Hyderabad, June 12: A crucial day for Jagan Mohan Reddy and the Congress in Andhra Pradesh. By-polls to the Nellore Lok Sabha seat and 18 Legislative assembly constituencies is underway on Tuesday. The ruling Congress, the opposition TDP and Jagan's YSR Congress party will be slugging it out for these seats. Polling has commenced at 8 am.

The assembly seats including one in Telangana fell vacant following the disqualification of Congress rebels who joined Jagan's party.

The Tirupati seat fell vacant following Praja Rajyam chief Chiranjeevi's election to the Rajya Sabha.

YSR Congress chief Jagan Mohan Reddy will remain in Chanchalguda jail during polling as his custody was extended on Monday in the alleged disproportionate assets case. Jagan's arrest could go against the ruling Congress in these elections because Jagan's family has been calling it political vendetta.

Other factors that could weigh on voters minds are enhanced electricity charges and erratic power supply in the state. The recent hike in petrol price - the steepest ever - and a severe shortage of drinking water could also hurt the Congress' prospects.

The by-polls to 18 Assembly segments on Tuesday will not lead to the fall of the Kiran Kumar Reddy government in Andhra Pradesh anytime soon but will give a new direction to the state politics. A 'wave' is anticipated in favour of YSR Congress, its chief's arrest in the disproportionate assets case and the corruption allegations against him notwithstanding, and its candidates are expected to 'sweep' the crucial by-elections.

Jagan's arrest by CBI and the subsequent campaign by his mother YS Vijaya and sister Sharmila have in a way generated sympathy for the YSR Congress. As the current trends indicate, the YSR Congress is the front-runner in almost all the constituencies except Parkal in Warangal district of Telangana.

The Congress' strategy in this regard miserably backfired and virtually landed it in the dock as the misdeeds of the past eight years started haunting it.

The TDP, which otherwise should have benefited from the anti-incumbency factor, was caught in the crossfire between the Congress and the YSR Congress though it started off with some advantage in the beginning.

In Parkal the TRS is bent on preventing the BJP's victory as it will threaten its existence as the sole torch-bearer of the statehood movement.

In the Nellore Lok Sabha constituency, sitting Congress MP Mekapati Rajamohan Reddy who quit his party to join the YSR Congress will face former Union Minister T Subbarami Reddy of the Congress.

Meanwhile, the election authorities have made elaborate arrangements in 18 assembly constituencies and one Lok Sabha seat where 46,13,589 voters are expected to exercise their franchise in 5,413 polling stations spread over 12 districts.

State Chief Electoral Officer (CEO) Bhanwar Lal told reporters that 50,000 polling personnel, including 138 companies of Central Armed Police Force (CAPF), have been deployed for the conduct of the elections.

By-polls were necessitated in 16 of the 18 assembly seats as the sitting Congress MLAs were disqualified for switching loyalty to Jagan and voting against the Congress government during a no-trust vote in December.

New delhi, Feb 10: The Supreme Court on Monday upheld the constitutional validity of the SC/ST Amendment Act, 2018, and said a court can grant anticipatory bail only in cases where a prima facie case is not made out.

A bench headed by Justice Arun Mishra said a preliminary inquiry is not essential before lodging an FIR under the act and the approval of senior police officials is not needed.

Justice Ravindra Bhat, the other member of the bench, said in a concurring verdict that every citizen needs to treat fellow citizens equally and foster the concept of fraternity.

Justice Bhat said a court can quash the FIR if a prima facie case is not made out under the SC/ST Act and the liberal use of anticipatory bail will defeat the intention of Parliament.

The top court's verdict came on a batch of PILs challenging the validity of the SC/ST Amendment Act of 2018, which was brought to nullify the effect of the apex court's 2018 ruling, which had diluted the provisions of the stringent Act.

New Delhi, Feb 19: The UIDAI on Tuesday said its Hyderabad office has sent notices to 127 people for allegedly obtaining Aadhaar numbers on "false pretences" but asserted these have nothing to do with citizenship.

The notices were issued after reports from the police, the Unique Identification Authority of India (UIDAI) said.

"Aadhaar is not a document of citizenship and UIDAI has been mandated under the Aadhaar Act to ascertain residency of a person in India for 182 days prior to applying for Aadhaar," the nodal body, which issues the 12-digit biometric ID, said in a statement.

The Supreme Court, in its landmark decision, has directed the UIDAI not to issue Aadhaar to illegal immigrants, it said.

"It may be noted that the regional office Hyderabad received reports from the state police that 127 people have obtained Aadhaar on false pretences, as in their preliminary enquiry they were found illegal immigrants who were not qualified to obtain an Aadhaar number," the UIDAI said.

As per the Aadhaar Act, such Aadhaar numbers are liable to be cancelled.

"Therefore, the regional office Hyderabad has sent notices to them to appear in person and to substantiate their claims for getting an Aadhaar number," it said.

The UIDAI emphasised that these notices have "nothing to do with citizenship and cancellation of Aadhaar number is in no way related to the nationality of any resident".

In case it is found and proved that any of them obtained Aadhaar by submitting false documents or through false pretences, their Aadhaar is liable to be cancelled or suspended depending on the severity of the transgression, UIDAI said.

"Severe errors like forged documents, etc., will lead to appropriate actions, including suspending /cancelling the Aadhaar," it cautioned.

"Sometimes it becomes necessary to cancel the Aadhaar number when it is found that a resident has obtained it by submitting false biometrics or documents. It is a routine quality improvement process that the UIDAI takes up regularly," the authority said.

The 127 people have been asked to appear before the UIDAI deputy director in Hyderabad for a personal hearing on February 20.

Additional time has been given to allow them to collect the requisite documents, "Since it may take them some more time to collect the original documents that they had submitted for obtaining Aadhaar, as informed by the state police, the UIDAI has postponed the personal hearing to May 2020," it added.
