NIA court convicts 13 Muslim youths in 2012 terror module case

September 16, 2016

Bengaluru, Sep 16: A National Investigation Agency (NIA) special court here on Thursdayconvicted 13 persons accused in the Karnataka terror module case, wherein several educated Muslim youths were arrested from their houses and rented rooms in Bengaluru, Hubballi and other places four years ago.

niaSources in the NIA said that this was the first time the accused have pleaded guilty in a terror case. Special court judge Muralidhar Pai adjourned the case to Friday, when he will pronounce the quantum of punishment.

The charge was that the youths had planned to assassinate several prominent personalities including BJP leaders and pro-BJP journalists. Later, a couple of the arrested youths had got clean chit in the case. Some of the accused are still absconding, according to the NIA. The arrest spree started on August 29, 2012 when a team of the Central Crime Branch of the Bengaluru City police nabbed two bike-borne youths in Basaveshwaranagar police limits.

The convicted are: Syed Tanzeem Ahmed of Ben galuru, Dr Imran Ahmed of Bengaluru, Dr Nayeem Siddiqui of Davanagere, Ubaid Ur Rehman of Hyderabad, Shoaib Ahmed Mirza alias Chotu of Hubballi, Abdul Hakeem Jamdar of Hubballi, Riyaz Ahmed Byahatti of Hubballi, Zafar Iqbal Sholapur of Hubb alli, Moha mmed Sa diq Lashkar of Hubballi, Mehaboob Bagalkot of Hubballi, Baba alias Mehboob Bagalkot and Wahid Hussain alias Saahil.

Public prosecutor Arjun Ambalapatta said, the conviction was made mainly under IPC sections 120B (criminal conspiracy), 153A (promoting enmity between different groups on grounds of religion), 307 (attempt to murder) and Section 38 of the Unlawful Activities Prevention Act and Arms Act, and Section 3 read with 25 of the Arms Act, 1959. The sections invoked entail prison terms of up to 10 years.

Police said the suspects were linked to Lashkar-e-Taiba and Harkat-ul-Jehad-al-Islami, and were being directed by handlers in Saudi Arabia to eliminate prominent personalities, including a newspaper editor, a newspaper columnist who is now a BJP MP representing Mysuru-Kodagu constituency, and right-wing leaders.

The case was later transferred to the National Investigation Agency. Six months after the arrests, NIA released two of the suspects, saying there was no prosecutable evidence against them, while a court released on bail a third suspect after the agency failed to file a chargesheet within the stipulated six months of the arrest.

Pleaded guilty in the hope of early release'

The Federation of Muslim NGOs has regretted that the 13 accused pleaded guilty because they were unable to bear the torture of remaining in prison.

"It is a sad reflection of the way investigations are being conducted in terror-related cases. Hundreds of witnesses are cited and a chargesheet running into several thousand pages is filed. The trial takes several years to complete. The draconian Unlawful Activities Prohibition Act ensures no bail is granted and the accused, even if innocent, have to spend several years in jail," read the statement.

"We further call upon the government to ensure the trials are expedited and the Act is amended to ensure bail is granted when proof is not convincing .... Call upon to form an independent review committee comprising a HC judge ... to review the evidence collected before granting sanction for prosecution to ensure innocents are not harassed," read the statement.

"Police say they have ample material evidence against our children. They have been in jail for too long now and have not got bail. Instead of dragging the case, our children agreed to plead guilty as they have already spent four years in jail, and undergo punishment. At least now they can look at an early release after they complete their terms," a family member said, on condition of anonymity.

Only 32 Of 260 gave evidence

The 13 accused stood motionless as NIA special court judge Muralidhar Pai held them guilty, while some of their family members let out exclamations of disappointment.

Around 10.30am Thursday, the men were brought in police vans, each accompanied by a policeman, as they walked to court hall 54 on the third floor of the City Civil Court complex. The judge said he would pronounce the judgment by 3pm. The men were taken out for lunch in the van and brought back to the hall by 2.30pm.

The 13 accused had been denied bail and were in jail during the course of the trial, where only 32 of the 260 witnesses turned up to give evidence.

Who said terror does not have any religion. Anything or nothing can become a terror act if the arrested are Muslims. and any terror act can become nothing if the arrested are Sangh Parivar activists.

Kochi, Jan 16: Kicking up a debate, an influential Catholic Church in Kerala has said "Love Jihad is a reality" and alleged that scores of women from Christian community from the southern state were being lured into the trap of Islamic State and used in terror activities.

The synod of Syro-Malabar Church, an apex body of Catholic Bishops chaired by Cardinal George Alencherry, also accused the state police of not viewing the matter cautiously and taking timely action in 'Love Jihad' cases.

Denying the charges, the Popular Front of India (PFI) questioned the "timing" of the statement and urged the Church to withdraw it immediately "as it would only help create division amid growing unity among various sections of society against Hindutva Fascism."

The Viswa Hindu Parishad (VHP) welcomed the Church statement and called for a united fight against 'Love Jihad' in Kerala Society.

An official of the Kerala State Women's Commission refused to comment, considering the sensitivity involved in the matter.

There was no immediate reaction from the police and government as well.

"There are circumstances in which Christian girls are killed in the name of Love Jihad in Kerala," the Synod has alleged in a statement issued through Syro-Malabar Media Commission here on Tuesday night, referring to the attacks against Christians across the world.

The Synod has termed as "shocking" the killing of Christians in Nigeria on Christmas day.

