Bengaluru, Feb 29: While arguing against the bail of Mohammed Nalapad, the prime accused in Bengaluru’s UB City cafe assault case, at the City Civil and Sessions court on Monday Special Public Prosecutor Shyam Sundar, termed the attack on Vidvat “an act of terrorism and barbarism, which had created a fear psychosis among the people”.

He said granting bail to the accused would hamper the investigations. He recalled that the the accused, after assaulting Vidvat in the cafe, followed him to the hospital and attacked him again. “The very act shows influential people showing power over the defenceless and common people,” Mr. Sundar said, adding that the victim, his family, and the witnesses in the case would be pressurised and threatened if bail is granted.

The investigation is in progress and the police are yet to record Vidvat’s statement, and granting bail would hamper further investigations, he said.

“The attack was on a person who could not offer resistance, and was almost beaten to death. The attack was unprovoked and brutal in nature and granting bail would set a bad example to society,” Mr. Sundar added.

Tomy Sebastian, the advocate representing Mohammed Nalapad, sought Vidvat’s medical report to ascertain nature of injuries. “The incident is hyped as the family of the victim in the case is highly influential. The accused does not have any record of criminal history. The attack was not intentional and the assault was on the spur of the moment. Moreover, the accused in the case surrendered before the police. There is also a counter-complaint by one of the accused in the case,” Mr. Sebastian said.

Objecting to this, the prosecution said that the counter-complaint filed by the accused was to hamper investigations.

The prosecution also said there was no mention of Mohammed Nalapad in the complaint, though CCTV footage from the hospital clearly shows him attacking Vidvat. Also, the time mentioned in the counter-complaint of the accused — 12 a.m. — cannot be true as the victim was in hospital at the time, as per medical records, said Mr. Sundar.

Meanwhile, continuing investigations, officials of the CCB visited the cafe and questioned staff members. The police have also recovered CCTV footages from the cafe. However, CCB officials could not record the statement of Vidvat as he was not been able to speak properly, a senior police officer said.

Assuring a fair probe in the assault, Home Minister Ramalinga Reddy on Monday said that he will direct the police to probe alleged possession of half a dozen firearms by Mohammed Nalapad. The Home Minister told presspersons here that it had come to his notice that the accused had boasted about firearms in social media platforms. “His father has a firearm licence. However, during the search by the police on his residence no such firearms were recovered. I will ask the police to look into it again.”

To a question on why rowdy sheet was not being raised against him, Mr. Reddy said: “The police commissioner will have to decide on that issue.” He also acknowledged that the accused had been involved in three to four incidents earlier, but there were no complaints in those cases. “To some degree, this incident has damaged government (reputation) and it has also caused embarrassment,” he added.

Bengaluru, Jul 28: Several state Congress leaders, including its President D K Shivakumar, among others, were detained by police as they tried to march towards Raj Bhavan here against the alleged attempts by BJP to topple the party's government in Rajasthan.

Shivakumar, along with Leader of the Opposition Siddaramaiah, state Congress Working President Eshwar Khandre, Salim Ahmed among others were stopped by the police midway as they marched from KPCC office towards Raj Bhavan.

Congress leaders then staged a dharna at the place where they were stopped. Addressing the gathering, Shivakumar accused the BJP of trying to "murder" democracy by destabilizing and removing elected governments.

"We wanted to protest against it and submit a memorandum to the President through the Governor," but the Karnataka government by using police was not letting them proceed towards Raj Bhavan, he said. "Despite our being a peaceful protest, the police stopped us," he said.

Siddaramaiah, echoing similar views, said peaceful protests against injustice was the right of every citizen. Alleging that the BJP was attempting to destabilise and remove the elected government in Rajasthan as it did in Karnataka and Madhya Pradesh, he said the Governor's office there (Rajasthan) was being 'misused'.

The Governor was working like an agent of the central government, he charged. He said, despite repeated appeals by the Rajasthan cabinet, the Governor there had not convened the assembly session, for the floor test to take place and for Congress to prove its majority. Police subsequently detained Shivakumar and some other Congress leaders and took them to a nearby police station.

They were later released. Meanwhile, as the Congress' protest amid Covid19 pandemic did not follow social distancing norms, Medical Education Minister K Sudhakar hit out at that party's leaders. In a tweet Sudhakar said, for Congress leaders getting publicity was more important than social concerns.

A 32-year-old Dalit man was allegedly stripped and assaulted by a group of 13 youth in Karnataka's Vijayapura for reportedly touching a motorbike of an upper caste owner, police said on Monday.

"On a complaint by the Dalit victim (Kashinath Talwar), we have booked the 13 accused and investigating the incident, which occurred at Minajgi village near Talikoti on July 18," Vijayapura district Superintendent of Police Anupam Agarwal told reporters here.

"Though Talwar claimed that he touched the bike by mistake and pleaded for mercy, he said the accused severely thrashed him with sticks and footwear and took off his pants while he lay on the road haplessly," Agarwal said, citing from the victim's 2-page complaint in Kannada.

A video clip of the assault went viral on the social media and triggered outrage in the district against the upper caste accused, as the intervention by the victim's parents did not stop them from carrying the assault. Vijayapura is 524km northwest of Bengaluru.

Talwar's father Yankappa also alleged that he, his wife and their daughter were also attacked by the accused when they tried to rescue him from being brutally assaulted.

In a related development, two-three women in the village also filed a complaint with the police against Talwar for allegedly eve-teasing and 'flashing' before them.

"We have summoned Talwar to inquire about his conduct as the women alleged that he teased them, touched them inappropriately and exposed his private parts while they were washing clothes outside their houses," Agarwal said.
