PIL filed in Supreme Court seeking ban on animal sacrifice during Eid-ul-Adha

New Delhi, Sep 8: A PIL has been filed in the Supreme Court questioning the sacrifice of animals on Eid-ul-Adha (Bakrid) and the validity of a provision of the Prevention of Cruelty to Animals Act, saying the practice was "cruel, inhuman, barbarian" and cannot be protected in the name of religion.

pilThe PIL, filed by seven Uttar Pradesh residents, has sought the court's direction to ensure that no animal is killed during the festival, called the feast of sacrifice, which is to be celebrated early next week.

"Issue a writ, order or direction or declaration to the effect that the practice of sacrifice of animals on Eid-ul-Adha day is unconstitutional and same cannot be resorted to by any member of the public," the petition said.

The plea, filed through lawyer Vishnu Shankar Jain, has challenged the constitutional validity of Section 28 of the Prevention of Cruelty to Animals Act which exempts the killings under religious practices and reads: "Nothing contained in this Act shall render it an offence to kill any animal in a manner required by the religion of any community."

"Issue a writ, order or direction striking down Section 28 of Prevention of Cruelty to Animals Act, 1960 as unconditional, being ultra vires to Article 14,21 and 25 of the Constitution," it said.

The PIL has made Ministries of Home Affairs, Law and Justice and Environment and Forest and Animal Welfare Board of India as parties.

"Tendency to sacrifice animals, even on roads and public places, are developing fast every year on Eid-ul-Adha in the most uncouth and inhuman manner and litres of blood is spread at public places affecting the sentiments of public at large," the plea said.

"It is most respectfully submitted that animals sacrifice on Eid-ul-Adha day is cruel, inhuman, barbarian, decency and morality and the same cannot be protected in the name of religion as such practice is in violation of Article 14,21 and 25 of the Constitution of India," it said.

Do animals have rights?

The vegetarian argument is that killing animals for the benefit of humans is cruel and an infringement of their rights. They put both on the same level without conceding any superiority to humans over animals. This argument is seriously flawed, because if animals had rights comparable to those of humans, they must also have equivalent duties. In other words, we must be able to blame them and punish them if they violate the rights of others. It is absurd that it should be considered a crime for humans to kill a sheep, but natural for a lion to do so. The problem stems from a misconception of the role of human life within the animal kingdom: a denial of purposeful creation within a clearly defined hierarchy degrades humans to the level of any other creature. Yet even then, the argument is illogical: Why should plants, for example, be denied the same protection from a violation of the sanctity of their life?

Is Islamic slaughter cruel?

The question of how an animal should be slaughtered to avoid cruelty is a different one. It is true that when the blood flows from the throat of an animal it looks violent, but just because meat is now bought neatly and hygienically packaged on supermarket shelves does not mean the animal didn’t have to die? Non-Islamic slaughter methods dictate that the animal should be rendered unconscious before slaughter. This is usually achieved by stunning or electrocution. Is it less painful to shoot a bolt into a sheep’s brain or to ring a chicken’s neck than to slit its throat? To watch the procedure does not objectively tell us what the animal feels.

The scientific facts

A team at the university of Hannover in Germany examined these claims through the use of EEG and ECG records during slaughter. Several electrodes were surgically implanted at various points of the skull of all the animals used in the experiment and they were then allowed to recover for several weeks. Some of the animals were subsequently slaughtered the halal way by making a swift, deep incision with a sharp knife on the neck, cutting the jugular veins and carotid arteries of both sides together with the trachea and esophagus but leaving the spinal cord intact. The remainder were stunned before slaughter using a captive bolt pistol method as is customary in Western slaughterhouses. The EEG and ECG recordings allowed to monitor the condition of the brain and heart throughout.

The Halal method

With the halal method of slaughter, there was not change in the EEG graph for the first three seconds after the incision was made, indicating that the animal did not feel any pain from the cut itself. This is not surprising. Often, if we cut ourselves with a sharp implement, we do not notice until some time later. The following three seconds were characterized by a condition of deep sleep-like unconsciousness brought about by the draining of large quantities of blood from the body. Thereafter the EEG recorded a zero reading, indicating no pain at all, yet at that time the heart was still beating and the body convulsing vigorously as a reflex reaction of the spinal cord. It is this phase which is most unpleasant to onlookers who are falsely convinced that the animal suffers whilst its brain does actually no longer record any sensual messages.

The Western method

Using the Western method, the animals were apparently unconscious after stunning, and this method of dispatch would appear to be much more peaceful for the onlooker. However, the EEG readings indicated severe pain immediately after stunning. Whereas in the first example, the animal ceases to feel pain due to the brain starvation of blood and oxygen – a brain death, to put it in laymen’s terms – the second example first causes a stoppage of the heart whilst the animal still feels pain. However, there are no unsightly convulsions, which not only means that there is more blood retention in the meat, but also that this method lends itself much more conveniently to the efficiency demands of modern mass slaughter procedures. It is so much easier to dispatch an animal on the conveyor belt, if it does not move.

Court should have right to panish if some one file the IPL which does not make any sence and causing unnessary focus, contradict the constituional rights and waste of court time etc.,"

Mangaluru, Jan 15: A 28-year-old man, who is a first-year MBBS dropout, was arrested by the police after he posed as a doctor and treated patients at a private hospital at Derlakatte on the outskirts of the city.

