Shah Rukh Khan I-T notice; asked to spell out offshore investments

Mumbai, Jul 25: Amid New Delhi's high-pitched hunt for hidden assets of the rich and famous, actor Shah Rukh Khan has received a notice from the income-tax department. About a fortnight ago, the tax office asked Khan to spell out details of his investments in offshore destinations.

srkThe tax office sought details of Khan's investments in destinations such as Bermuda, British Virgin Islands (BVI) and Dubai. While tax authorities are sitting on a mountain of information on offshore investments by a large number of Indians, it is unclear whether the department has any prima facie evidence to believe that Khan's overseas assets reflect his undisclosed wealth.

The notice was sent under Section 131 of the Income-Tax Act, which empowers tax authorities to conduct enquiries, a person aware of the development told ET. The department, it appears, is going beyond the actor's disclosed ownership of shares of companies in tax havens to fish out information such as activities of these outfits, the decision-makers, directors, etc. ET's email to Karuna Badwal, Khan's business manager and co-producer at Red Chillies Entertainment, went unanswered till the time of going to press.

According to industry sources, besides Khan, a few industrialists who have structured investments through Singapore have received similar notices. It happens at a time the government — driven by its promise to unearth black money — is going after many wealthy Indians who did not declare overseas bank accounts and assets such as properties and stocks in the quasiamnesty scheme last year. The notices to celebrities (like Khan) may be aimed at reminding the rich that they should come clean under the ongoing Income Declaration Scheme (IDS), which is being aggressively marketed by the finance ministry as an opportunity to declare undisclosed local assets.

Efforts to make a ID's a success

"The government is making all efforts to make IDS a success. Notices are being issued to assessees to send the message that the government is serious and those who once again refuse to declare concealed income would face the music," said senior chartered accountant Dilip Lakhani.

According to Mitil Chokshi, senior managing partner at audit firm Chokshi & Chokshi LLP, "There's no doubt that those assessees who have been issued notices or subjected to investigation cannot opt for IDS. But such actions — like prosecution initiated against many assessees, charges slapped on many professionals for aiding and abetting, and information obtained from other jurisdictions — would make assessees think twice before evading tax. It would surely go to make many new assessees." Neither Lakhani nor Chokshi is an adviser to Khan.

Many businessmen, top-notch professionals and actors have used the liberalised remittance scheme of the Reserve Bank of India to buy apartments and stocks abroad. Many, in order to escape estate duty, bought into shell companies in Jersey to invest in London's property market. The scheme allows investment in almost all markets barring countries such as Mauritius, Iran and Afghanistan. Some businessmen have used their companies in India to invest abroad as rules allow a local company to invest up to 400% of its net worth in an overseas joint venture or wholly owned subsidiary.

"A lot depends on how investments are structured. A professional in showbiz who parks a slice of his earnings from overseas shows in an offshore account may appear to be violating the law. But if he organises his business smartly — by giving the rights of organising such shows to a firm in BVI or Dubai and hires directors who execute the decisions — he may still be within the tax rules. He is liable to pay tax only if he receives dividend from such overseas companies he has floated," said a person who provides such advice.

A few years ago, taxpayers were told to share information of overseas investments in their tax returns. "But even if one shares such information, the tax department would not know the nature of the company and its structure. Now, they are trying to find out more. But there's very little the department can do if the investments are legal," he said.

New Delhi, Aug 5: Playback singer S P Balasubrahmanyam on Wednesday confirmed testing positive for COVID-19 with 'mild' symptoms.

The 74-year-old musician shared the information through a video message posted on his official Facebook page.

In the video, the singer detailed about having a little "discomfort" for two days, stating he had chest congestion along with cold and on-off fever, which led him to get tested for the virus.

However, he also mentioned that he could have stayed at home in self-quarantine, as advised, but did not want to put his family in danger, and hence got admitted by his own choice, to recover quickly.

"I am in good hand, I am in good health. Nobody has to worry about this. The fever has subsided, and in two days I'll be discharged and I'll be home. Thanks for the concern," he said in the video message.

