Will deal with only legal aspect of triple talaq: Supreme Court

New Delhi, Feb 14: Supreme Court on Tuesday said it would decide issues pertaining to "legal" aspects of the practices of triple talaq, 'nikah halala' and polygamy among Muslims and would not deal with the question whether divorce under Muslim law needs to be supervised by courts as it falls under the legislative domain.muslim-marriage copy

"You (lawyers for parties) sit together and finalise the issues to be deliberated upon by us. We are listing it on Thursday for deciding the issues," a bench comprising Chief Justice J S Khehar and Justices N V Ramana and D Y Chandrachud said.

The bench made it clear to the parties concerned that it would not deal with the factual aspects of the particular case and would rather decide the legal issue.

"We are not interested with facts at all. We are only interested in dealing with the legal issue," the bench said.

The apex court said that the question whether divorce under Muslim Personal Law needs to be supervised by either courts or by a court-supervised institutional arbitration falls under the legislative domain.

The court, meanwhile, allowed the lawyers to file small synopsis of cases pertaining to alleged victims of triple talaq.

The Centre had earlier opposed the practice of triple talaq, 'nikah halala' and polygamy among Muslims and favoured a relook on grounds like gender equality and secularism.

The ministry of law and justice referred to constitutional principles like gender equality, secularism, international covenants, religious practices and marital law prevalent in various Islamic countries.

Responding to a batch of petitions including the one filed by Shayaro Bano challenging the validity of such practices among Muslims, the Centre first dealt with the right of gender equality under the Constitution.

All India Muslim Personal Law Board, however, had rubbished the stand taken by the Narendra Modi government that the apex court should re-look these practices as they are violative of fundamental rights like gender equality and the ethos of secularism, a key part of the basic structure of the Constitution.

Another prominent Islamic organisation Jamiat Ulema-i-Hind told the court there is no scope for interference with the Muslim Personal Law in which triple talaq, 'nikah halala' and polygamy are well rooted and stand on much higher pedestal as compared to other customs.

Who is he to say what is good for Indian Muslims? Can I say that beef is good for Brahman and it is law that every Brahman should eat beef along with vegetables? Triple talaq in one sitting is not widely practiced in India but it is ISLAMIC LAW which can be applied in rarest of rare case subject to Qazi'? approval. Triple talaq in 3 sitting is widely practiced in Indian society. Govt should think about improving people'? lives rather than peeping in people'? bedrooms and bathrooms.

Bengaluru, June 19: Karnataka Chief Minister B.S. Yediyurappa''s home-office in the city centre was shut for sanitisation after the husband of a woman employee working there tested COVID-19 positive, an official said on Friday.

"The chief minister''s home-office has been closed for sanitisation after the employee''s husband tested positive for coronavirus," an official of the Chief Minister''s Office told media persons here.

The employee did not report for duty for two days after her husband was infected with the virus.

"The chief minister''s engagements, including an official event involving the state police department were shifted to the Vidhana Soudha (state secretariat)," said the official.

As the employee was on outpost duty, she did not come in contact with the Chief Minister or his cabinet colleagues and other senior officials.

Earlier in the day, the divisional railway manager''s office in the city centre was shut for sanitisation after a visiting employee tested positive for coronavirus.

"The three-floor DRM office has been closed for the day for santisation and all employees have been advised to work from home as one of our staffer who visited the office early this week tested positive for COVID-19 on Thursday," senior Divisional Commercial Manager Krishna Reddy told media persons here.

The DRM''s office is located adjacent to the Krantivira Sangoli Rayanna (KSR) main railway station in the city centre.

The state''s mini secretariat Vikas Soudha adjacent to the iconic Vidhana Soudha in the city centre has also been shut for sanitisation after a government employee working in it tested COVID positive.

The Bruhat Bengaluru Mahanagara Palike (BBMP), entrusted with the task of containing the virus spread, has already sanitised a portion of the massive building in the city centre.

After an employee of the food and civil supplies department tested positive, all offices on the ground floor of the mini-secretariat were sealed and sanitised.

