Trump picks conservative judge Neil Gorsuch for Supreme Court

February 1, 2017

Washington, Feb 1: US President Donald Trump has nominated young federal appeals court judge Neil Gorsuch for the high-profile job on the Supreme Court, elevating a jurist who could cement the court's conservative bent and help shape the American legal establishment for decades, including on divisive issues such as gun control and religious rights.

Gorsuch, 49, is the youngest Supreme Court nominee in a quarter century and is Trump's pick to fill a vacancy caused by the death of conservative Justice Antonin Scalia nearly a year ago.

Gorsuch's nomination underscores the fast-rising conservative's potential to shape major decisions for decades to come on major divisive issues such as abortion, gun control, the death penalty and religious rights.

"I am proud to announce the nomination of Judge Neil Gorsuch for Justice of the Supreme Court," Trump said in a televised prime-time event from the East Room of the White House.

"Judge Gorsuch has outstanding legal skills, a brilliant mind, tremendous discipline and has earned bipartisan support," Trump said adding, "It is an extraordinary resume — as good as it gets."

Born and raised in Colorado, Gorsuch attended Columbia University and Harvard Law School and after graduating with honours, he received his doctorate from the Oxford University as a Marshall Scholar.

Gorsuch is seen as an "originalist" who believes in the American Constitution's original intent and meaning.

"Judge Gorsuch has a superb intellect, an unparallelled legal education, and a commitment to interpreting the Constitution according to its text. He will make an incredible Justice as soon as the Senate confirms him," Trump said.

Making his first nomination to the Supreme Court, Trump also said that he was fulfilling his promise to select someone who loves the Constitution and respects laws and will interpret them as written.

In 2006, then President George W Bush nominated Gorsuch for the US Court of Appeals for the Tenth Circuit, and he was confirmed by voice vote without objection.

"I am honoured and humbled to receive this nomination. I look forward to meeting with Senators over the coming weeks as we begin this process," Gorsuch said.

Outlining his legal ideas, Gorsuch said: "It is the rule of judges to apply, not alter, the work of the people's representatives. A judge who likes every outcome he reaches is very likely a bad judge."

He also praised Justice Scalia as "a lion of the law."

Trump said he hoped both Democrats and Republicans can come together for once for the good of the country. But some Democrats have vowed to mount a vigorous challenge to nearly any nominee to what they view as the court's "stolen seat."

"This may be the most transparent judicial selection process in history," Trump said, adding "the qualifications of Judge Gorsuch are beyond dispute."

As a young man, Gorsuch delivered papers and worked as a front desk clerk at a Howard Johnson to make extra money. Now, he enjoys fishing, hiking and skiing. He and his wife care for animals, including a horse, in the small barn at their home.

The silver-haired jurist is known for writing incisive rulings, advocacy for court review of government regulations and defence of religious freedom.

If confirmed, Gorsuch's appointment could have a major impact on abortion, gender rights and gun control issues. Although Republicans hold 52 seats in the Senate, they need 60 to confirm a nominee.

"I pledge that if I am confirmed I will do all my powers permit to be a faithful servant of the Constitution and laws of this great country," Gorsuch said.

He said the Supreme Court's work is vital to protect the people's liberties under law and to the "continuity of our Constitution, the greatest charter of human liberty the world has ever known."

House Speaker Paul Ryan said in Gorsuch, Trump fulfilled his pledge to nominate a judge who has demonstrated loyalty to the Constitution. "He is a phenomenal nominee for the Supreme Court."

House Majority Leader Kevin McCarthy said Congress and the American people don't want a liberal Supreme Court justice or a conservative Supreme Court justice. "We want a justice who will decide cases based on the law and the Constitution as they are written. Neil Gorsuch appears to fit that mold."

The Democrats, however, voiced their opposition.

"Given his record, I have very serious doubts about Judge Gorsuch's ability to meet this standard. Judge Gorsuch has repeatedly sided with corporations over working people, demonstrated a hostility toward women's rights, and most troubling, hewed to an ideological approach to jurisprudence that makes me sceptical that he can be a strong, independent Justice on the Court," said Senate minority leader Charles Schumer.

"Make no mistake, Senate Democrats will not simply allow but require an exhaustive, robust, and comprehensive debate on Judge Gorsuch's fitness to be a Supreme Court Justice," he said, adding that the Senate must insist upon 60-votes for any Supreme Court nominee, a bar that was met by each of President Barack Obama's nominees.

Democratic Senator Patrick Leahy said he had hoped that Trump would work in a bipartisan way to pick a mainstream nominee like Merrick Garland and bring the country together.

"Instead, he outsourced this process to far-right interest groups. This is no way to treat a co-equal branch of government, or to protect the independence of our federal judiciary," he said.

National Abortion Federation in a statement expressed its disappointment. "We need a Supreme Court justice who will honour established precedent, including the constitutional right to privacy and Roe v Wade. That Justice is not Neil Gorsuch," said its president and CEO Vicki Saporta.

The Seattle City Council, one of the most powerful city councils in the U.S., on Monday unanimously passed a resolution condemning India’s recently-enacted Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC).

Reaffirming Seattle as a welcoming city and expressing solidarity with the city’s South Asian community regardless of religion and caste, the resolution “resolves that the Seattle City Council opposes the National Register of Citizens and the Citizenship Amendment Act in India, and finds these policies to be discriminatory to Muslims, oppressed castes, women, indigenous, and LGBT people“.

