New Delhi, Nov 8: The Ryan murder case has a new twist after a Class XI student of the school was arrested, from his house in Sohna, by the CBI.

Sources said the student was charged under Section 302 of the IPC. He was taken in for interrogation by the CBI on Tuesday night.

The boy’s father said that he was informed by CBI late last night about the arrest. “The CBI questioned him the whole day and did not let me meet him. Around 11 pm, they told me that he has murdered Pradyuman,” he said.

According to Sec 19(a) of the Juvenile Justice Act, information by the Police officer-in-charge on arrest needs to be provided to the parent /guardian and probation officer. Since the arrested student is a minor, the report cannot divulge the name of the accused or his parent.

Pradyuman’s father Varun Thakur blamed the Gurgaon-based school’s authorities for its carelessness. “I can only say that what happened was because of school’s carelessness. We never thought any student can be involved in this case,” he told.

Till now a school bus conductor at Gurgaon's Ryan International School was believed to be the prime suspect in the murder of the seven-year-old. Days after the killing, Gurgaon Police had arrested the conductor.

The Gurgaon Police even claimed they had managed to secure a confession from the conductor — Ashok Kumar.

The conductor’s family had all this while claimed that he was being framed.

It was after sustained pressure from the parents that the Manoharlal Khattar government in Haryana transferred the murder case to the Central Bureau of Investigation (CBI).

The Class 11 student has been charged with Section 302 of IPC which deals with punishment for murder which is a heinous offence.

Now as per the JJ Act, if a juvenile between the ages of 16 to 18 commits a “heinous” crime, they may be tried as an adult based on the JJ Board’s assessment.

An offence is categorised as a heinous crime if the term of punishment is seven years and above. The JJ Board’s decision on whether to try the juvenile as an adult is preceded by a preliminary inquiry to assess the following things:

Mental and physical capacity to commit such an offence, Ability to understand the consequences of the offence and Circumstances in which the person allegedly committed the offence.

The JJ Act instructs that in order to complete the assessment, the Board can take the assistance of relevant experts, such as experienced psychologists. It is also clarified that the preliminary assessment is not a trial.

New Delhi, Feb 13: Arvind Kejriwal wrote to Delhi Lieutenant Governor Anil Baijal on Wednesday, staking claim to form the government in the national capital, sources said, while hinting that the AAP might not invite senior leaders and chief ministers of other parties for the oath-taking ceremony.

The sources said it was the formal process by the AAP chief, who was elected as the legislature party leader earlier in the day, to stake claim for forming the new government.

Kejriwal, who returned to power in Delhi with a stunning poll victory on Tuesday, will take oath as chief minister for the third consecutive time on February 16.

While the oath-taking ceremony will be open to the public, the Aam Aadmi Party (AAP) was considering not inviting leaders and chief ministers of other parties as it did not wish to be seen as a "confrontationist" against the BJP-led Centre, the sources said.

They, however, added that the party was yet to take a decision on it.

The AAP has planned mobilisation of people for the mega event and all the newly-elected MLAs of the party have been asked to ensure huge participation from their constituencies.

"I request the people of Delhi to attend the oath-taking ceremony of the chief minister at the Ramlila Maidan in large numbers," senior AAP leader Manish Sisodia told reporters, adding that the ceremony will start at 10 am.

The AAP won 62 seats in the 70-member Delhi Assembly, while the Bharatiya Janata Party (BJP) bagged the remaining eight seats. The Congress drew a blank for the second consecutive time in the Delhi polls.

New Delhi, May 30: The Congress on Friday described the first year of the Modi government as a "year of disappointment, disastrous management and diabolical pain".

Congress leader K C Venugopal said the six years of the Modi dispensation have seen fraying of bonds of empathy, fraternity and brotherhood with increase in acts of communal and sectarian violence.

Congress chief spokesperson Randeep Surjewala said that at the end of six years, it appears the Modi government is at war with its people and is inflicting wounds on them, instead of healing them.

"It is inflicting wounds on Mother India," he said.

"This government is trying to fill coffers of the select rich and is inflicting pain on the poor," Surjewala said.

On the BJP's charge of the Congress playing politics over the COVID-19 crisis, Venugopal said the opposition party did not indulge in any politics and gave suggestions instead.

"Being a responsible opposition, it is our duty to raise the problems faced by the common people. As opposition, we highlighted the failures of the government," he said.

Venugopal said the government "is totally insensitive" to the plight of migrant labourers and farmers.

Surjewala also demanded that a virtual session of Parliament be convened immediately to discuss pressing issues and the due process be set in motion for holding of meetings of various parliamentary committees.

Modi and his cabinet had taken oath on this day last year for a second term in office.
