Proposed surrogacy law says no parenthood for singles

New Delhi, Apr 16: Bollywood celebrities like Karan Johar and Tusshar Kapoor became proud fathers via surrogacy but other aspiring singles may face roadblocks as a proposed law restricts this method by allowing only legally wedded couples. Several experts including lawyers and doctors, barring a few, were of the view that the window of surrogacy should not be closed for single parents and the couples should have the option to choose anyone who is not a close relative as a surrogate mother.karan

However, senior advocate Shekhar Naphade had a different and mixed take on the entire issue. While maintaining that it has become a "fashion" among celebrities to become a single parent, he advocated doing away with the provision to allow only a couple's close relative to become a surrogate mother.

The Surrogacy (Regulation) Bill, 2016, introduced in Lok Sabha last year, also faced criticism from practitioners of family law like Priya Hingorani and Anil Malhotra, who assailed the provisions which take away the rights of gays and lesbians from attaining parenthood with a clause that only legally wedded persons can go for surrogacy. The proposed law virtually bars all others like unmarried couples, single parents, live-in partners and homosexuals from opting children through surrogacy.

Dr Bikas Kumar Singh, Chief Medical Officer at a major private hospital here who preferred not to comment on the aspect of single parents, expressed reservation on the point of restriction that mandates a surrogate mother to be a close relative. "The last hope for a childless couple should not be curtailed but extended with due filtering," Singh said. Giving a broader perspective, Hingorani said it was not correct to only allow a close relative to be a surrogate mother as her confidentiality has to be maintained and anyone else should be permitted to do so.

Malhotra said the bar on unmarried couples and others from opting for surrogacy was violative of Article 14 of the Constitution which provides equality before the law and equal protection. As per the bill, the intending couples should be legally married for at least five years and should be Indian citizens to undertake surrogacy which would be allowed only for altruistic reasons. It also specifies the age limit for an infertile couple, where the woman should be aged between 23-50 years and the man between 26-55 years.

Naphade, who has filed a petition in the Supreme Court opposing commercialisation of surrogacy, said he does not subscribe to the concept of single parent and there should be a time frame after which a married couple can go for surrogacy. "It should not be a substitute for having a child through an unnatural process. The child should have both a father and a mother. When he goes out in the society, he will have a problem if he does not have a father or a mother. It is in the larger interest of the child," he contended.

However, these experts were united on their view that the clause of close relatives becoming surrogates was "objectionable" and would create family problems as it could reveal the identity of the surrogate mother, which needs to be kept secret. Hingorani, who was of the opinion that this clause would be challenged in court, said "when a single parent can adopt a child, why can't they go for surrogacy? It is contradictory. The intention of the bill is not to make surrogacy commercial. But you cannot single out gay and lesbian couples. When single mothers and live-in partners are recognised by law, how can you exclude them from surrogacy?"

While Naphade said the provision will be a "little problematic" and it needs to be debated, Dr Singh said the identity of the surrogate mother must be kept secret and if she is their close relative, there are chances that the child would come to know about it at a later stage. Malhotra was of the view that commercial surrogacy will still flourish and unethical practices continue. So, the better method would be to provide a regulatory authority with statutory powers like CARA is for adoptions.

"This clause of close relatives being surrogates will create family problems and conflicts with relatives in the family fold, as current societal practices in India may not find such a practice acceptable in traditional homes," he said. They, however, differed in their opinion on the provision of disallowing foreigners from opting surrogacy in India. While Dr Singh agreed with the government in disallowing foreigners saying it would ensure that women from the middle or lower middle classes are not exploited, Hingorani said there should be uniformity on the issue across the world and in many nations, they do not allow surrogacy. So why do people from there come here for it, she asked.

The woman lawyer said surrogacy should be legalised and open to others as well and proper norms should be evolved. People should be allowed only after they fulfill all criteria. She said the bill should include that the surrogate mother's health is properly taken care of, both pre- and post- delivery. And, instead of compensating her with hefty money, her health should be given priority. Dr Singh said that all medical aspects are covered in the bill and added that health of the woman should be considered but it should not be made the only criteria.

Malhotra said the ban on Non-Resident Indians, Persons of Indian Origin and Overseas Citizens of India per se does not appear to be satisfying any test of a valid bar. Such a discrimination clearly violates Article 14 of the Constitution when brought in parity with adoptions permissible to the NRIs, PIOs and the OCIs, he said. In January this year, the Rajya Sabha Chairman had referred the legislation, as introduced in the Lok Sabha in November last year, to the Parliamentary Standing Committee on Health and Family Welfare for in-depth examination. The parliamentary panel has invited suggestions on the legislation from all stakeholders.

Patna, Aug 3: Bihar DGP Gupteshwar Pandey on Sunday charged that Vinay Tiwari, the IPS officer from Patna who is in Mumbai to probe a case related to Bollywood actor Sushant Singh Rajput's death, has been "forcibly quarantined" by civic authorities in the metropolis.

Tiwari is heading a Bihar Police team which is in Mumbai to investigate an ''abetment to suicide'' case on the basis of a complaint filed by the late actor's father in Patna.

"IPS officer Vinay Tiwari reached Mumbai today from Patna on official duty to lead the police team there but he has been forcibly quarantined by BMC officials at 11 PM today," Bihar Director General of Police (DGP) Pandey tweeted.

"He was not provided accommodation in the IPS mess, despite request, and was staying in a Guest House in Goregaon," he said.

Sushant's sister Shweta Singh Kirti has tweeted, " What? Is this even for real? How can an officer sent on duty be quarantined for 14 Days?".

Rajput, 34, was found hanging from the ceiling of his Bandra residence on June 24 last.

