Personal details cannot be disclosed under RTI: Bombay HC

RTI_Bombay_HCMumbai, Sep 8: Under RTI, disclosure of personal information in respect of service record, income tax returns and assets of an individual is illegal unless it is necessary in larger public interest, the Bombay High Court has ruled.

Accordingly, Justice Vasanti Naik quashed an order of Nashik State Information Commissioner asking the information officer to supply information about personal assets of petitioner Subhash Khemnar to respondent Dilip Thorat.

"On hearing the petitioner and on perusal of the Act, it appears that the Chief Information Commissioner was not justified in directing Information Officer to supply personal information in respect of service record, income tax returns and assets of the petitioner unless he was satisfied that such disclosure was justified in larger public interest," said the judge in a recent order.

In the impugned order there is no finding with regard to the satisfaction of the Commissioner that the disclosure of the personal information in respect of the petitioner was justified in larger public interest, the judge noted.

Under section 8(1) J of the Act, there is no obligation on the Information Officer to give personal information, the disclosure of which has no relationship with any public activity or interest, or which would cause unwarranted invasion on the privacy of the individual unless the authority is satisfied that the disclosure of such information is justified in larger public interest, the Judge further said.

The petitioner had challenged the order passed by the Chief Information Officer on December 4 last year asking the information officer to supply personal information about him on a second appeal filed by the respondent.

Initially, the information officer did not supply the information and rejected the application filed by the respondent.

Thereafter he went in appeal before a higher authority but it was rejected. He then went in second appeal before the Chief Information Officer which was allowed. Being aggrieved, the petitioner moved the High Court.

According to the petitioner, the respondent was allegedly involved in extortion and the petitioner's brother-in-law had filed a complaint against the respondent for extortion. Also, the court had rejected the application filed by the respondent seeking anticipatory bail.

New Delhi, Jun 30: Amid calls for boycotting Chinese products after India-China face-off in eastern Ladakh, Congress leader Rahul Gandhi on Tuesday hit out at Prime Minister Narendra Modi-led government claiming that imports from China have increased under the NDA regime.

"Facts don't lie. BJP says: Make in India. BJP does: Buy from China," Gandhi tweeted along with a graphic of the percentage of imports from China during the UPA rule and the NDA government.

The graphic claims that imports from China were at 12-13 per cent when the Congress-led UPA government vacated office in 2014 but now stood at 17-18 per cent in 2020.

The Congress leader has been vehemently targeting the Centre on the India-China border situation after 20 Indian soldiers were killed in violent face-off with Chinese troops in Ladakh's Galwan valley earlier this month.

Indian intercepts have revealed that the Chinese side suffered 43 casualties, including dead and seriously injured, in the face-off.

New Delhi, Jun 11: Petrol and diesel prices on Thursday were hiked by 60 paise per litre each - the fifth straight daily increase in rates since oil PSUs ended an 82-day hiatus in rate revision.

Petrol price in Delhi was hiked to Rs 74 per litre from Rs 73.40 while diesel rates were increased to Rs 72.22 a litre from Rs 71.62, according to a price notification of state oil marketing companies.

Rates have been increased across the country and vary from state to state depending on the incidence of local sales tax or VAT.

This is the fifth daily increase in rates in a row since oil companies on Sunday restarted revising prices in line with costs, after ending an 82-day hiatus.

In five hikes, petrol price has gone up by Rs 2.74 per litre and diesel by Rs 2.83.

Lucknow, Aug 4: Rashtriya Swayamsewak Sangh (RSS) Chief Mohan Bhagwat on Tuesday left for Ayodhya to attend foundation laying ceremony of Ram Temple tomorrow.

The Prime Minister is scheduled to lay the foundation stone of the Ram temple in Ayodhya on August 5. The construction of Ram temple will begin in Ayodhya after the said ceremony in which various dignitaries from political and religious fields are scheduled to participate.

Bhagwat, along with PM Modi, Uttar Pradesh Chief Minister Yogi Adityanath, Governor Anandiben Patel and President of Ram Mandir Trust, Nitya Gopal Das will be present on stage for the event.

Supreme Court, on November 9 last year, had directed the Central government to hand over the site at Ayodhya for the construction of a Ram temple.

The formation of Shri Ram Janmabhoomi Teertha Kshetra Trust was announced on February 5 for the construction of Ram temple at Ayodhya. The Trust has been mandated by the Central government to oversee the construction of Ram temple in Ayodhya.
