Salman Khan may face fresh legal trouble over Khan market

salmanNew Delhi, Dec 30: It was an effective publicity move when Salman Khan launched the web portal khanmarketonline on December 26, calling it a gift for his fans on his birthday on December 27. The strategy though has already created a possible legal tangle for the actor with Khan Market Traders’ Association of Delhi objecting to the name.

Association president Sanjiv Mehra alleged that the Bollywood star is trying to gain “mileage out of Khan market’s popularity”. Speaking to Hindustan Times, Mehra said, “We are an internationally recognised market established in 1950. Salman Khan is neither part of the market, nor has he approached anyone here. He cannot use the name.”

Refuting rumours that he wants to take legal action against the Dabangg star, Mehra said that he plans to send a request to Salman Khan, asking him to change the name of his portal. “Salman Khan is a brand, it (the portal) could be named salmankhanmarketonline. Why use a brand that is already there? Salman is an entity agreed, then let him use his own credentials. Why should he take mileage out of Khan market’s publicity? Salman asks people to be human; he should just be one and volunteer to change his portal,” he said.

Asked if he would take a legal step, Mehra said, “I will discuss it with my legal team.”

Mehra also invited Salman to hire or buy a shop in Khan Market, as he will then be a part of the association. “We can then discuss whether he can use the name,” Mehra said.

So, what happens if Salman refuses to budge and Mehra is forced to look for a legal solution?

Supreme Court advocate Jitendra Mohan Sharma believes there is a fighting chance. “On principle, Khan market is an older entity and Salman Khan is a brand in himself but Khan market is also an established name. Being an older brand is a point Khan market can bank upon. Dominant principle would apply – which one is older and more popular,” Sharma said. However, equity and brand value could tip the scales. “Khan does not carry anything as it is a surname. It holds no weightage in copyrights issues. How it is to be balanced is for the two sides to agree upon. Equities will also have to be considered as to how much is at stake.”

A sessions court judge however disagrees. Speaking on the terms of anonymity, he said, “Anyone can use a name if it is not registered yet. Khan market per se can be anywhere in the country. There is no legal barrier standing on the way. Now if Bengali Market says it represents only Bengalis, you won’t find defence personnel in Defence Colony. So these are misnomers.”

Mumbai, Jul 3: Renowned Bollywood choreographer Saroj Khan died early on Friday morning due to cardiac arrest. She was 71.

The three-time National Award winner, who had choreographed some of the most memorable songs in Hindi cinema, was not keeping well for some time.

She was admitted to Guru Nanak Hospital in Bandra last Saturday after she complained of breathing issues. The mandatory COVID-19 test done at the hospital showed a negative result.

“She passed away due to cardiac arrest at around 2.30 a.m. at the hospital,” Khan’s nephew Manish Jagwani said.

In a career spanning over four decades, Khan is credited with choreographing more than 2,000 songs, including Dola Re Dola from Sanjay Leela Bhansali’s Devdas, Ek Do Teen from Madhuri Dixit-starrer Tezaab and Ye Ishq Haaye from Jab We Met in 2007.

She last choreographed for Tabaah Hogaye, featuring Madhuri from filmmaker Karan Johar’s production Kalank in 2019.

Kochi, Jan 6: A trial court on Monday framed charges against Malayalam film actor Dileep and other accused in the case of alleged abduction and molestation of a south Indian actress in 2017.

The actor and nine other accused were present in the additional special sessions court in Ernakulamwhen the charges were framed against them.

All of them have denied the charges.

On Saturday, the Court had dismissed a plea filed by Dileep, seeking to exclude him from the list of accused.

The Court had admitted the prosecution argument that there is prima facie evidence against him in the crime and dismissed the plea of the actor, who is eighth accused in the case.

The court had also not allowed a plea by the actor to grant him 10 days time to file the appeal in a higher court in the light of the Supreme Court order in November 2019 that the trial should be completed in six months.

The court is hearing the case in-camera.

On December 19, Dileep, along with his lawyers and a technical expert, had examined the contents of the electronic records at the closed room of the court.

Earlier, the Supreme Court had directed that the actor be allowed to inspect the records to enable him to present an effective defence during the trial.

In February 2017, the actress was allegedly abducted and molested by the accused.

Seven people, including the key accused 'Pulsar' Suni were arrested in connection with the actress' abduction case.

There are 10 accused in the case.

The entire act had allegedly taken place in a moving vehicle, which was filmed by the accused to blackmail her.

Dileep was subsequently arrested and arrayed as an accused in connection with offences under provisions of the Indian Penal Code and IT Act.

The top court had directed that the trial in case be concluded expeditiously, preferably within six months from the date of the judgement.

A woman judge is hearing the case.

In February 2019, the High Court, while considering a plea seeking to transfer the case to a Sessions Court headed by a woman judge to conduct the trial, had ordered the CBI special court Judge-III Ernakulam Honey M Varghese to complete the trial expeditiously.

Mumbai, Jun 30: Actor Aamir Khan on Tuesday issued a statement and confirmed that some of his staff members have tested positive for COVID-19, while the rest of his family members have tested negative.

Khan also announced that he was taking his mother for a COVID-19 test and urged his fans to pray for her test to come out as negative.

The '3 Idiots' star put out the statement on Instagram and said, "This is to inform you that some of my staff have tested positive. They were immediately quarantined, and BMC officials were very prompt and efficient in taking them to a medical facility."

Thanking the Brihanmumbai Municipal Corporation (BMC) for their precautionary steps, he added, "I would like to thank the BMC for taking such good care of them, and for fumigating and sterilising the entire society."

Informing about the health of his family members, the 'Thugs of Hindostan' actor added, "The rest of us have all been tested and found negative," and informed that, "Right now I am taking my mother to get her tested. She is the last person in the loop. Please pray that she is negative."

Thanking the BMC, and hospital authorities for their swift prompt, he added, "I would, once again, like to thank the BMC for the prompt, professional and caring manner in which they helped us. And a big thank you to Kokilaben Hospital and the doctors, nurses and staff there. They were very caring and professional with the testing process."

Aamir also urged his fans to be safe amid the coronavirus outbreak.
