Woman Got Fired For Being HIV Positive, To Get Her Job Back After 3 Years

Pune, Dec 4: A Pune-based woman employee, who was terminated by her company after being diagnosed with HIV, got justice from the Labour Court almost after three years.

The court on Monday ordered the company to reinstate her in the same post she was in, along with providing all the back wages.

The company had terminated her in 2015 after she submitted a medical document for claiming medical benefits which revealed that she was diagnosed with HIV, following which company asked her to resign on the same day.

Speaking to news agency she said, "I was asked to submit a document for the medical claim and when I did that, they asked me about it (HIV). I told them I got it from my husband and within 30 minutes, they forced me to resign. I was working there as a trainee operator for 5 years."

However, the woman has claimed that she was verbally told by the company that the reason behind her removal is HIV but the documents she was provided clearly mentioned "absenteeism" as the reason.

The woman further claimed that she had joined the company after a leave of two months for her health issues and suddenly after working for about a week when she was found positive with HIV and was to resign by the company.

Advocate Vishal Jadhav, who appeared for woman told ANI, "An employee was terminated on the basis of being tested positive for HIV, however, the company claims that the employee resigned herself."

The employee then challenged the company order in a court in Pune. The court found that no employee can be terminated on being tested positive for HIV as the termination can only take place under the frame of law, which was not done in this case.

"The company was asked to reinstate her in the same post she was in, along with providing all the back wages," he added.

The woman was found positive with HIV through her husband who died from the disease. She was also boycotted by her in-laws for her disease.

Bareilly (UP), May 19: Samajwadi leader Chhotelal Diwakar and his son, Sunil Diwakar, were shot dead in broad daylight in Sambhal district of Uttar Pradesh on Tuesday. The entire incident was caught on camera.

The murder was apparently a fallout of a dispute over laying of a road under MGNREGA.

Chhotelal Diwakar had contested the 2017 assembly elections on a Samajwadi Party ticket.

Superintendent of Police, (SP), Sambhal, Yamuna Prasad, said, "Some work was being carried out under MGNREGA due to which some dispute happened. Two people have been shot dead. We will reach the spot of the incident to find more details."

According to his family members, Diwakar and his son had gone for a walk in the fields when the assailants came on a motorbike and after a brief altercation, shot them dead. They fled on foot, leaving their motorbike behind.

A large number of SP workers reached the village soon after the news of the double murder spread.

SP Yamuna Prasad who reached the spot that falls under Behjoi police station, soon after the murders, said that a manhunt has been launched for the assailants. He said that further investigations were underway and the bodies have been sent for post mortem.

Bijnor, May 24: A man died after he was attacked by his cousins, allegedly for not getting tested for the Coronavirus after his return from Delhi.

The incident took place in Malakpur village in Bijnor district.

Manjeet Singh (23) died on Friday during treatment in Meerut.

A FIR has now been registered against Manjeet's cousins, Kapil and Manoj, their mother Puniya and Manoj's wife Dolly at the Nahtaur police station on a complaint filed by the father of the deceased Kalyan Singh on Sunday.
SHO, Nahtaur police station, Satya Prakash Singh said that no arrests have been made yet.

According to reports, Manjeet died due to head injuries.
His sample was not collected for a Coronavirus test by doctors during treatment.
Additional SP, Bijnor, Sanjay Kumar said, he underwent thermal screening when he reached Bijnor on May 19 from Delhi. The report was negative so his sample was not collected.

SHO Satya Prakash Singh said, "Since his return, Kapil and Manoj were regularly asking Manjeet to get his test done. On Thursday, the cousins again asked Manjeet to get his test done after which an argument ensued between them."

"The accused brought sticks and started hitting Manjeet. He suffered injuries on the head and shoulder. When Manjeet fell unconscious, he was rushed to government hospital by his parents where he succumbed to injuries a day later," said Singh.

Chief Medical Officer, Bijnor, Dr Vijay Yadav said he has "no information" about the matter.

New Delhi, Jun 8: A 10-month-old girl allegedly lost her life in an accident in West Delhi's Tilak Nagar area, the police said on Sunday.

"The incident took place when the baby was in the compound of the parking area at the ground floor of her residence and the driver of Mercedes Benz was reversing the car," a police official said.

The deceased was identified as Radhika, whose father Rakesh used to work as the security guard in the said residence.

The unfortunate incident occurred at around 3.30 p.m. in the afternoon following which the baby was rushed to Deen Dayal Upadhyay (DDU) Hospital where she was declared brought dead.

The owner of the said Mercedes Benz SUV is identified as Jassbir Singh who is into elevator business. At the time of the incident, his driver Akhilesh was driving the said vehicle.

"The offending vehicle has also been taken into possession and the FSL team is being summoned for inspection. Investigation in this matter is underway," said Deputy Commissioner of Police (DCP) West Delhi.
