New Delhi, Oct 28: President Pranab Mukherjee has given his consent to Delhi LG's proposal to invite BJP to form the government in the national capital, the Centre today told the Supreme Court which rapped the LG for the five-month delay in taking a decision.najeeb jung

The apex court said that in a democracy, President's Rule cannot go on forever and questioned why the authorities failed to act expeditiously.

A five-judge constitution bench headed by Chief Justice H L Dattu said that it will hear the petition filed by Aam Aadmi Party (AAP) seeking dissolution of the House even though the Centre informed the bench that the President has given his consent on Lt Governor Najeeb Jung's proposal to invite BJP to form government.

The bench also asked why the Centre always comes out with one statement or another just a day before the matter is taken up for hearing by it.

"Just before matter is taken up for hearing, you make a statement. Why was it not decided earlier? How long can you go on like this?" the bench said, adding that LG should have taken the decision at the earliest.

"We can't shrug our responsibility and we will hear the case on merit," the bench said, adding, "in a democratic polity people have right to have government and not to be ruled by a governor."

It said that such issues take time and that is why it adjourned the case many times to facilitate the LG to take a decision but nothing has been done.

Referring to the President's letter which was placed before the bench, the apex court said that "this exercise should have been done much earlier". During the last hearing, the Centre had told the apex court that its stand on government formation in Delhi will only be known after Diwali as the LG's proposal to the President seeking his response on inviting single-largest party BJP was still under consideration.

The court was hearing a plea filed by AAP seeking dissolution of the Assembly and had earlier asked the Centre what steps it had taken to explore the possibility of government formation.

In his letter to the President, the LG had referred to the resignation of the AAP government on February 14, saying that it was not in "the interest of public to hold elections in such a short time after the elections of December 2013".

"In accordance with the constitutional convention and also keeping in mind the law laid down by the Supreme Court that every effort must be made to form a popular government before recommending dissolution, I shall be grateful if the Hon'ble President of India grants approval to invite BJP, that is even today the single largest party in the legislature to seek their interest in forming the government (MLA strength of all parties as well as independents is attached).

"Should the BJP agree, I would ask them to demonstrate their strength to form a stable government on the floor of the house within a stipulated time frame, possibly one week.

"Future course of action can be determined after taking into the account the response of the BJP," the letter had said.

BJP had emerged the single largest party after the Assembly polls in December last year with 32 seats including ally Akali Dal's one MLA in the 70-member House.

BJP fell four seats short of a simple majority and had refused to form the government, saying it did not have the numbers and will not resort to any "unfair means" to take the reins.

AAP with 28 MLAs had later formed the government with the support of eight Congress MLAs. AAP's strength has also come down to 27 after expulsion of party MLA Vinod Kumar Binny.

BJP's number came down to 28 in the House in May after three of its legislators--Harsh Vardhan, Ramesh Bidhuri and Pervesh Verma--were elected to Lok Sabha.

On August 5, the apex court had given five weeks' time to the Centre to take a decision on dissolution of the Delhi Assembly "one way or another", questioning it for continuing to keep the House in suspended animation when no party was coming forward to form the government.

New Delhi, May 6: The government on Wednesday said no data or security breach has been identified in Aarogya Setu after an ethical hacker raised concerns about a potential security issue in the app.

The app is the government's mobile application for contact tracing and disseminating medical advisories to users in order to contain the spread of coronavirus.

On Tuesday, a French hacker and cyber security expert Elliot Alderson had claimed that "a security issue has been found" in the app and that "privacy of 90 million Indians is at stake".

Dismissing the claims, the government said "no personal information of any user has been proven to be at risk by this ethical hacker".

"We are continuously testing and upgrading our systems. Team Aarogya Setu assures everyone that no data or security breach has been identified," the government said through the app’s Twitter handle.

The tweet gave point-by-point clarification on the red flags raised by the hacker.

"We discussed with the hacker and were made aware of the following... the app fetches user location on a few occasions," it said, but added that this was by design and is clearly detailed in the privacy policy.

The app fetches users’ location and stores on the server in a secure, encrypted, anonymised manner - at the time of registration, at the time of self assessment, when users submit their contact tracing data voluntary through the app or when it fetches the contact tracing data of users after they have turned COVID-19 positive, it said.

On another issue that users can get COVID-19 stats displayed on the home screen by changing the radius and latitude-longitude using a script, Aarogya Setu said that all this information is already public for all locations and hence does not compromise on any personal or sensitive data.

"We thank the ethical hacker on engaging with us. We encourage any users who identify a vulnerability to inform us immediately...," it said.

Responding to Aarogya Setu's clarification, Alderson tweeted, "I will come back to you tomorrow".

Jan 18: Days after the arrest of Deputy SP Davinder Singh along with two Hizbul Mujahideen terrorists, Shiv Sena on Saturday questioned the role of police in the Kashmir Valley.

"Cross border infiltration is ongoing in Kashmir. But the police machinery is being used to help the terrorists in Kashmir to safely cross the border (to Pakistan) and a President's medal awarded Deputy SP was arrested for doing so. In Kashmir (it seems), the government is using the police for some other purposes, what will the country's Home Ministry say if somebody has a doubt in connection with the Pulwama attacks," Sena mouthpiece, Saamna, read.

This was in reference to the incident in which Jammu and Kashmir police intercepted a vehicle on Sunday and arrested DySP Davinder Singh along with two top Hizbul Mujahideen terrorists, who were travelling together.

The Sena mouthpiece asserted that the impact and acceptance of the Centre removing Article 370 should be visible "through the people" during the upcoming Republic Day celebrations.

"Jammu and Kashmir is now a Union Territory. It is being ruled by the Centre through President's Rule. The government had removed Article 370 in a historic decision...The joy and excitement in the people over the removal of 370 should be visible in the Republic Day celebrations this time. The tricolour should be seen flying over all houses in Kashmir, it is the least that can be expected," it added.

The Sena mouthpiece further said that with the arrest of terrorists in the recent days, it hoped that "Republic Day will be celebrated safely in Delhi, Jammu and Kashmir".

New Delhi, Apr 29: India's tally of COVID-19 cases has reached 31,332, said the Union Ministry of Health and Family Welfare on Wednesday. With 73 more deaths reported, the number of deaths due to coronavirus in the country breached the 1,000 mark and stood at 1,007.

The tally is inclusive of 22,629 active coronavirus cases, 7,695 patients who have been cured/discharged and one patient migrated.

According to the Ministry, Maharashtra has the most number of COVID-19 cases with 9,318 cases of which, 1,388 patients have been cured/discharged while 400 patients have succumbed to the virus.

Gujarat has the second-highest number of positive cases in the country with 3744 cases including 434 patients cured/discharged and 181 deaths.

Delhi's tally stands at 3314 cases of which, 1078 patients have recovered while 54 patients have succumbed to the virus.

Madhya Pradesh has a total of 2387 positive cases including 377 patients recovered/discharged and 120 fatalities.

Meanwhile, Goa (seven cases; all seven recovered), Arunachal Pradesh (one case; now recovered), Manipur (two cases; both recovered), Tripura (two cases; both recovered) have reported no new cases of COVID-19.
