Residential status of NRIs under I-T scanner, past assessments could be reopened

New Delhi: Individuals who claim to be Non-Resident Indians (NRIs) for tax filing purpose have come under the scanner of the investigation wing of the income tax (I-T) department.

Worth mentioning here is that an individual will be considered as an NRI by the I-T department if he stays overseas for more than 182 days in a particular financial year. But laws also state that a person will be considered as a 'resident' if he has been in India for more than 60 days in the year in question and 365 days during the four years prior to that year.

Many Indians divide their time between India and abroad in order to avoid paying tax on income from outside India. It may be noted that according to income tax laws, NRIs are not required to pay tax on their income from outside India but a resident Indian is required to pay tax on their income from abroad.

It is learnt that several NRIs have received notices from the I-T department for reopening tax assessments of the past five to six years, they were also told to share photocopies of their passports.

The tax department is scrutinizing individuals who claimed NRI status without fulfilling the norms on the period of stay for alleged tax evasion. These people may face long litigation, the business daily said.

“Even if a person is forced to extend his stay in India beyond 182 days on genuine grounds like hospitalisation or marriage, there is no respite. The department has turned aggressive to ensure that foreign income of residents does not escape taxation,” senior chartered accountant Dilip Lakhani said.

Many notices were served to NRIs a month before the budget which proposed an amendment (with retrospective effect) in the black money Act to include NRIs in the definition of ‘assessee’ – a move that would make the laws more stringent.

Worth mentioning here is that in the revised income tax return forms for the last financial year, NRIs have to give details of stay in India for the past four years to enable assessing officers to determine their true residential status.

It is advisable for NRIs who have got NRI status 6-7 years ago to preserve relevant documents and clear evidence of source and application of funds as well as immigration details, Mitil Chokshi, senior partner at Chokshi & Chokshi said.

Doha: Selvam aged 46 son of Subramanian hailing from Panakulam Village, Alangudi, Pudukkottai District in Tamilnadu province who worked as a technician, died in Qatar on April 24.

Due to challenging situation prevailing in both India & Qatar for body repatriation services, especially in Covid-19 atmosphere, Family is unable to progress further for past 2 months. At his stage Family of the deceased met Social Democratic Party of India (SDPI), Pudukkottai office bearers and requested to intervene and help out, and also agreed to bury the body in Qatar itself.

Hence, SDPI delegates communicated with well-known Indian Expatriate welfare Organization - Qatar Indian Social Forum (QISF). QISF General Secretary Basheer Ahamed, Secretary Abdullatheef Madikeri and team collected the required documents from the family of the deceased and managed to clear all the necessary formalities from the police department, Health Department, Embassy of India and Hamad Medical Corporation within a short period of time and arranged for a peaceful burial of Mr. Selvam in Dukhan cemetery.

Dubai, May 20: Dubai-based Karnataka Sports and Cultural Club’s humanitarian services in charge Naseer Karaje team have appreciated the efforts of Dakshina Kannada Deputy Commissioner, Mangaluru Airport director, NGOs of Mangaluru, and MLA for extending a royal welcome to second batch of repatriates from Dubai that landed at Mangaluru Airport on May 18.

There was so much of confusions when 1st batch of repatriation flight landed in Mangaluru airport on 12th May due to lack of proper arrangements and co ordination.

This time due to proper arrangements and special supervision by the DC everything was driven smoothly. It has given a confidence to all the Manglurean expats of Dubai in returning to their native places, the KSCC said.

Riyadh, Feb 24: Indian Islahi Center, Riyadh (IICR) kicked off the propagation campaign of "Learn the Quran" national conference, which is slated to be held on March 27, 2020 at Nofa Istiraha, Exit 18, Riyadh, Kingdom Saudi Arabia. It's IICR's 20th successful program.

Kerala Legislative Assembly's opposition leader & Congress leader, Ramesh Chennitthala inaugurated the campaign that was held at Voco Hotel in Riyadh, capital city of the Kingdom of Saudi Arabia. Ramesh was on two days visit in the Kingdom of Saudi Arabia.

The objective of the campaign is to instil the keenness & to keep creating the continuous awareness amongst the community on Quran. It also enables to recite the Quran with Tajweed (science of reading the Quran) & correct form.
