Tinted glasses in vehicles: Act or face contempt action, SC warns cops

New Delhi, August 3: The Supreme Court today warned the Director Generals of Police and Commissioners of Police in all the states and union territories of contempt action if they fail to take action on use of tinted glasses in vehicles.

A bench of justices B S Chauhan and Swatanter Kumar asked the police machinery in the country to not only challan the offending vehicles but also to take forthwith measures to remove materials pasted on safety glasses by vehicle users.

"We are not emphasising on security threat to nation but it is a clear violation of law. No material can be pasted on safety glasses, this law needs to be enforced.

"DGPs/CPs to ensure complete compliance in true letter and substance. At this stage we will not initiate any action on the DGPs and other officials but issue a clear warning that in case of non-compliance the court shall be compelled to initiate appropriate action under the contempt of courts act without any notice," Justice Kumar said.

On July 22, the Supreme court had expressed its dissatisfaction over tardy implementation of its directions banning the use of tint on car windows, beyond a permissible limit, in Delhi.

The bench had said that the roads of the national Capital still had numerous cars with heavily tinted windows and windscreens and that the users or owners of such vehicles, often involved in accidents, go scot-free.

The court had also noted that most of these vehicles were being used by VIPs enjoying Z-category security.

The bench had observed that the VIPs, who were permitted to use tinted film on their vehicles but only as per due procedure, were exploiting the relaxation granted to them.

The apex court's observations came while hearing a batch of petitions filed by sun film manufacturers association and others seeking clarification as well as modification of the apex court?s order banning the use of tinted glass on vehicle windowpanes.

Concerned over rising instances of criminals using black films on windscreens and side glasses of four wheelers, the apex court had directed the states and the Union territories to strictly enforce the ban on use of tint beyond the limit permitted.

A three-judge bench headed by Chief Justice S H Kapadia had on April 27 said that manufacturers may produce vehicles with tinted glasses which provide for 70 per cent Visual Light Transmission (VLT) for safety glasses on front and rear windscreen and 40 per cent VLT for side glasses.

The directions had come into effect and were enforceable from May 4.

The apex court, however, at that time had given liberty to the police officers concerned to grant exemption to VVIPs like those enjoying "Z" and "Z plus" category security.

The court's verdict had come on a PIL filed by one Avisekh Goenka seeking total ban on all forms of tinted glasses used in four wheelers.

The court, while granting the exemption to VVIPs and others facing threat perceptions, had said, "The cases of the persons who have been provided with Z and Z+ security category may be considered by a committee consisting of the director general of police/commissioner of police of the concerned state and the home secretary of that state/Centre.

The bench had advised that "certificates should be provided only in relation to official cars of VIPs/VVIPs, depending upon the category of security that such person has been awarded by the competent authority."

New Delhi, Apr 21: India's count of positive coronavirus cases reached 18,985 after 1,329 new cases were reported in the last 24 hours, the Ministry of Health and Family Welfare said on Tuesday.

Out of the total cases, 15,122 are active cases, 3,259 have been discharged or cured and one has migrated. With 44 new deaths reported in the last 24 hours, the toll stands at 603.

As per the evening update by the ministry, Maharashtra continues to be the worst-hit state with 4,669 cases, out of which 572 patients have been discharged and cured and 232 deaths.

Delhi's total count of confirmed cases stand at 2,081, which includes 431 cured or discharged cases and 47 deaths.

Gujarat has reported a total of 2,066 positive COVID-19 cases, out of which 131 patients have recovered or discharged, while 77 patients have lost their lives.

Madhya Pradesh's count of COVID-19 cases stand at 1,540, including 127 cured or discharged cases and 76 deaths.

Rajasthan has so far reported 1,576 positive cases, out of which 205 patients have recovered or discharged and 25 people have lost their lives.

Tamil Nadu's COVID-19 figure has risen to 1,520, with 457 patients recovered and 17 fatalities. Uttar Pradesh has reported 1,294 cases, out of which 140 patients have recovered and 20 are dead.

Kanpur, Jul 10: Kanpur encounter main accused Vikas Dubey, who was injured in an encounter with the police, died on Friday, the police said.

"Gangster Vikas Dubey arrested for killing eight policemen is dead," confirmed the police.

According to SP Kanpur West Anil Kumar, gangster Vikas Dubey attempted to flee after the car overturned. Dubey attempted to flee by snatching pistol of the injured policemen. However, he was shot in the retaliatory firing.

"Vikas Dubey attempted to flee by snatching pistol of the injured policemen after the car overturned. Police tried to make him surrender, during which he fired at the policemen. He was injured in retaliatory firing by police. He was later rushed to the hospital," SP Kanpur West told reporters here.

Dubey, the main accused in the Kanpur encounter was arrested by the police in Ujjain on Thursday morning. He was on the run for the last six days and had come to Ujjain to offer prayers at Temple, where he was identified by a security guard at the shrine.

The gangster is the main accused in the encounter that took place in Bikru village in Chaubeypur area of Kanpur last week, in which a group of assailants allegedly opened fire on a police team, which had gone to arrest Dubey. Eight police personnel were killed in the encounter.

Dubey managed to escape after the killing.  The Uttar Pradesh police launched a hunt for him and raised the bounty on him to Rs 5 lakh.

Bahua Dubey and Prabhat Mishra, close aides of the main accused, were killed in separate encounters in Etawah and Kanpur respectively, on Thursday.

The main accused's other aide Shyamu Bajpai was arrested by the Chaubeypur police following an encounter. He carried a reward of Rs 25,000, the police informed on Wednesday. Earlier the same day, Uttar Pradesh's Special Task Force (STF) gunned down Vikas Dubey's close aide Amar Dubey in Hamirpur district.

No one fool other than ghobar society will believe on this news. Totally a goonda raj by yogiraaj.  He tried to offer 1crore to all killed policemen. But locals obligation now this is the  new drama. One way this is a lesson to his and his chaddi society's followers that party can take their own soldiers life for the self benefit.

New Delhi, Jun 2: Prime Minister Narendra Modi on Tuesday said India will definitely get its economic growth back as the government continues to pursue various reforms.

Speaking at industry association CII's annual session, he said the government has taken tough steps to fight the coronavirus pandemic and has also taken care of the economy.

"On the one hand we have to safe lives of our people and on the other hand we have to stabilise the economy and speed up the economy," he said.

He said he gets the confidence from farmers, small businesses and entrepreneurs for getting the economic growth back.

"Corona may have slowed our speed (of growth) but India has now moved ahead from lockdown with the phase one of unlock. Unlock Phase-1 has reopened a large part of the economy," he said.

He said intent, inclusion, investment, infrastructure and innovation are crucial for India to revert back to a high-growth trajectory.
