SC gives protection from arrest to Setalvad till Feb 19

New Delhi, Feb 13: Supreme Court today granted protection from arrest to social activist Teesta Setalvad and her husband for another six days in a case of alleged embezzlement of funds for a museum at Ahmedabad's Gulbarg Society that was devastated in the 2002 riots.

teestasThe apex court said it would independently examine on the basis of FIR whether it is a case for granting anticipatory bail or not which has been denied to Setalvad and her husband.

"We are not going to quash the FIR," a bench comprising justices S J Mukhopadhaya and N V Ramana said.

Senior advocate Kapil Sibal, appearing for the Setalvads, said "we are also only for anticipatory bail" and all documents would be placed to satisfy that "it is not the case of custodial interrogation."

After hearing for half an hour during which Additional Solicitor General Tushar Mehta opposed the plea, the bench deferred the matter for February 19, asking the parties to place before it the Gujarat High Court judgement and other additional documents.

In the mean time, the order passed yesterday granting them interim protection, shall continue till then, the bench said.

"We will look into the allegations in the FIR mainly. Let it be very clear, we will be looking at the case not by names but like the case of any ordinary individual," it observed.

The apex court was hearing the appeal filed by the Setalvads against the yesterday's judgement of the High Court by which their plea for anticipatory bail was rejected for not co-operating with the investigation.

The High Court had also observed that Setalvads were not cooperating in the probe and that "they cannot be armoured with full fledged anticipatory bail when applicant did not cooperate with the investigation."

Setalvad and her husband have been booked by the Crime Branch of Gujarat Police on charges of cheating, breach of trust and under the IT Act, in a matter relating to the construction of "Museum of Resistance" in the Gulbarg society in Ahmedabad which was hit by communal riot in 2002.

On February 28, 2002, in the aftermath of the Godhra train burning incident, armed rioters had swooped on the Gulbarg society and killed 69 people, including former Congress MP Ehsan Jafri.

New Delhi, Jun 4: India on Thursday witnessed a record single-day spike of 9,304 coronavirus cases taking the country's tally to 2,16,919, according to the Union Ministry of Health and Family Welfare.

The ministry informed that 260 more deaths due to coronavirus were reported in the last 24 hours.

The total number of cases in the country now stands at 2,16,919 including 1,06,737 active cases, 1,04,107 cured/discharged/migrated and 6,075 deaths.

Maharashtra has so far reported 74,860 cases, more than any other state in the country.

In Tamil Nadu, 25,872 cases have been detected so far while Delhi has reported 23,645 coronavirus cases.

According to the Indian Council of Medical Research (ICMR), 1,39,485 samples were tested in the last 24 hours whereas 42,42,718 samples have been tested till date.

Ahmedabad, May 12: The Gujarat High Court on Tuesday declared state BJP minister Bhupendrasinh Chudasama's election in 2017 as void on grounds of malpractice and manipulation.

Justice Paresh Upadhyay cancelled Bhupendrasinh Chudasama's election in an order passed on a petition filed by Congress candidate Ashwin Rathod, challenging the BJP leader's victory from Dholka constituency by a margin of 327 votes in the 2017 Gujarat Assembly polls.

In his election petition, Ashwin Rathod alleged that Bhupendrasinh Chudasama indulged in "corrupt practice and breach of many of the mandatory instructions of the Election Commission, at various stages of the election process, more particularly at the time of counting of votes".

Bhupendrasinh Chudasama currently holds charge of the education, law and justice, legislative and parliamentary affairs, and some other departments in the Vijay Rupani government.

Shimla, Apr 19: A man, who had recovered from the novel coronavirus, was again found suffering from the infection in Himachal Pradesh, officials said.

The man, a Tablighi Jamaat member, tested positive for the infection on Saturday within a week of his two reports coming out negative, they said.

Residents of different places in Mandi district, the man along with two other Jamaatis had been staying in a mosque of Nakroh village in Una'a Amb tehsil and all tested positive on April 2.

They were admitted to Tanda's Dr. Rajendra Prasad Government Medical College (RPGMC) in Kangra district on April 3.

As per the available information, they had tested negative for the first time on April 10 and they were declared as cured as per protocol after they tested negative for the second time on April 12.

Subsequently they had been discharged from the RPGMC and were kept in institutional quarantine.

However, with the man again testing positive, the total number of active cases in the hill state has increased to 23 out of the total 40 positive cases.

Four persons have been shifted to a private hospital outside the state. Eleven have recovered while two others have died.

A total of 16 confirmed cases were found in Una and health department statistics now shows 14 active cases and two cured.

Officials said 11 patients — three each from Chamba, Kangra, and Solan districts and two from Una district — have recovered.
