House panel backs move not to treat marital rape as sexual offence

New Delhi, Mar 2: A parliamentary committee has endorsed the government's decision not to treat "marital rape" as a sexual offence in the recently-promulgated anti-rape ordinance, agreeing that it could destroy the institution of marriage. However, the panel was silent on rape in live-in relationships, with many members of the view that treating it differently from other sexual offences was not possible in the absence of a law recognizing live-in arrangements.

Justifying the panel's recommendation to keep "marital rape" out of the purview of anti-rape laws, chairman of the standing committee on home affairs M Venkaiah Naidu said that leaving scope for the wife to accuse her husband of rape "has the potential of destroying the institution of marriage".

"In India, for ages, the family system has evolved ... Family is able to resolve the (marital) problems and there is also a provision under the law for cruelty against women, It was, therefore, felt that if marital rape is brought under the law, the entire family system will be under great stress and the committee may perhaps be doing more injustice," the parliamentary panel examining the Criminal Law (Amendment) Bill, 2012, said in its report tabled on Friday.

Though some members of the panel like Raja (CPI) and Prasanta Chatterjee (CPI(M)), both of whom put in a dissent note, besides Kanimozhi (DMK) had insisted on some room for the wife to take up the issue of marital rape, arguing that consent in marriage was not "forever", the majority view was that if a wife was aggrieved, there were other means for her to move court. The reference was apparently to laws against cruelty to women. There were some suggestions that the wife's age mentioned in Section 375 be raised from 16 to 18 years, but Union home secretary RK Singh, while appearing before the panel, warned that this would outlaw marriages in many states in one stroke.

Even though the Supreme Court has, in several judgments since 2010, ruled long-term live-in relationships as legal and on par with marriage, the government is yet to enact a law recognizing live-ins and outlining the rights of live-in partners. The home secretary had conceded before the panel that dealing with rape charges brought against a man by his live-in partner, especially where the relationship failed to culminate into marriage, was a tricky issue as sexual consent was presumably based on the promise of marriage. The standing panel steered clear of taking a stand on the suggestion it had received against considering live-in relations as rape.

The panel received as many as 90 suggestions from individuals, women's bodies and states/UTs. Incidentally, only five states and UTs — Gujarat, Mizoram, Lakshadweep, Puducherry and Dadra & Nagar Haveli — gave in their views.

New Delhi, Feb 25: Condemning the violence in Delhi, the Congress on Tuesday demanded that the Prime Minister, the Home Minister and the Chief Minister of Delhi come forward to ensure peace and maintain brotherhood while rising above partisan politics.

"This is Gandhi, Nehru, Patel's India, can any Indian accept this mindless violence? Congress appeals to the people of Delhi to maintain communal harmony and thwart all attempts of the forces dividing the country on the basis of religion," Congress' chief spokesperson Randeep Surjewala told reporters.

Unabated violence and incidents of stone-pelting and murder in the national capital have shattered the nation, he said, while referring to the riots in northeast Delhi over the Citizenship (Amendment) Act that continued for the third day, and demanded stern action against the culprits.

"Our appeal to the prime minister, the home minister and the Delhi chief minister is, can you rise to the occasion, leave aside your political partisanship and views, and become really not leaders of your parties but leaders of the society so that harmony, peace, and non-violence prevail," he said.

The Congress party will stand with the Centre and the Delhi government in every way to maintain brotherhood and harmony in the society, he said.

"Do not fail this country because you belong to different political parties," Surjewala said, adding this was a sincere appeal "on behalf of people of Delhi and the country" to Prime Minister Narendra Modi, Home Minister Amit Shah and Chief Minister Arvind Kejriwal.

"There is no place for violence in Gandhi ji's India... Today there is a need to establish peace on the ground and maintain brotherhood," he said.

Surjewala said the party also prays for the speedy recovery of DCP Amit Sharma and the hundreds of other people who have been injured in the violence.

"We also condemn the firing at three journalists Arvind Gunasekar, Saurabh Shukla and Akash and pray for their good health," he said.

"We strongly condemn these brutal riots and demand that the culprits are identified and stern action is taken against the real culprits and miscreants. The Congress mourns the death of Head Constable Ratan Lal and others in the violence," Surjewala said.

New Delhi, Jun 12: Petrol price on Friday was hiked by 57 paise per litre and diesel by 59 paise a litre as oil companies adjusted retail rates - the sixth straight day of increase in rates since oil firms ended an 82-day hiatus of rate revision.

Petrol price in Delhi was hiked to Rs 74.57 per litre from Rs 74, while diesel rates were increased to Rs 72.81 a litre from Rs 72.22, according to a price notification of state oil marketing companies.

Rates have been increased across the country and vary in each state depending on the incidence of local sales tax or value added tax.

This is the sixth consecutive daily increase in rates since oil companies on Sunday restarted revising prices in line with costs, after ending an 82-day hiatus.

In six hikes, petrol price has gone up by Rs 3.31 per litre and diesel by Rs 3.42.

Lucknow , May 13: Samajwadi Party chief Akhilesh Yadav on Wednesday took a jibe at Prime Minister Narendra Modi over announcing Rs 20 lakh crore special economic package to boost the economy saying that the Centre is again making "false promises to 133 crore Indians".

"Earlier, you promised Rs 15 lakh and now Rs 20 lakh crore. You have made false promises 133 times with 133 crore Indians. How can someone trust you this time? People now are not asking how many zeroes there are but how many false promises have been made," he tweeted (translated from Hindi).

Yesterday, Prime Minister Narendra Modi had announced a Rs 20 lakh crore economic stimulus package for the country fighting COVID-19, stating that it will give a new impetus and a new direction to the self-reliant India campaign.

The Prime Minister had also announced that the fourth phase of lockdown will be completely redesigned with new rules and will commence from May 18.