The arrested has been identified as Mohammed Habib Hussain, a native of Shivamogga, who was residing in Attavar, Mangaluru. He had discontinued studies after the first year due to personal reasons.

The incident took place on Sunday night  at Yenepoya Medical College, Derlakatte. Dr Sampathila Padmanabha, medical superintendent, Yenepoya Medical College, said the accused had come to the medical college at midnight on December 29.

After speaking to the security guard at the hospital entrance, he introduced himself as an assistant to the consulting urologist, and wanted to visit patients at the private ward situated at floor number 7.

After entering, he called the duty nurse to get case sheets. Later, he examined two women patients in the presence of the duty nurse, and also wrote a prescription on the patient case sheet. He also yelled at a nurse, saying that she isn’t doing her duty properly, and left the place.

However, the nurse who grew suspicious, informed the management, after the accused had left the place. The management, who crosschecked about the accused, found out that he is not a doctor, and that he is also not associated with the hospital.

The management sent an advisory to all employees to produce their identity cards, whenever they enter any wards, especially at night, and also to keep an eye on anyone suspicious. The same message was passed on to other hospitals in the vicinity.

The accused again showed up at the hospital on Sunday night. As security guards were told about strangers visiting the hospital in the guise of doctors, he was allowed to enter the hospital premises, so that he can be apprehended. He later went to the reception counter and queried about the consultant urologist. When he noticed that the staff had an idea about what was happening, he tried to flee from the spot. He was later caught by a security guard, and the police were informed. He was arrested by Ullal police station personnel.

Dr Padmanabha added that he used to roam around with his friend in a car. He was also involved in a similar incident at a private hospital in Kankanady, and the same has been informed to the police. He visited hospitals in a car, which has been seized by police.

Bengaluru, Jan 2: Former chief ministers of Karnataka Siddaramaiah and H D Kumaraswamy on Thursday launched a scathing attack on Prime Minister Narendra Modi as he embarked on a two-day visit to the state attend events in Tumakuru and Bengaluru. In a series of tweets, the Congress and the JD(S) leaders took a dig at Modi for his alleged failure on various fronts.

"You did not visit Karnataka when it was devastated by floods, you did not visit Karnataka when our farmers cried for help, but all of a sudden, when you want to launch your political propaganda, you remember the innocent people of Karnataka. Wah Modi Wah!!" Siddaramaiah tweeted.

In another tweet, the Congress leader claimed Karnataka is starved of Central government funds as there were no adequate flood relief, no GST revenue loss compensation and there was a delay in the transfer of grant-in-aid.

He further said, "Before attempting to fool our people, let the people of Karnataka know when they will get their due share!" He also sought to know from Modi why the 25 MPs from Karnataka have 'turned off' their engines.

"With 25 MPs from BJP and a state government with BJP, people hoped for a double engine. Instead, all BJP representatives have turned off their engines and have become sycophants to play a tune to your idiosyncrasies. Why, are they scared of you?" Siddaramaiah said.

Seeking an explanation on various incomplete projects, the Congress leader said, "Mr Narendra Modi, people are fed up of your lies and double-edged sword comments. We want your answer today about long-standing questions on: Kalasa Banduri Yojana, Belagavi border issue, exams in Kannada, Tulu & Kodava in 8th schedule, the list goes on." Kumaraswamy too minced no words as he went on the offensive against the Centre.

In his tweets quoting newspaper reports, he said Karnataka's coffer has dried up, financial position is in doldrums and the revenue has plummeted.

"What's the reason (behind poor economic situation)? The poor economic policies of the Centre. After swallowing the GDP and development of the country, the wrong policies have affected the state too," alleged Kumaraswamy.

Quoting reports, Kumaraswamy said the Centre has denied the state's share of revenue.

"About 5.44 per cent of state's share is yet to come from the Centre. This is step-motherly attitude of the Centre towards the state," Kumaraswamy tweeted.

Hubballi, Jan 30: Seeking to disabuse people of the notion that the Citizenship (Amendment) Act (CAA), recently passed by the BJP-led central government threatened the legitimacy of Muslims in the country, yoga guru Baba Ramdev on Wednesday said that he would among the first to take to the streets should the community face any such trouble. “If the National Register of Citizens (NRC) threatens injustice to Indian Muslims, it I not just I, but a billion Indians will protest against its implementation,” he added.

Recalling his longstanding association with Prime Minister Narendra Modi, Ramdev said, “I have known Modi for more than 15 years, and I can assure you that he cannot be called anti-Muslim. There is nothing in the CAA that threatens the rights of Muslims, some of whom are being misled by a few.”

The yoga guru said that, while 99% of the Muslims in India were patriotic, the remaining ones were seeking to divide the country, which he said was resulting in Islam falling into disgrace. “I appeal to all Muslims to keep away from such anti-national forces seeking to bring a bad name to Islam,” said Ramdev, calling on the people to stay united in the face of the severe economic crisis that the country was presently in the grips of.

He added that he was as committed to his goal of getting black money back to India. However, when quizzed by journalists as to how long he was willing to wait for PM Modi to realise this objective, Ramdev said, “Chodi, mere aur Modi ke beech jagada mat lao (Please do not incite a fight between Modi and me).”

The yoga guru also endorsed the decision of the Centre to recognise singer Adnan Sami with a Padma award.
