Bhushan on Friday directed the governments of four states -- Gujarat, Karnataka, Tamil Nadu, and Telangana, to analyse the factors driving the high COVID-19 mortality and devise ways and means to reduce the mortality.

Apart from the higher case mortality, these states account for 17 per cent of India's active cases, high daily new cases, low tests per million, and high confirmation percentage.

In a high-level virtual meeting, Bhushan advised state administrations to adhere to measures suggested by central advisories and guidelines to prevent and reduce mortality due to coronavirus infection.

According to the health ministry, 16 districts in these four states are reporting maximum virus fatalities. It includes -- Ahmedabad and Surat in Gujarat; Belagavi, Bengaluru urban, Kalaburagi and Udupi in Karnataka; Chennai, Kanchipuram, Ranipet, Theni, Thiruvallur, Tiruchirappalli, Tuticorin and Virudhnagar in Tamil Nadu; and Hyderabad and Medchal-Malkajgiri in Telangana respectively.

"The districts were advised to ensure that the advisories, guidelines and clinical treatment protocols issued by the Health Ministry are adopted and effectively implemented to reduce the mortality among COVID-19 patients and other preventable deaths among all sections of the people, particularly those with co-morbidities, pregnant women, the elderly and children," said the health ministry official.

"States were advised to ensure optimum capacity utilization of testing labs, increase tests per million population and reduce confirmation percentage, in addition to ensuring timely availability of ambulances with target zero refusal," the official further said.

"States were also advised to analyze availability and need for projected beds and oxygen, and plan in a timely manner. States and district administration have also been advised to ensure good infection prevention and control practices to control infection in the healthcare workers," said the official.

Principal Secretary (Health) and MD (NHM) from the four States along with district surveillance officers, district collectors, commissioners of the municipal corporation, Chief Medical Officers, and Medical Superintendent of Medical Colleges participated in the meeting.