Last month, Rajput's father lodged an FIR here of abetment to suicide naming actress Rhea Chakraborty, said to be close to the deceased Patna-born actor, and her family members as accused. Tiwari was posted as the City SP (East) in Patna.

The Mumbai Police, which is also probing the death case, have so far recorded statements of nearly 40 people, including those from Rajput's family, his cook and people from the film industry that include filmmaker Mahesh Bhatt, film critic Rajeev Masand, director-producer Sanjay Leela Bhansali and filmmaker Aditya Chopra.

Mar 21: The novel coronavirus outbreak in the country may have brought the ever-bustling film industry to a halt but it hasn't stopped Bollywood celebrities from utilising their massive online influence to entertain their followers as well as engage them in fitness, dance and yoga routines.

According to the Health Ministry, the coronavirus cases in India rose to 258 on Saturday after 35 fresh cases were reported in various parts of the country.

As the government encourages more social distancing, people from the film fraternity are finding ways to connect to people and ensure their self-isolation isn't wasted.

On Sunday, actor Shilpa Shetty will hold a special live fitness session across digital platforms for people to follow from home.

"In times like these, it's important to stay fit, active, and healthy. Join me on Sunday, 22nd March at 4:00 pm IST as I go LIVE on Instagram-Facebook-Helo (@theshilpashetty) and on the @ShilpaShettyApp to show you some beneficial and helpful yoga asanas.

"You can watch, learn, and practice it from the comfort of your homes. Remember, staying indoors shouldn't be an excuse for deviating from your fitness routine," the actor wrote in an Instagram post.

Online yoga and fitness programs are picking up steam, with many celebrities pitching in.

On Saturday, actor Tamannah Bhatia went live with Diva Yoga, a studio part of a larger yoga ecosystem called SARVA, where she participated in a one-hour virtual yoga class, to encourage people to pursue their fitness goals.

Malaika Arora, co-founder of the yoga studio, told news agency that as the world fights a public health crisis, "we must do our best to stay calm and safe."

"There is also a need to boost our immunity levels even if it means continuing our workout from home. The live sessions being conducted on the Diva Studios Instagram handle and immunity boosting modules being shared on the SARVA app and website are aimed at this.

"Our instructors will offer guided lessons every day... for everyone’s benefit. I encourage people to join in and be responsible for your own health. When you are fit and healthy, you can help others in a better manner. It is these small steps that will lead to a better outcome," she said.

With everything coming to a standstill, choreographer Terence Lewis has also figured out an alternate avenue to reach out to his students: through online classes.

As of now, those who are not his students do not have the access to it, but Lewis said that's going to change soon.

"In few days, we will be starting online dance tutorials for people who have no access and means to be a part of our institute directly. Since, we do not have any branches, neither do I believe in having one, we directly teach from our original space in Andheri.

"Here we have instructors who have learnt from me and is the only legit institute we have hence, we'll think of doing the online classes as way of engaging with people who are far away from us," Lewis told PTI.

As shootings of movies, TV shows and web series stand suspended till March 31, casting director and actor Abhishek Banerjee is encouraging artistes to send self tapes from their homes.

"We are encouraging that to minimise human to human contact and audition spaces. Some actors are known to us, some unknown. It's very difficult to track anybody's health of you don't know the person. So it's easier to see the self tapes and keep shortlisting them and maybe we will call them again for a proper audition when everything is alright," he said.

The process of recording a self audition, according to the "Stree" actor, isn't easy.

"Full marks and respect for actors who are sending the self tapes because audition process takes a lot of efforts and to do that alone, without any help in isolation, without cues, it's commendable."

Banerjee, who runs Casting Bay, a leading casting studios, along with his friend Anmol Ahuja, said on an average, any big casting office had around 100-150 footfalls everyday, which has now come to a griding halt.

"The minute the government decided, we stopped all auditions too. Everything is on a standstill now. The production houses have asked us to hold on the auditions and projects. The major worry is that many actors will have date issues now. Once everything opens in April, let's see how to tackle that. It'll be a very difficult situation," he added.

London, Jul 4: Hollywood star Chris Hemsworth says he is really excited about the biopic on WWE legend Hulk Hogan, which is currently in development.

"The Thor" actor revealed that he will bulk up his physique for the much-anticipated film to be directed by “Joker” helmer Todd Phillips.

“This movie is going to be a really fun project. As you can imagine, the preparation for the role will be insanely physical. I will have to put on more size than I ever have before, even more than I put on for Thor.

''And then there is the accent as well as the physicality and the attitude. I will also have to do a deep dive into the rabbit hole of the wrestling world, which I'm really looking forward to doing,” Hemsworth told British magazine Total Film.

The project was announced last year, with “8 Mile” scribe Scott Silver and John Pollono attached to pen the script.

It is expected to look into Hogan's rise from the Florida wrestling circuit to becoming the face of the World Wrestling Federation in the 1980s where he squared off with villain Andre the Giant.

The 36-year-old actor, however, said that the team is still “quite a way away” from starting production on the film.

“'I haven't even seen a script yet. The project is deep in development. Todd Phillips and I met to chat about it maybe a year or two ago. We talked about the idea for the film, which I think was going to be a TV series at one point.

''There were a few different ideas about what portion of his life it was going to be set in, so we spitballed about what it could be and what I thought it might be. Thankfully, they ran with a few of those ideas and the script is in the process of being written - but Hulk Hogan is still quite a way away.''

The biopic will be produced by Michael Sugar through his Sugar23's first-look Netflix deal along with Joint Efforts' Phillips and Bradley Cooper, Eric Bischoff, and Hemsworth.

Hogan will also serve as executive producer along with Sugar23's Ashley Zalta. Steve Desmond and Michael Sherman will serve as co-producers.
