Cartoonist Aseem Trivedi's arrest: Charges absurd, says Press Council of India Chairman Markandey Katju

Mumbai, September 10: A Kanpur-based cartoonist, Aseem Trivedi, was remanded to police custody till September 16 by a Mumbai court on Sunday for allegedly posting seditious content on his website. His website has also been blocked.

His arrest gas been criticised by voices from across the board. The Chairman of the Press Council of India, Markandey Katju, compared the arrest to Nazi war criminals.

"The policemen who make such illegal arrests cannot take the plea that they were obeying orders of political superiors. In the Nuremberg trials, the Nazi War Criminals took the plea that orders are orders, and that they were only obeying the orders of their political superior Hitler. But this plea was rejected by the International Tribunal which held that illegal orders should be disobeyed," Mr Katju said yesterday.

The police had arrested Mr Trivedi on Saturday on the basis of a private complaint filed in December last year.

The complainant, Amit Katarnavea, a lawyer and a member of the Republican Party of India, had alleged that Mr Trivedi had put up banners, mocking the Indian Constitution, during Anna Hazare's anti-graft rally held last year at the Bandra Kurla Complex in Mumbai and also posted obscene content on his website.

"If telling the truth makes one a traitor, then I am happy. Likewise even Gandhi, Bhagat Singh are traitors. If while doing service to the nation I am booked under sedition, I will continue to do so and get arrested," Mr Trivedi said after his arrest.

AK Khan, a friend of Mr Trivedi, alleged that the cartoonist is being repeatedly manhandled since his arrest. India Against Corruption or IAC, which has been attacking the government over a series of alleged scams, has lent support to Mr Trivedi, saying the arrest is politically-motivated.

"If anyone is talking against corruption, proclaiming it as anti-national and slamming charges of sedition, one needs to understand that this (drawing cartoons) is against the government and not against the country," said Mayank Gandhi, a member of IAC.

"He is not a member of IAC but is fighting against corruption and we are here to lend him moral support," Mr Gandhi added.

"Whoever raises their voice against corruption is termed as a seditionist, anti-nationalist and a Naxalite," said Preeti Menon, member IAC.

Last month, the court had issued a non-bailable warrant against the cartoonist. A police team was sent to his residence in Kanpur but he wasn't traceable; so his parents were informed and the warrant was served.

"Whenever he started drawing cartoons, it was in the welfare of the country and when he organised this exhibition of his cartoons on December 25, 26 during Anna's movement at MMRDA grounds last year, then some member of the Maharashtra Congress Committee filed a writ in the High Court and based on that Police issued a warrant without any prior information," said the cartoonist's father Ashok Trivedi.

The police insist that the arrest is a procedural formality, saying they have acted on a complaint. The First Information Report states that the accused had put 'ugly and obscene content' on his website.

"He has shown disrespect to the National flag and therefore he has been arrested under section 124 A," said Chandrakant Bhosale, Senior Inspector, Mumbai Police.

The arrest comes at a time when Mr Trivedi was scheduled to visit Syria to collect the 2012 Courage in Editorial cartooning award. He was scheduled to fly on September 12.

New Delhi, Jun 30: Amid calls for boycotting Chinese products after India-China face-off in eastern Ladakh, Congress leader Rahul Gandhi on Tuesday hit out at Prime Minister Narendra Modi-led government claiming that imports from China have increased under the NDA regime.

"Facts don't lie. BJP says: Make in India. BJP does: Buy from China," Gandhi tweeted along with a graphic of the percentage of imports from China during the UPA rule and the NDA government.

The graphic claims that imports from China were at 12-13 per cent when the Congress-led UPA government vacated office in 2014 but now stood at 17-18 per cent in 2020.

The Congress leader has been vehemently targeting the Centre on the India-China border situation after 20 Indian soldiers were killed in violent face-off with Chinese troops in Ladakh's Galwan valley earlier this month.

Indian intercepts have revealed that the Chinese side suffered 43 casualties, including dead and seriously injured, in the face-off.

Bhopal, Jul 25: Madhya Pradesh chief minister Shivraj Singh Chouhan said on Saturday he has tested positive for the coronavirus disease (Covid-19).

Chouhan made the announcement in a series of tweets.

“My dear countrymen, I had symptoms of COVID-19 and after the test, my report has come back positive. I appeal to all my colleagues that whoever came in contact with me, must get their corona test done. And my close contacts should quarantine themselves,” Chouhan said in a tweet in Hindi.

“If COVID19 is treated on time, a person is completely cured. I have been reviewing the status of corona infection every evening since March 25. I will try to review corona situation through video conferencing as much as possible now,” he added.

