Post-RTI, buzz now is privacy law

New Delhi, October 19: An expert group has suggested a law to protect privacy of citizens, recommending that both government and private sector organisations should be covered by the proposed legislation, being drafted by the Department of Personnel and Training.

Suggesting a “conceptual framework” for the proposed legislation to the Planning Commission on Thursday, the group recommended that right to privacy should be extended to individuals, except in cases of national security, public order and prevention, detection, investigation and prosecution of criminal offences.

Disclosure of information shold be made only when it is in public interest. Protection of an individual or rights and freedom of others may also be considered an exception to the application of the proposed right to privacy law, the group headed by former Chief Justice of Delhi High Court A P Shah said.

The ambit of the privacy legislation should extend to data being processed in India, and data that originated in India, even when it is transferred internationally. The violation of the proposed law should constitute an offence and penalty be imposed on the violator, it recommended but did not quantify the amount of penalty.

Prime Minister Manmohan Singh had recently called for maintaining a “fine balance” between the Right to Information (RTI) Act and the Right to Privacy.

He also said the citizens’ right to know should definitely be circumscribed if disclosure of information encroached upon someone’s personal privacy.

This came in the wake of RTI activist Arvind Kejriwal’s accusations against the dealings of the company owned by Robert Vadra with housing major DLF and Union Ministers including P Chidambaram terming the dealings as “an issue between two private individuals.”

While releasing the report, Justice Shah noted that protection of the right to privacy guaranteed under the Constitution was a major concern with the initiation of programmes like Unique Identification number, NATGRID and DNA profiling, most of which will be implemented through the communication and information technology in the country.

To ensure protection of right to privacy of individuals, the panel outlined nine “national privacy principals” for collection, processing, storage, access retention, destruction and maintaining anonymity of the information collected about an individual.

Under these principals, a data (information) controller will be required to give simple information to all individuals in clear and concise words before collection of any personal information about them. The individuals will also be given choice with regard to providing personal information.

So far telephones were tapped by an executive order. The panel has recommended that under emergency situation, telephone of an individual could be tapped by an executive order just for first 15 days.

The authorities will have to seek a court order for continuing further tapping of telephone of an individual, Justice Shah said.

After personal information has been used in accordance with the identified purpose, it should be destroyed. Data retention mandates by the government should be in compliance with the national privacy principals, the report said.

Justice Shah, however, clarified that recommendations his committee for formulation of the proposed legislation would not come in conflict with the Right to Information Act, saying, “RTI also recognizes right to privacy.” The privacy Act should not circumscribe the Right to Information Act.

Additionally, RTI recipients should not be considered a data controller, the panel categorically said in its report.

Jul 1: Gold prices in India hit an all-time high on Wednesday, tracking a global rally, as surging coronavirus cases in many countries raised the metal's safe-haven appeal.

Local gold futures hit an all-time high of Rs 48,871 ($646.66) per 10 grams in early trade, taking their gains to 25% in 2020 so far. The contract had gained nearly 25% in 2019.

However, this dampened the retail demand for gold in India, the world's second-largest consumer of the precious metal.

"Retail demand is negligible. Buyers are postponing purchases anticipating a correction in prices," said a Mumbai-based bank dealer with a bullion importing bank.

In thin trade, dealers were offering a discount of up to $22 an ounce over official domestic prices on Wednesday afternoon, up from the last week's $18. The domestic price includes a 12.5% import tax and 3% sales tax.

The country's gold imports in May plunged 99% from a year earlier as international air travel was banned and jewellery shops were closed amid a nationwide lockdown to curb the spread of coronavirus.

In overseas market, spot gold firmed near an eight-year peak on Wednesday, as a spike in coronavirus cases in the United and States and many other countries has cast a shadow on hopes for a quicker global economic recovery, driving inflows into safe-haven assets.

According to a latest Reuters tally, the coronavirus has infected more than 10.48 million people worldwide so far.

New Delhi, Feb 27: The death toll in the communal violence in northeast Delhi over the amended citizenship law reached 32 on Thursday, senior officials said.

It was at 27 till Wednesday night.

"Five more deaths recorded at GTB Hospital, so death toll at that hospital has gone up to 30, taking total toll to 32," a senior Delhi Health Department official told news agency.

The Lok Nayak Jai Prakash Narayan Hospital had reported two fatalities on Wednesday.

New Delhi, Mar 11: Jyotiraditya Scindia, the Madhya Pradesh politician whose surprise exit from the Congress has brought the Kamal Nath government to the brink of collapse, joined the Bharatiya Janata Party on Wednesday. Scindia joined the BJP at an event in national capital Delhi in the presence of party chief JP Nadda.

Scindia, who was warmly welcomed by Nadda, described 10 March, the day that he exited from the Congress as one of the two life-changing days of his life. The first, he said, was 30 September 2001 when he lost his father. Scindia underscored that the Congress was not the party that it had been and had been living in denial.

Scindia had ended his 18-year-old association with the Congress on Tuesday after meetings with Home Minister Amit Shah and Prime Minister Narendra Modi.

Scindia’s exit from the Congress was followed by resignation letters by about 22 MLAs who had been sequestered in Karnataka. The resignation letters were, however, sent to the Governor and not the assembly speaker, and threatens to upend the Kamal Nath government which has a wafer-thin majority.

If the resignations are accepted, the effective strength of the MP assembly will come down to 206, leaving the Bharatiya Janata Party (BJP) with a slender majority beyond the halfway mark of 103 with its 107 MLAs. For now, the Congress is trying to persuade the MLAs to not pull down the state government.

In his resignation letter to Congress chief Sonia Gandhi that Scindia put out on Twitter soon after, he alluded to his discomfort in the party over the last year or so. “...as you well know, this is a path that has been drawing itself out over the last year,” he had written in his letter.

It was seen as a reference to the Congress settling for Kamal Nath as the chief minister after the 2018 state elections though it was Scindia who had led from the front to oust the BJP from Madhya Pradesh. Scindia’s supporters had hoped that the Congress would tell Kamal Nath to give up his second charge - as the party chief in the state - but this also didn’t happen.

The first hint that something was amiss came in November last year when Scindia removed a reference to the Congress in his Twitter bio and instead wrote “public servant and cricket enthusiast”. He had then explained the change to an effort to make the Twitter bio shorter.

Jyotyiraditya Scindia’s aunt Yashodhara Raje Scindia appeared to declare soon after that the 49-year-old would join the BJP when she welcomed his resignation, calling it “ghar wapsi” or homecoming. “Jyotiraditya was being neglected in Congress,” Yashodhara Raje Scindia said.

Scindia’s grandmother, Vijaya Raje Scindia, was one of the founders of the Jana Sangh, the precursor to the BJP. His aunt Vasundhara Raje is a former Union minister and ex-chief minister of Rajasthan and another aunt Yashodhara Raje is a former minister in the Madhya Pradesh cabinet.