New Delhi, Jan 2: Hoping her cinematic voice can help bring about lasting change in how society perceives acid attack survivors, actor Deepika Padukone says her latest film Chhapaak should ideally be so impactful that there won't be need for another story on acid violence.

After all, cinema is in itself such a powerful medium, Deepika told news agency ahead of the release of the film, which is based on the life of acid attack survivor and activist Laxmi Agarwal.

The idea behind the social drama is to invoke empathy and understanding rather than paint women who have undergone the ordeal as victims, the actor, who has also produced the film, said in a telephonic interview from Mumbai.

"Beyond the gruesomeness, the violence and all of that, there is a story of the human spirit and hope. That's why we're telling the story," she said.

Deepika, 33, said it was a story that spoke to her and she felt pride in attaching herself to the project.

Chhapaak, directed by Meghna Gulzar and featuring Vikrant Massey, is the second mainstream film to focus on the subject after 2019 Malayalam movie Uyare starring Parvathy Thiruvothu.

"I hope we won't have to constantly tell stories on acid attack survivors for us to see change. I hope with our film we begin to see that change for ourselves as a society and for acid attack survivors.

"If we don't, then we've done something wrong as a society. Cinema in itself is such a powerful medium that hopefully just through this one film we will hopefully be able to see that kind of change and impact," Deepika said.

The actor said there was not much planning behind the decision to back the film financially.

"Sometimes certain films need a little more hand holding, a little more love and support. I felt like I would be adding a little more value as a producer.

"This is a film I'm very proud of, not just from the script point of view but even in terms of the story and its message," she said.

The film, which releases on January 10, will be Deepika's first release in two years and comes after her marriage to frequent co-star Ranveer Singh.

The actor said she used the time to creatively replenish herself.

"It was about finding a film worthy of putting out there. It's not that work at my end had stopped. I was constantly looking for scripts that challenged and excited me.

"I would look at it as time for creative fertility. It's important to nurture yourself. The work that goes on behind the scenes... most often we're constantly on a film set, but whether it's meeting with writers and directors, looking for scripts... That is also part of the creative process and that's what I've been doing."

The title Chhapaak instantly evokes the image of acid being splattered, and Deepika said the director wanted a word for the film's name that could also lend itself to a song.

"I think she said 'chhapaak', which is the sound of a splash, is something that could adapt or lend itself beautifully to a song. Perhaps, it also has to do with fluidity. So on one hand, liquid is known to take different forms, a liquid such as this (acid) can change someone's life forever," she said.

Mumbai, Jul 27: Reel life villain Sonu Sood turned real life hero once again, this time by gifting a tractor on Sunday to a farmer in a remote village in Andhra Pradesh to help him till the land. The actor came up with the gift after coming through a video clip on Twitter wherein a tomato farmer in Madanapalle in Chittoor district was seen ploughing the land with his two daughters carrying the yoke on their shoulders.

In his instant reaction, Sood promised a pair of ox to the farmer, but later said the family deserved a tractor. "So sending you one. By evening a tractor will be ploughing your fields. Stay blessed," Sood, who acted as a villain in numerous Telugu films, said in a tweet.

True to his word, a new tractor was delivered to the elated farmer Nageswara Rao at his Mahalrajupalle village by Sunday night. Telugu Desam Party president N Chandrababu Naidu, who belongs to Chittoor district, hailed the actor's gesture.

"Spoke with @sonusood ji and applauded him for his inspiring effort to send a tractor to Nageswara Rao's family in Chittoor district. Moved by the plight of the family, I have decided to take care of the education of the two daughters and help them pursue their dreams," Naidu said in a tweet.

Rao's elder daughter completed her Intermediate while the second one passed Class 10. Rao used to run a tea stall in Madanapalle before coronavirus left him out of business. He returned to his native Mahalrajupalle village to take up agriculture once again.

Given his penury, he could not hire either a pair of bulls or a tractor to till the land, when his daughters volunteered to help him on the chores. Their plight went viral on social media following which the actor stepped in with help.
