Nirbhaya gang-rape: All convicts to hang as SC dismisses last review plea

New Delhi, Dec 18: The Supreme Court on Wednesday rejected review petition filed by Akshay Kumar Singh, one of the four men convicted in the 2012 Nirbhaya gangrape and murder case.

A three-judge bench headed by Justice R Banumathi said there are no grounds to review the verdict and the contentions raised by convict Akshay Kumar Singh were already considered by the top court in the main judgement.

The bench said that review petition is not "re-hearing of appeal over and over again" and the top court had already considered the mitigating and aggravating circumstances while upholding the death penalty to the convict in the 2017 verdict.

The apex court said that it found "no error" on the face of the main judgement requiring any review. As soon as the bench pronounced the verdict, advocate A P Singh, appearing for convict Akshay, sought three weeks time to file mercy petition before the President.

 Solicitor General Tushar Mehta, appearing for the Delhi government, told the bench that one week time is prescribed under the law for filing mercy petition. "We are not expressing our view in this regard. If as per the law any time is available to the petitioner, it is for the petitioner to avail the remedy of filing mercy petition within that stipulated time," the bench said.

While pronouncing the judgement, the bench said the convict has again sought to assail the prosecution case and the findings of courts on it and this cannot be permitted. The bench said that the grounds raised by Akshay were almost identical to the grounds taken by the other three convicts in the case whose review pleas were rejected by the top court last year.

Regarding Singh's submission about the alleged flaws in the investigation, the bench said, "All these things have already been well considered by the trial court, High Court and the Supreme Court."

"I am very happy," Nirbhaya's mother, Asha Devi, told ANI after the verdict was pronounced by the three-judge bench of the apex court.

Akshay had moved the top court seeking clemency on the ground that the "rising pollution" has already increased the mortality rates. He sought commutation of the death penalty awarded to him and four others.

Besides Akshay, three other convicts, Mukesh, Akshay and Pawan are facing the gallows for rape and murder of a 23-year-old paramedical student in a moving bus on the night of December 16, 2012. The girl, who was later named Nirbhaya, died of injuries a few days later.

Two more people, including prime accused Ram Singh, were also accused of committing the crime. Singh, however, committed suicide in the Tihar jail during the trial of the case. Another accused was a minor at the time of the commission of the crime and was sent to a reform facility.

In 2013, a fast-track court had held the four condemned men guilty in the case. Their conviction was also upheld by the Delhi High Court and Supreme Court later.

Akshay is only one of the four convicts who had not filed the review petition in the case. Mukesh, Pawan and Vinay had filed the review petition last year but it was rejected by the apex court. As a last resort, Vinay, filed a mercy petition last month, but later sought to withdraw it.

Meanwhile, a Delhi court is also slated to hear a petition seeking issuance of death warrants against the four convicts today at 2 pm.

Jaipur, Jul 13: Congress Legislature Party (CLP) on Monday unanimously passed a resolution supporting Chief Minister Ashok Gehlot-led government and accusing the BJP of destabilising the government by indulging in horse-trading of MLAs.

The CLP also condemned all "undemocratic" acts to weaken Congress party and its government and demanded action against any Congress office-bearers involved in anti-party activities.

"Feared by exemplary works and public service of Congress government, BJP-led conspiracy is trying to destabilise Congress' state government, horse-trading of MLAs and trying to murder democracy by using money and political power," read the resolution.

"It is unfortunate that BJP did not learn lessons from the defeat in the Rajya Sabha elections and are trying to destabilise Congress government using corrupt means. 

This ripping off of democracy by BJP is an insult to 8 crore people of Rajasthan, they will not accept it. CLP meet expresses its confidence in Congress President Sonia Gandhi and leader Rahul Gandhi, and unanimously supports the government led by Ashok Gehlot," it said.

"This meet urges that strict disciplinary action be taken against any office-bearer or member of Legislative Party who indulges in activities against the Congress government, party or gets involved in any conspiracy," read the resolution.

As many as 107 MLAs attended the CLP meeting, which begun in the afternoon and now has been concluded.

"107 MLAs are present at the CLP meeting in Jaipur," Chief Minister Ashok Gehlot's media advisor confirmed to media.

The crisis in Rajasthan Congress intensified with Gehlot and his deputy Sachin Pilot at loggerheads. While Gehlot is blaming BJP for trying to destabilise the state government by poaching MLAs, Pilot is camping in Delhi to speak to the party leadership regarding the political turmoil in the state.

BJP has claimed that the Ashok Gehlot-led government has lost the majority in the state.

"Sachin Pilot was the rightful candidate for the post of Rajasthan Chief Minister but Ashok Gehlot took the charge; a conflict in the party began since then. What is happening today is the result of that conflict. The state government has lost the majority," Rajasthan BJP President Satish Punia said today.

Bengaluru, Feb 27: Defence Minister Rajnath Singh on Thursday said that the situation is moving towards normalcy in Delhi after recent incidents of violence.

"Situation is moving towards normalcy," Rajnath told media here.

Joint Commissioner of Police (Traffic) Narendra Singh Bundela on Thursday said that the law and order and traffic situation in violence-affected parts of Delhi is normal.

"The situation is quite normal and peaceful as far as security and traffic are concerned. We have held talks and conducted patrols with people of all communities. Services such as road cleaning have resumed and traffic flow is normal," Bundela told ANI here.

"People can go out to get their daily needs from the market but we are advising them not to come out in groups," he added.

Meanwhile, the death toll in the incidents of violence in North-East Delhi has risen to 34.

Delhi Police has registered 18 FIRs and 106 people have been arrested in connection with the violence.

Kochi, Apr 24: The central government on Thursday submitted a statement in the Kerala High Court on the three petitions challenging the contract between Kerala government and US-based data analytics company Sprinklr.

Assistant Solicitor General P Vijayakumar filed the statement on behalf of the central government, which is the second respondent in the case.

The statement said that the contract between the Kerala government and Sprinklr dilutes the rights of the people. It stated the contract does not specify the amount of compensation that individuals should receive in case of breach of privacy or misuse of information.

It also said that it was not clear whether the information was collected and handed over to the data analytics firm with full consent of the patients (suspected and otherwise).

''It is always preferable to utilise the services available in the government sector for sharing sensitive data required for analytical purposes.

The Government of India has introduced the 'Aarogya Setu' application for collection of health data and about seven crore Indian citizens have already downloaded the same. All the state governments are advised to promote the said application for fighting the pandemic," the statement said.

It was further submitted that the "Government of India with the support of NIC is capable of providing all the requirements relating to data storage, processing and application which are being offered the third respondent, if a request to that effect comes from the state government."

Kerala Congress leader Ramesh Chennithala and BJP state president K Surendran had earlier approached the Kerala High Court seeking cancellation of the state government's agreement with Sprinklr for processing of data related to COVID-19 patients.