The chief minister said the review meeting will now be held by home minister Narottam Mishra, urban development and administration minister Bhuppendra Singh, health education minister Vishvas Sarang and health minister Dr Prabhuram Choudhary in his absence.

“I will also continue to do everything possible to help control COVID19 in the state during treatment,” he said.

One of Chouhan’s ministerial colleagues tested positive for Covid-19 late on July 22.

The chief minister along with the minister, the Bharatiya Janata Party’s state unit president VD Sharma and state unit general secretary (organisation) Suhas Bhagat had visited Lucknow in a government plane on July 21 to attend the funeral of MP governor Lalji Tandon who died away in the Uttar Pradesh capital, his hometown. during hospitalisation.

The minister is admitted to a private medical college’s teaching hospital in Bhopal.

New Delhi, Jan 16: In trouble brewing for the Gautam Adani-led M/S Adani Enterprises, the Central Bureau of Investigation (CBI) on Thursday said that it has registered a case against former officials of the National Co-operative Consumer Federation (NCCF) and others over alleged irregularities in supply of coal to the Andhra Pradesh Power Generation Corporation (APGENCO) in 2010.

The CBI in its FIR has named Virendra Singh, the then Chairman of the NCCF, G P Gupta, the then MD of the NCCF, S C Singhal, the then Senior Advisor of NCCF, Adani Enterprises Ltd and other unknown public servants and others for criminal conspiracy, cheating and criminal misconduct by public servants.

According to CBI, the case was filed on Wednesday after the preliminary enquiry revealed the crime by the officials named in the FIR and the Adani Enterprises was found to be true.

The FIR alleged that on June 26, 2010, APGENCO floated a tender enquiry for supply of six lakh metric tonnes of imported coal "on free on rail destination" basis to Dr Narla Tata Rao Thermal Station (NTTPS), Vijaywada and Rayalasaleema Thermal Power Plant (RTTP), Kadapa, Andhra Pradesh/RTPP via Kakinada-Vizag-Chennai-Krishnapatnam or any other ports

The same was forwarded by the Chief Engineer, APGENCO to seven PSUs -- PEC Limited, STC Limited, MSTC Limited, NCCF, MMTC, Coal India Limited and SCCL Limited.

The FIR alleged that during the probe, the Adani Enterprises used a proxy company to get the supply contract. It said, "NCCF received bids from six companies -- Adani Enterprises Ltd, Maheshwari Brothers Coal Limited (MBCL), Vyom Trade Links Pvt. Ltd, Swarana Projects Pvt. Ltd, Gupta Coal India Ltd and Kyori Oremen Ltd.

During investigation it was found that Gupta Coal India Ltd had quoted the NCCF margin of 11.3 percent, while the MBCL quoted the margin of 2.25 percent and rest did not quote any margin to the NCCF.

The FIR said the quotes of the Gupta Coal India Ltd, Kyori Oremen Ltd and Swarana Projects Pvt. Ltd were rejected by the NCCF as they were not found to be fulfilling the tender conditions.

"Post tender negotiation was done by senior officials of NCCF to give undue favour to Adani Enterprises Ltd despite it not qualifing the tender (terms)," the FIR said, adding instead of cancelling the bid of Adani Enterprise Ltd, senior management of NCCF conveyed the offer margin to the company through one of its representative -- Munish Sehgal, who was sitting in the NCCF head office. It is prima facie evident that when the bids were being processed at NCCF head office in Delhi, a representative of Adani Enterprises Ltd. was informed regarding their imminent rejection due to non-submission of NCCF margin and also that MBCL was eligible bidder quoted 2.25 percent margin," it alleged.

The CBI in its FIR, further alleged that Adani Enterprises Ltd. had given an unsecured loan of Rs 16.81 crore to Vyom Trade Links Ltd in 2008-09. "And further it was revealed that the bank guarantees of the Adani Enterprises Ltd. and Vyom Trade Links Ltd. were issues by the same branch of the State Bank of India and at the same time," it said.

"It was clear that Adani Enterprises Ltd. presented Vyom Trade Links Ltd. as a proxy company in this particular tender and Vyom Trade Links Ltd. later withdrew its offer on flimsy ground," the CBI FIR said.

"The aforesaid acts of commissions and omissions on the part of the senior management of the NCCF disclose that during their tenure, they acted in a manner unbecoming of public servants and committed irregularities by way of manipulation in the selection of bidders, thereby giving undue favours to Adani Enterprises Ltd. in award of work for supply of coal to APGENCO despite its disqualification," it added.