It is a matter of concern that Love Jihad is gaining grounds in Kerala putting in danger its social peace and communal harmony, the Synod said.

"It is a reality that 'Love Jihad' is happening in Kerala in a planned manner targeting Christian girls," it said.

The Synod, referring to a police record, said out of 21 people who were recruited into Islamic State terror outfit, half of them were converted from Christian faith and it should be an eye opener for the community.

Noting that unofficial accounts say many girls were being used in terror activities through Love Jihad, the Synod said it was a serious matter and such accounts state that Love Jihad is not only "in the imagination".

The Synod, however, said it was not assessing the 'Love Jihad' as an issue affecting the friendship between religions and urged the government to treat it as one related to law and order and not as a religious matter.

The Church demanded speedy action against the culprits involved in the 'Love Jihad.'

It also called for efforts to sensitise parents and children about the dangers of Love Jihad.

The PFI, often being accused of playing key roles in alleged 'Love Jihad' cases in Kerala, claimed that the state police, after conducting a thorough probe, had earlier submitted a report in the Kerala High Court, stating that there was no cases of 'Love Jihad' in the state.

"The Church is raising such a baseless allegation at a time when the minorities including Muslims and Christians and the people of Hindu community are in a joint fight against the Fascist government at the Centre.

Their untimely statement would only help divert the people's attention from the key issues that society is facing at present", PFI State President Naziruddin Elamaram told PTI.

Urging the Bishops to immediately withdraw the statement, he said, "I don't know what is their interest in making such a statement at this juncture."

Not a single Muslim community is holding 'Love Jihad' to increase the number of Muslims here, Elamaram claimed.

He, however, said there were instance of inter-religious marriages in Kerala in which Muslim girls marrying Hindu and Christian boys and Hindu and Christian girls selecting partners from the religions of their choice.

Such marriages cannot be termed as 'Love Jihad', he said.

Asked about the Bishops' allegations that Christian girls are targeted and recruited to Islamic State terror outift, the PFI leader said not a single Muslim organisation in India have recognised the Islamic State and such recruitments should not be seen as part of a 'jihad' as doubts prevail in minds on who created the IS.

Former president of the VHP, SJR Kumar claimed that 'Love Jihad' exists in Kerala society.

He alleged that there were centres in Kerala to "convert Hindu and Christian girls who are being lured into the trap of love by youths with criminal backgrounds".

"We have brought this issue into the attention of the Kerala society much earlier. But nobody listened to us.

Now, we are happy that the Bishops have realised the threat of Love Jihad. It is the time of a joint fight against this menace," Kumar told PTI.

He also alleged that Muslim men trap Hindu and Christian women into marriage and forcing them to convert to Islam.

"The converted Hindu and Christian girls are being used in drug trafficking and terrorism," Kumar said.

Mangaluru, Jan 15: The coastal city of Mangaluru witnessed a historic event as a sea of humanity converged at the Shah Gardan Maidan in Adyar-Kannur to register their protest against the Citizenship (Amendment) Act (CAA), National Register of Citizens (NRC) and National Population Register (NPR) besides the “categorical mistreatment” of Muslim community at the hands of the police across the country including in Mangaluru.

The protest is jointly being organised by the various Muslim organisations of Dakshina Kannada and Udupi district under the leadership of Muslim Central Committee.

The main staged is named after Shaheed Jaleel Kudroli and Shaheed Nausheen, who were ruthlessly gunned down by the police during a chaos that erupted on December 19 in the city due to police batten charge against people during a minor protest against NRC.

Even thought the police had banned public transport and blocked the highway to reduce the number of protesters, around one-and-a-half lakh people had reached the venue when the historic meeting commenced at 2:30 p.m. By 4 p.m. the number of protesters crossed 2 lakh, according to the organisers.

Both sides of the highway were filled with those who came to witness the rally and traffic went haywire along a five-kilometre stretch of the road. The people who took part in the rally were seen waving national flags.

The protest rally was inaugurated by Udupi Khazi Bekal Ibrahim Musliyar. Dua was offered by Dakshina Kannada Khazi Twaka Ahmed Musliyar.

Addressing the protesters, former IAS officer and activist Kannan Gopinathan alleged that the Centre wants to create fear among all sections of people and silence them. Society began to protest when the government crossed the limits and put curbs on democratic freedom, he claimed.

The Centre thought that they can get away with CAA and NRC. However, people have realised the truth and have started coming out onto the streets, Gopinathan added.

Activist Harsh Mander said the theme of the protest against the CAA and NRC is "national flag in one hand, Constitution is another and people will march forward with love in their hearts”.

“The fight against NRC is the fight for the protection of our Constitution. The BJP is using NRC as a weapon to divide the people after Article 370 and Ram Mandir construction," he said and warned the Centre: “The more you try to divide us, the stronger and united we’ll be”

Human rights activist Shivasundar said the "chowkidar" appointed by the people is now asking them whether they are the real owners of their houses.

The BJP only delivered hollow promises which is evident from the rising unemployment, fall in GDP, farmers suicides and the economic slowdown, he alleged.

MLA UT Khader, MLC BM Farooq, former MLA Mohiyuddin Bava, Muslim central committee president KS Mohammed Masood, Ullal Qazi Fazal Koyamma Tangal, Dakshina Kannada district Wakf committee president UK Monu Kanachur, Sunni Youth Federation state general secretary Abdul Rashid Zaini and Karnataka Samastha Mushavara state secretary UK Abdul Aziz Darimi were present among others.