The city registered 17 fresh cases on Thursday, taking the total number of positive cases to 844. With 14 discharged earlier in the day, 384 have been cured of the infection, while 408 are under treatment.

Of the 114 COVID deaths across the southern state since March 10, Bengaluru has accounted for 51 till date.

Bengaluru/ Mangaluru, Aug 3: For the first time in many days, if not weeks, the number of recoveries in Karnataka was higher than new covid-19 cases in the state raising hope of some relief against the virus.

Karnataka confirmed 4752 new covid- 19 cases while the number of recoveries stood at 4776 in the 24 hours until 5 pm on Monday. The state also recorded 98 deaths. 

Medical education minister K.Sudhakar said that the recovery rate in Karnataka is at around 42%

"Everyday there is increase in recovery rate which is higher by 9.17% in Bengaluru city. Overall recovery rate of the state by Sunday evening was 42.81 % and it is 35.14% in Bengaluru," the minister posted on Twitter.

The total number of cases in Bengaluru crossed the 60,000 mark including 1497 cases on Monday.

The total number of cases in Mysuru breached 5000 cases as 372 persons tested positive. The mineral-rich district of Ballari recorded 305 cases. Other parts of Karnataka has seen a surge in cases with 15 out of the 30 districts reporting at least a 100 cases.

Dakshina Kananda

Dakshina Kannada district alone has recorded 153 new cases and seven deaths. 
Among the 153 new cases, 119 are from Mangaluru, 11 from Bantwal, six from Beltangady, four from Puttur, one from Sullia, and 12 from other districts.

The total number of covid positive cases in the district mounted to 6,168. Out of these, 3,138 cases are currently active. As many as 2,854 persons have recovered and been discharged, and 176 deaths have occurred so far.

Udupi

Udupi reported 126 fresh cases past 24 hours, according to health bulletin released by the Udupi district administration. They include 58 from Udupi, 34 from Kundapur, 28 from Karkala, and six from other districts. 

A total of 34,500 samples have been collected so far. 29,174 have turned out to be negative. As many as 4,800 confirmed cases of coronavirus have been reported so far in the district. 

As many as 2,812 patients have been discharged so far, and 1,952 cases are currently active. As per district bulletin, 36 deaths have occurred so far. One positive case has been transferred to Dakshina Kannada.

New Delhi, Jan 28: The Supreme Court of India today granted bail to 17 convicts sentenced to life imprisonment in 2002 Gujarat massacre case, pending their appeal before the Supreme Court.

The convicts also have to participate in social and spiritual services, said the court, announcing the riders for bail.

The Bench of Chief Justice of India SA Bobde and Justices BR Gavai and Surya Kant directed for the convicts to be segregated into two groups to be sent to Indore and Jabalpur.

District legal authorities in Indore and Jabalpur in Madhya Pradesh have been asked to ensure that the convicts do the spiritual and social work the court has asked for.

The Supreme Court has also asked the administration to find them work for livelihood. The state legal services authority has been asked to file a compliance report as also report on their conduct.

The case concerns the mass killing of 33 innocent Muslims - mostly women and children - who were burnt alive at Sardarpura village in March 2002.

This was part of the mass massacre that swept through Gujarat in the aftermath of the death of train passengers on Sabarmati Express in Godhra on Feb 27, 2002. Thousands of innocent Muslims were killed and raped in the three-day violence. The victims include hundreds of children including newborns.

In 2016, the Gujarat High Court had upheld the conviction of 17 accused in the Sardarpura massacre case.

Earlier, a Special SIT court had convicted a total of 31 persons in the case, after three years of trial against 73 persons from Sardarpura and nearby villages.

Justice delayed is Justice denied!!!! Supreme court since last 6 months taking decission not as per Just. please Uphold the Supreme court Honour as its noble institution.as culprit must be punished so has to set example for the wrong doers.

For the sake of God please do not call them JUSTICE. If they str aware of meaning of word justice then they would have given death penalty to all the culprits. So sad that supreme court of india is running as per the instructions of MODI govt. RIP Justice
