Sex worker can't allege rape if denied money: SC

New Delhi, Oct 12: Acquitting three persons of rape charges, the Supreme Court has ruled that a sex worker cannot lodge a sexual assault complaint against her customers if they refuse to pay.

scA bench of Justices Pinaki Chandra Ghose and Amitava Roy said that though the evidence given by a woman alleging rape must get importance from the trial court, but it could not be taken as "gospel truth".

"The evidence of prosecutrix must be examined as that of an injured witness whose presence at the spot is probable but it can never be presumed that her statement should always, without exception, be taken as gospel truth," the bench said.

The ruling came in a 20-year-old case from Bengaluru. A woman, working as a maid, had alleged that three persons abducted her in an auto, took her to a garage and repeatedly raped her.

The three accused had challenged a Karnataka high court order directing their prosecution. The SC bench examined the witness all over again and said, "Her conduct during the alleged ordeal is also unlike a victim of rape and betrays somewhat submissive and consensual disposition."

In her statement to the trial court, the woman had said that after the three accused dumped her, she went back to locate the garage where she was raped before lodging the complaint so as to enable her to give proper evidence about the crime.

The woman's roommate, however, spilled the beans while deposing as a witness. She said the woman used to take financial help from the accused persons and, after completing her household work, used to indulge in prostitution at night. The roommate further told the court that the woman had approached the accused persons for Rs 1,000 which they declined to give.

When asked why she had lodged the complaint against the accused persons, the woman had said that it would have compelled them to pay the money she wanted.

The bench said, "This witness's version is plausible, and thus, fits in with the defence plea to demolish the prosecution case." Writing the judgment for the bench, Justice Roy said, "Her vengeful attitude in the facts and circumstances, as disclosed by her, if true, demonstrably evinces a conduct manifested by a feeling of frustration stoked by an intense feeling of deprivation of something expected, desired or promised."

Acquitting the three accused, Justices Ghose and Roy drew the conclusion, "We are of the unhesitant opinion that the prosecution has failed to prove the charge against the appellants to the hilt as obligated in law and thus, they are entitled to benefit of doubt."

Panipat, Mar 3: A 22-year-old man was charred to death after he came in contact with a live electricity wire while posing for a TikTok video near the Matlaudha railway station here, police said on Tuesday.

The incident took place on Monday evening when Vikas, a resident of Dharamgarh village, climbed a pole over which the wire was passing and posed for the video, police said.

His three friends were standing below when the accident took place.

Vikas came in contact with the wire carrying 25,000 volts current and was burnt, police said.

Police have sent the body for a post-mortem and started investigation into the matter.

Jun 25: A 16-year-old girl allegedly committed suicide at her house in east Delhi and her family members secretly buried her body, which was later exhumed for post-mortem, police said on Wednesday.

The girl, whose family hails from Jharkhand, allegedly hanged herself in a room in her house on Monday, they said.

No suicide note was recovered from the spot, police said.

Her body was exhumed on Tuesday as per the directions of the Sub Divisional Magistrate of the area. The process was carried out as her family members secretly buried her without informing the police.

The post-mortem will be conducted after Covid-19 tests, police said.

The incident took place on Monday. The reason behind her taking the extreme step is yet to be ascertained, they said.

Police said the girl lived with her mother and two siblings. The family hails from Jharkhand and are financially extremely weak. Her father died two years ago, they said.

After the father’s death, the girl's mother along with her siblings took her body to a burial ground and buried her, police said.

The police said the matter came to their notice after a neighbour alerted them about it. Following the information the body was exhumed, they said.

On questioning the girl's mother, she told police that she didn't know that one has to inform police in a suicide case, a senior police officer said.

Inquest proceedings have been initiated, police said.

Amaravati, Jul 31: Nine people have died after allegedly consuming sanitiser in Prakasam district of Andhra Pradesh today, the police said.

Prakasam district Superintendent of Police Siddharth Kaushal said the people had been consuming sanitiser for the past few days, mixing it with water and soft drinks.

"We are also investigating whether they laced the sanitiser with any other toxic substances," the official said.

"Their family members say these people have been consuming sanitiser for the past ten days. We are sending the sanitiser stocks, being sold in the area, for examination," he added.

Kurichedu in Prakasam district has been under lockdown due to rise in coronavirus cases and hence, liquor shops have also been shut since the past few days.

Habitual drinkers were said to be consuming sanitisers that have alcohol content, apart from illicitly distilled arrack.

The police said two beggars near a temple were the first to fall victim on Thursday night. While one of them was found dead at the spot, another died in the government hospital in Darsi town, they said.

A third person was also taken to the Darsi hospital late on Thursday night after he fell unconscious but he was declared brought dead. Six others who fell ill after allegedly consuming sanitiser, died this morning.

Others who fell ill after consuming sanitiser are undergoing treatment at their residences in the village, the police added.