Introduced by Indian American City Council member Kshama Sawant, the resolution urges the Parliament of India to uphold the Indian Constitution by repealing the CAA, and to stop the National Register of Citizens, and take steps towards helping refugees by ratifying various UN treaties on refugees.

“Seattle City’s decision to condemn CAA should be a message to all who wish to undermine pluralism and religious freedom. They cannot peddle in hate and bigotry, and expect to have international acceptability at the same time,” said Ahsan Khan, president of Indian American Muslim Council.

Thenmozhi Soundararajan of Equality Labs, which organised the community in support of the resolution, welcomed its passage. “We are proud of the Seattle City Council for standing on the right side of history today. Seattle is leading the moral consensus in the global outcry against the CAA, she said.

Soundararajan said that thousands of organizers across the country have called, e-mailed, and visited Seattle City Council members to amplify this resolution, and it sets an example to cities across the United States.

“At a time when members of the Indian ruling party sided Trump, the Muslim ban, and his war on immigrants as justification for targeting hundreds of millions of Indian minorities, Americans have a unique responsibility to stand up and speak about this human rights crisis. We are glad that Seattle is leading the way on this,” she said.

Washington, Jun 24: Twitter has once again flagged a tweet from US President Donald Trump which promoted violence by saying if protesters tried to set up an "autonomous zone" in Washington, DC they would be met with "serious force".

This is the fourth time Twitter has red flagged Trump's tweet for glorifying violence or violating its policies.

Trump has been critical of the "autonomous zone" in Seattle, an area occupied by protestors for much of this month.

"We've placed a public interest notice on this Tweet for violating our policy against abusive behaviour, specifically, the presence of a threat of harm against an identifiable group," Twitter's safety team tweeted late Tuesday.

Trump had tweeted: "There will never be an ‘Autonomous Zone' in Washington, D.C., as long as I'm your President. If they try they will be met with serious force!"

Twitter earlier labeled a video tweeted by him which mocked CNN as manipulated media.

According to Twitter, "this Tweet has been labeled per our synthetic and manipulated media policy to give people more context".

In May, Twitter labeled two Trump tweets that made false claims about mail-in ballots in California.

Twitter later labeled another Trump tweet glorifying violence in which he said, "when the looting starts, the shooting starts."

Facebook also removed a Trump campaign ad featuring a symbol used by Nazis for political dissenters, saying the ad violated its policies.

Brussels/Amsterdam, Apr 16: As the novel coronavirus continues to wreak havoc in the western world since its outbreak in Wuhan last December, researchers believe that the Chinese leadership is trying to absolve President Xi Jinping by using a section of the western media to influence public opinion globally.

"There are clear indications that China is conducting activities in a persistent and systematic manner to influence public opinion-making, academia, think tanks and political decision-making among the member states of the Belt and Road Initiative (BRI) in general and western capital cities in particular," Siegfried O Wolf, Director of Research at Brussels-based think tank South Asia Democratic Front, said.

Some western media say some Chinese officials were secretly aware that they were facing a pandemic from the new coronavirus but allowed Wuhan to host a mass banquet for tens of thousands of people and millions began their annual trip home for the Lunar New Year celebrations.

The pandemic has since then affected 210 countries and territories around the world. Over 2 million people have been declared positive in which over 134,000 lost their lives.

"The frequency and extra-ordinary large scale of Chinese sponsored events in European political hubs, like in Brussels, and the subsequent media coverage can be seen as evidence for Beijing's public diplomacy efforts. However, the rising skepticism within the EU regarding Xi Jinping's development projects and the emerging questioning of Chinese sources funding Free Universities, like the one in Berlin, shows that this strategy produced mixed results so far," Wolf said.

He added, "However, one must also state that these efforts helped China to gain certain leverage among many non-Chinese media, western as well as non-western ones. Today, we can observe that China's political leadership tries to instrumentalise this influence for a major image campaign to distract from the fact that it carries the initial responsibility for the dramatic spread of COVID-19 by holding back key information."

Wolf also said that the current internal dynamics in China, like the shirking of responsibilities by the local authorities, are most-likely part of a twofold strategy. Firstly, there is the strategic component - namely, to reaffirm to the general public that the Communist Party of China is still in full control of the situation. The second strategic pillar is one of 'whitewashing'.

"Concretely, Beijing's obvious aim is to distract the domestic and international attention from the real, but hidden causes of the Coronavirus outbreak and its potential reputational and political consequences for Xi Jinping and his BRI," he stated.

Yoana Barakova, a Research Analyst at European Foundation for South Asian Studies (EFSAS), an Amsterdam-based think-tank, said, "The death of Dr. Li Wenliang, one of the very few medical professionals who tried to warn the world in December 2019 about the looming threat, sparked widespread condemnation around the international community in early February. Yet, little did he know that his legacy would continue much later after his demise, with the emboldened Chinese government trying to cover up its missteps through hardcore censorship after being exposed for undermining and underestimating the initial danger."

The researchers believe that the deterioration in press freedom under Jinping's regime has become more evident in recent days, with local authorities trying to control the state narrative by cosmetically placing media's focus on government's superficial attempts to tackle the crisis.
